BE IT RESOLVED by the Co�on Council of the City of Oshkosh [hat the followLng
attached resolution regarding a new compliance schedule to correct bypasses
and overflows in the sewer system is hereby approved.

RESOLUTION
Oshkosh desires to continue to extend its Sanitary
areas which do not affect uncorrected bypasses and
WHEREAS, the City of Oshkosh by previous resolution, has agreed to, and
remains committed to the elimina*.ion of all Category 1 bypasses and over—
flows no later than July 1, 1986, and;
WHEREAS, that previous resolution also contained interim deadlines of April
1, 1982 for submittal of a Sexer System Evaluation Survey (SSES), and July
1, 1982 for submittal of a facilities plan, and;
WHEREAS, rainfall occurences and quantities have been significantly less
thzn anticipated, thus delaying gathering of data needed to complete the
SSES and facilities plan, as discussed in the attachments, and;
WHEREAS, findings to date appear to indicate that eventual corrective
measures may require less design and construction time than had originally
been anticipated, and;
WHEREAS, the City of Oshkosh is already acting promptly to correct infil—
tration and inflow problems as they are found by its engineering con—
sultants, instead of aaiting for finalization of the SSES, and;
WHEREAS, the Wisconsin Department of Natural Resources is now denying
extension of city sewers in all areas of the City, including those which
have no effect whatever on the bypassing and overflows, and;
WHEREAS, the City of Oshkosh is taking all neasures over which it has
control to meet its commitments in good faith,
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Osh—
kosh, that the Wisconsin Department of iJatural Resources is hereby re—
quested to establish a new compliance schedule for the City of Oshkosh
relative to the ability of the City to obtain approvals for future seWer
extensions in those areas of the City uhich do not affect the byoassing and
overflows, as shown below and subject to the conditions listed in the
previous resolution.

Preparation of the schedule for the SSES was based on historical records
which indicated an average frequency of ineasureable rainstorms to be one
every 10 days during the fall and spring rainy seasons. If this had
occurred as planned, flow monitoring of the north side vould have been
completed in the fall of 1981, and flow monitoring of the south side Would
have been completed in the early spring of 82. A total of 8 rainfall
events is required to fully monitor both sides. To date, the combination
of an exceptionally dry fall '81 period, and an extended uinter '82 period,
has produced only 5 of the required events. While rainfall quantities have
been close to normal, these quantities have resulted from the effect of
several large storms, and from several storms that exhibited characteris-
tics Which were not well suited for production of f1oN monitoring data.

The Department is in receipt of a resolution passed and adopted by the Comnon
Council of the City of Oshkosh on June 3, 1982. The resolution amended a
previous resolution which was passed by the Common Council on April 2, 1981.
The original resolution and supporting documentation stated that the City of
Oshkosh will improve its sewerage system in order to correct wet weather
bypassing and overflows. This task will be carried out regardless of the
availability of state or federal funds. The resolution passed on June 3, 1982
alters the time schedule which was set forth in the original resolution.
Receipt of this resolution completes information necessary to process sewer
extension applications by this Department under s. NR 110.05(4)(c), Wisconsin
Administrative Code.
To ensure that the City of Oshkosh understands the commitments it has made in
the original resolution and the new resolution, they are summarized below:
1. The city has resolved to submit the Sewer System Evaluation Survey to the
Department by October 1, 1982
2. The city has resolved to submit the facilities plan to the Department by
January 1, 1983.
3. The city has resolved to submit plans and specifications for the sewer
system rehabilitation contracts for the North Side projects to the
Department by June 1, 1983.
4. The city has resolved to submit plans and specifications for the sewer
system rehabilitation contracts for the South side projects to the
Department by October 1, 1983.
5. The city has resolved to award contracts and commence construction of the
sewer rehabilitation projects for the North Side by December 1, 1983.
6. The city has resolved to award contracts and commence construction of the
sewer rehabilitation projects for the South Side by March 1, 1984.
7. The city has resolved to complete construction of all improvements to
correct all Category 1 bypasses and overflows by July 1, 1986.
8. The city has resolved to carry out the above tasks regardless of the
availability of grants.

The Department has reviewed the proposed schedule and supporting information
supplied by the City of Oshkosh and finds it to be an acceptable program
providing assurances for correction of wet weather bypasses and overflows.
Failure to comply with any of the elements (1-8) outlined above may result in
the denial of subsequent sanitary sewer extension requests.
