HomeMy WebLinkAbout32003 / 82-04July l, 1982 FIRST FEADING R E V I S E D 117 ORDINANCE PURPOSE: CIiARTER ORDINANCE OF THE CITY OF OSHKOSH ALLOtdING THE BOARB OF APPEALS TO ELECT I't5 OLN CHAIRI�SA.*I ZrITIATED BY: CITY ADMINISTRATION A CHARTER ORDINANCE OF THE CZTY OF OSHKOSH AMENDING SECTION 30-23(A) OI' TItE OSHKOSH MUNICIPAL CODE CONFORMING TO SECTION 62.23(e)2 OF THE WISCONSIN ST�TU�rES .. � WHEREAS, Section 62.23(e) of the Wisconsin Statutes mandates that cities create a Board of Appeals having powers to make special exceptions to the zoning ordinance; and WHEREAS, Section 62.23(e)2 provides that the Chaireian of said Board be designated by the Mayor; and WEiEI:EAS, the City of Oshkosh desires that the Board of Appeals elect its own Chairman; NOW, TfiEREFORE, the Co�on Council of the City of Oshkosh by charter ordinance do ordain as follows: SECTION l. That Section 30-23(A) of the Oshkosh Msnicipal Code con- forming to Section 62.23(e)2 of the Wisconsin Statutes pertaining to Lhe cx'eation of the Board of Appeals is hereby amended to read as follocas: SECTZON 30-23 CREATION OF BOARD OF APPEALS (A) The Board of Appeals shall eonsist of five (5) members ap- pointed by the Mayor and approved by the Cosmon Council for a tenn of three �3) yaars, except thzit of those iirst ap- pointed, one (1) shall serve for on2 (1) yeax, two (2) for two (2) years, and two (2) for three (3) years. The members shall serve without compensation. The Board uf Appeals sha11 elect one (1) of its members as Chairman. The T:ayor shall appoint, and the Council. approve, two (2) alternate members. for a term of three (3) years, who shall act with fu11 power, only when a member of the Board of Appeals refuses to vote because of conflict of interest or in a r�ember's absence. Vacaacies shall be filled for the unexpired terms of nembers whose terms becoae vacant. �'�. July 1, 1982 ;E7 Charter Ordinance Board of Appeals Continued SEGTION 2. That after passage of this charter ordinance the Clerk is hereby directed to publish it as a Class 1 notice under Chapter 985 of the Wisconsin Statutes; record it in a permanent book kept for that purpose, with a statement of the manner of its adoption; and file a certified copy thereaf with the Secretary of State. SECTION 3. That this charter ordinance shall be subject to the pro- visions of Section 66.01 of the Wisconsin Statutes. SECTION 4. That this charter ordinance shall be in full force and effect from and after sixty days after its passage and date of publication.
