HomeMy WebLinkAbout32285 / 83-08February 17, 1983 # 8 RESOLUTION (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: INtTIAL RESOLUTION - 1983 PAVING PROGRAM -- PORTLAND CEMENT CONCRETE PAVING INITIATED BY: DEPARTMENT OF PUBLIC WORKS BE IT RESOLVED 6y the Common Council of the City of Oshkosh as follows: 1. The Common Council hereby declares its intention to exercise its power under Section 66.60 of the Wisconsin Statutes to levy special assessments upon property within the fotlowing described areas for benefits conferred upon such property by improving the following named streets, said public improvement to include the following: PORTLAND CEMENT CONCRETE PAVING l. Nicolet Avenue - Bowen Street to Harrison Street 2. Arcadia Avenue - Westhaven Drive to Heritage Trail 3. Mount Vernon Street - E. Gruenwald Avenue to E. Smith Avenue 4. Congress Avenue - Walnut Street to Wisconsin Street 5. Winnebago Avenue - Bowen Street to Rosalia Street 6. Cul-de-sac at end of Sullivan Street 7. Allerton Drive - from e. lot line of Lots 431 & 559 to Maricopa Drive 8. Maricopa Drive - Allerton Drive to Len�ox Street 9• Starboard Court West - Bowen Street west to end 2. Said improvements shall consist of concrete paving as described above and appurtenant work with concrete curb and gutter on both sides of the street at a grade heretofore established by special ordinance of the City of Oshkosh. 3. Before such improvements are made, the Board of Public Works is directed to cause water and sewer service pipes to be laid in said streets from the mains to the curb line of each lot fronting on the said streets and to keep an accurate account of the expense incurred in front of each lot and report the same to the Comptroller who shall cause the amount charged to each lot to be entered on the tax roll as a special tax against said road, provided, however, that the Board of Public Works shall not cause such laterals to be so laid for any particular lot, or parcel where, in the opinion of the Board of Public Works, it would be impractical to do so. 4. The total amount assessed against such district shall not exceed the total cost of the improvements and the amount assessed against any parcel shall not be greater than the benefits accrued thereto from said improvements. -10- February 17, 1983 # 8 RESOLUTION - Portland Cement - Cont'd. 5• The assessments against any parcel may be paid according to the provisions of Section 25-$3 thru 25-$9 of the Oshkosh Municipal Code. 6. The Board of Public Works is directed to prepare a report consisting of: (a) Final plans and specifications for said improvements. (b) An estimate of the entire cost of the improvements and laterals. (c) An estimate as to each parcel of property within the assessment district of: (1) The assessment of 6enefits to be levied for each improvement. (2) The damages to be awarded for property taken or damages by each improvement. �3) The net amount of benefits over damages or of damages over benefits for each improvement. Upon completion of such report, the Board of Public Works is directed to file a copy thereof in the City Clerk's office for public inspection. 7. Upon receiving the report of the Board of Public Works, the City Clerk is directed to give notice of a public hearing on such reports as specified in Section 66.60(7) of the Wisconsin Stawtes. The Hearing shall be held by the Board of Public Works at the Council Chambers in tfie City Hall at a time set by the Clerk in accordance with Section 66.60(7) of the Wisconsin Statutes. 8.
