Second by Council Member Chapin. �arried. f•if:3 A motion was made by Council Member numbers 141494, 141458, and 141515 from Council Member Kutchera. Carried # 1C Propp to remove parcel assessment. Second by A motion was made by Council Member Kutchera to exempt the 75' x 75' property owned by Russell Neumann from assessment under the condition that Mr. Neumann file a letter of intent with the proper City Officials regarding possible future development of his property. Second by Council Member Chapin. Carried. # 1D A motion was made by Council Member Chapin to recalculate the Fred Auclair property regarding the square footage on a 120' depth and reduce the assessment. Second by Council Member Propp. Carried. (Ayes - 6; Noes - 1) A motion was made by Council Member Hulsebosch to amend the amendment requesting Mr. Auclair to file a letter of intent with the proper City Of£icials regarding possible future development of his property. Second by Council Member Teichmiller. Lost. # lE A motion was made by Council Member Kutchera to reduce the assessment on the property owned by Michael Dempsey under the condition that Mr. Dempsey file a letter of intent with the proper City Officials regarding possible future development of his property. StJ�:�(I2TE� B'� r <� 1i?'30C?7ll � ; . ., February 3, 1983 1/ 1 RESOLUTION (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: FINAL RESOLUTION - SANITARY SEWER AND WATER MAIN INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, the Co�on Council of the City of Oshkosh held a public hearing on the 3rd day of Feliruary, 1983, at 7:0� P.M, for the purpose of hearing all interested persons concerning the preliminary resolution and report of the City Manager (Board of Public Works) on the proposed improvements consisting of sani- tary sewer and water main, pursuant to the initial resolution adopted June 17, 1982, by the Oshkosh Common Council of the following named streets: A. SANITARY SEWER 9ND WATER MAIN l. Fond du Lac Road from Chicago & North Western Railroad tracks to Waukau Avenue 2. Stoney Beach Road from Fond du Lac Road to Stoney Beach Avenue 3. Stoney Beach Avenue as platted in Wright's Subdivision 4. Stoney Beach Lane from Stoney Beach Road to 900 feet south of Stoney Beach Road 5. Waukau Avenue from Fond du Lac Road to Lake Winnebago 6. All easements as described in attached F.�chibit A. B. WATER MAIN Waukau Avenue from the west line of the Chicago & North Western Railroad right-of-way to Fond du Lac Road NOW, THEREFORE, BE IT RESOLVED by the Co�on Council of the City of Oshkosh as follows: 1. That the report of the City Manager, acting as the Board of Public Works, pertaining to the construction of the above described public improve- ments, including plans and specifications therefor, is hereby adopted and approved with the following modiEications: a. b. c. -1- February 3, 1983 �k 1 Cont'd. 2. That the action of the City Manager in advertising for bids and to carry out the work of such improvements in accordance with the report of the City Manager and in accordance with the said resolution heretofore adopted, is hereby approved, ratified and confirmed. 3. Tfiat payment for said improvements be made by assessing the cost of the property benefited as indicated in said report, e�ccept as modified herein. 4. That benefits and damages shown on the report as modified are true and correct and are fiereBy confirmed. 5. That the assessments for all projects included in said report are hereby combined as a single assessment but any interested property owners shall be entitled to object to each assessment separately or both assessments, jointly for any purpose of purposes. 6. Tfiat tfie assessments may &e paid in cash, or in installments pursuant to Section 25-83 tfiru 25-89 of the Oshkosh Municipal Code, said deferred payments to bear interest at the rate of ten percent (10%) per annum on the unpaid balance. The City Clerk sfiall publish an installment assessment notice in accordance with Section 66.54(7)(e) of the Wisconsin Statutes in the official newspaper of the City. 7. The City Clerk is directed to publish.this resolution in the OSHKOSH DAILY NORTHWESTERN, the official newspaper of the City. 8. The City Clerk is further directed to mail a copy of this resolution to every property owner whose name appears on the assessment roll whose post office address is known or can with reasonable diligence be ascertained. -2- .
