HomeMy WebLinkAbout14. 15-362 JULY 14, 2015 JULY 28, 2015 15-349 15-362 ORDINANCE FIRST READING SECOND READING (CARRIED___7-0_____LOST________LAID OVER________WITHDRAWN________) PURPOSE: REPEAL & RECREATE A PORTION OF THE STREETS AND SIDEWALKS ORDINANCE / SECTION 25-23 STREET TO REMAIN OPEN TO TRAFFIC DURING COURSE OF EXCAVATION INITIATED BY: DEPARTMENT OF PUBLIC WORKS A GENERAL ORDINANCE OF THE CITY OF OSHKOSH REPEALING & RECREATING A PORTION OF THE STREETS AND SIDEWALKS ORDINANCE / SECTION 25-23 STREET TO REMAIN OPEN TO TRAFFIC DURING COURSE OF EXCAVATION. The Common Council of the City of Oshkosh does ordain as follows: SECTION 1. That Chapter 25 Streets and Sidewalks, Article VIII. Work in Streets and Public Right-of-Ways, Section 25-23 of the Oshkosh Municipal Code pertaining to streets remaining open to traffic during course of excavation work is hereby repealed and recreated to read as follows: ARTICLE III. WORK IN STREETS AND PUBLIC RIGHT-OF-WAYS SECTION 25-23 STREET TO REMAIN OPEN TO TRAFFIC DURING COURSE OF EXCAVATION WORK. A passageway of not less than 10 feet in the traveled portion of the street must remain open for travel at all times when openings are made into the following: State and County roads, one-way streets, detour routes, Murdock Ave. (Algoma Blvd. to Hazel St.), Bowen th St., W. 9 Ave., Ohio St., Elmwood Ave. (Algoma Blvd. to Irving Ave. and Lincoln Ave. to thth New York Ave.), W. South Park Ave., Knapp St. (9 Ave. to 20 Ave.), Sawyer St. th (Oshkosh Ave. to 9 Ave.), Witzel Ave., New York Ave. (High St. to Hazel St.), Washington Ave. (Main St. to Hazel St.), Algoma Blvd., Taft Ave. (Eagle St. to Koeller St.), Eagle St. thth (5 Ave. to Adams St.), W. 5 Ave. (Sawyer St. to Westfield St.), Hazel St. (Murdock Ave. to Washington Ave.), Irving Ave. (Elmwood Ave. to Hazel St.), Campbell Rd., Harrison St., Pearl Ave. (Main St. to Rockwell Ave.), W. Smith Ave. (Vinland St. to Jackson St.), thth Wisconsin St., W. 20 Ave., Oregon St., Jackson St., W. 24 Ave., Oakwood Rd., Koeller St. and Washburn St. The passageway may be maintained by tunneling, or if tunneling is not practicable or possible, the contractor must proceed partway across the street and must backfill, place a hard surface of hot mix asphalt or concrete (or other surface as approved by the Director of Public Works or designee for emergency repairs), and open the roadway to traffic before continuing the excavation across the street. The above streets may be closed with approval of the Common Council. JULY 14, 2015 JULY 28, 2015 15-349 15-362 ORDINANCE FIRST READING SECOND READING CONT'D SECTION 2. This ordinance shall be in full force and effect from and after its passage and publication. SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #15-362 (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH REPEALING & RECREATING A PORTION OF THE STREETS AND SIDEWALKS ORDINANCE / SECTION 25-23 STREET TO REMAIN OPEN TO TRAFFIC DURING COURSE OF EXCAVATION on July 28, 2015. The ordinance is updated to include West 20th Avenue, Oregon Street, all of Jackson Street, West 24th Avenue, Oakwood Road, Koeller Street and Washburn Street. Elmwood Avenue's limits were updated to reflect the addition of the pedestrian mall. The ordinance would require installation of a hard surface of hot mix asphalt or concrete prior to opening of the portion of the street for travel except in emergency situations as approved by the Department of Public Works. Gohde, Assistant Director of Public Works DATE: June 18, 2015 RE: Approve Revisions to Chapter 25 / Streets & SidewalksSm� Municipal Code Section 25-23, Streets to Remain Open to Traffic During Course of Excavation Work, requires certain segments of roads to remain open to traffic during construction. The roadways include State Highway, County roads, and other streets that carry significant traffic volumes or provide access to significant destinations. Over the years, sections of State Highways and County roads have been transferred to the City and have lost the State Highway or County road designation. As a result, these roadway sections are allowed to be closed to traffic during construction. Also, as the City has grown, new streets have not been added to this section of the Municipal Code. Additional clarification items were also added to this section. These items include segment updates, requirements of the road surface condition in areas open to traffic, and that closure may occur with Common Council approval. ANALYSIS The following roadway sections have been added to the list of streets that must remain open to traffc during construction, unless otherwise approved by the Common Council: • West 20�" Avenue • Oregon Street • Jackson Street • West 24`h Avenue • Oakwood Road • Koeller Street • Washburn Street The requirement that the section of roadway open to traffic be on an asphalt or concrete surface was also added to this section. This will prevent contractors from being able to leave gravel patches in those streets until final restoration is complete. FISCAL IMPACT There is no fiscal impact to the City.
