Home My WebLink About32297 / 83-04March 3, 1983 FIRST READING # 4 ORDINANCE (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: CREATE ORDINANCE REQUIRING THE USE OF FLASHING RED LIGHTS BY SCHOOL BUS OPERATORS INITIATED BY: COUNCILMAN CHAPIN A GENERAL ORDINANCE OF THE CITY OF OSHKOSH CREATING SECTION 27-7.1 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO THE USE OF FLASHING RED LIGHTS BY SCHOOL BUS OPERATORS. WHEREAS, Section 346.48(2)(b)2 of the Wisconsin Statutes prohibits school bus operators from using flashing red lights when loading or unloading passengers in residential and business areas where curbs and sidewalks exist on both sides of the street, and WHEREAS, this law has created safety hazards in certain areas which endanger the children of the City of Oshkosh, and WHEREAS, Section 349.21 of the Wisconsin Statutes empowers cities to permit the use of flashing red lights by school bus operators in residential and busi- ness areas under certain circumstances, NOW, THEREFORE, the Common Council of the City of Oshkosh do ordain as follows: SECTION l. That Section 27-7.1 of the Oshkosh Municipal Code pertaining to the use of flashing red lights by school bus operators is hereby created to read as follows: 27.7.1 (A) The operator of a school bus equipped with flashing red warning lights as specified in Section 347.25�2)> Stats., shall use said warning lights in residence or business dis- tricts where curbs and sidewalks exist on both sides of the street when pupils or other authorized passengers are to be loaded or unloaded at a location at which there are no traffic signals and such persons must cross the street before being loaded or after being unloaded. (B} When flashing red warning lights are used pursuant to sub- section (A), the provisions of Sections 346.48(J) and (2)(a) pertaining to proper use of said lights and approaching motorists, and Sec. 346.49(2)(a), Stats., pertaining to penalties for vio- lating said sections shall apply and are hereby adopted and by reference made a part of this ordinance with the same force and effect as though set out herein in full. SECTION 2.
