HomeMy WebLinkAbout31983 / 82-21July 1, 1982 /i 21 RESOLUTION PURPOSE: INITIAL RESOLUTION FOR GRADING AND GRAVELING INITIATED BY: DEPARTMENT OF PiJBLIC WORKS BE IT RESOLVED by the Common Council of the City of Oshkosh as follows: 1. The Common Council hereby declares its intention to exercise its power under Section 66.60 of the Wisconsin Statutes to levy special assess- ments upon property within the following described areas for benefits con- ferred upon such property by improving the following named streets, said public improvements to include the following: GRADING AND GRAVELING Nicolet Avenue - From Bowen Street to Harrison Street. 2. Said public improvement shall include the grading of the above named street to the grade hereafter established by special ordinance of the City of Oshkosh. 3. Before such impYovements are made, the Board of Public Works is directed to cause water and sewer service pipes to be laid in said streets from the mains to the curb line of each lot fronting on the said streets and to keep an accurate account of the expense incurred in front of each lot and report the same to the Comptroller who shall cause the amount charged to each lot to be entered on the tax roll as a special tax against said road, provided, however, that the Board of Public Works shall not cause such laterals to be so laid for any particular lot, or parcel where, in the opinion of the Board of Public Works, it would be impractical to do so. 4. The total amount assessed against such district shall not exceed the total cost of the improvements, and the amount assessed against any par- cel shall not be greater tfian the benefits accrued thereto from said WtiO'.°IDf_R�S. 5. The assessments against any parcel may be paid according to the provisions of Section 25-83 through 25-89 of the Oshkosh Municipal Code. 6. The Board of Public Works is directed to prepare a report consisting of: a. Final plans and specifications for said improvements. b. An estimate of the entire cost of the improvements and laterals. c. An estimate as to each parcel of property within the assessment district of: - 21A - July 1, 1982 il 21 RESOLUTION Grading & Graveling Continued (1) The assessment of benefits to be levied for each improvement. (2) The damages to be awarded for property taken or damages by each improvement. (3) The net amount of benefits over damages or of damages over benefits for each improvement. Upon completion of such report, the Board of Public Works is directed to file a copy thereof in the City Clerk's Office for public inspection. 7. Upon receiving the report of the Board of Public Works, the City C1erk is directed to give notice of a public hearing on such reports as specified in Section 66.60(7) of the Wisconsin Statutes. The hearing shall be held by the Board of Public Works at the Council Chambers in the City Aall at a time set by the Clerk in accordance with Section 66.60(7) of the Wisconsin Statutes. 8. The installation of said street improvements shall be accomplished according to the provisions of Section 25-3 through 25-11 of the Oshkosh Municipal Code.
