HomeMy WebLinkAbout32304 / 83-12MARCH 3 1983 (CARRIED # 12 RESOLUTION LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE AGREEMENT WITH ZION ELDERCARE OF OSHKOSH INITIATED BY: CITY ADMINISTRATION BE IT RESOLVED by the Common Council of the City of Oshkosh, that the proper City officials are hereby authorized and directed to enter into the attached one-year limited agreement with Zion Eldercare of Oshkosh, to provide non-medical care during the day to isolated, moderately handicapped older persons at Zion's Adult Day Care facility located at 1150 Van Buren Avenue, Oshkosh. BE.IT FURTHER RESOLVED that the monies for the stated purpose are hereby appropriated from the 1982 Community Development Block Grant Fund, Account 321-962, Local Option - Eldercare and that such funds will be restricted to only those services to be provided to citizens of Oshkosh and the expenses related to personnel expenses and consumabie office supplies. -15- SL73kIm��D BY APPROVED . . :.� RESOLUTION # 12 AGREEMENT FOR ADULT DAY CARE SERVICES BETWEEN THE CITY OF OSHKOSH A4D ZION ELDERCARE OF OSHKOSH THIS AGREEMENT made and entered into this day of , 1983, bY and between the City of Oshkosh, Wisconsin, a municipal corporation, hereinafter called "City" and Zion Eldercare of Oshkosh, 1150 Van Buren Avenue, Oshkosh, a Wisconsin non-profit, non-stock corporation, hereinafter referred to as "Eldercare": WITNESSETH: 1. The City shall: Provide funding for a one-year period for an amount up to $15,000 to Eldercare for the purpose of personnel expenses and related consumable office supply expenses. Funding for the period of March 14, 1983 to March 14, 1984 shall be paid with the 1982 allocation of Community Development Block Grant funds. Funds to be released monthly upon receipt of proper invoice. 2. Eldercare agrees: A. To set-up an adult day-care service whereby it will provide non-medical care during the day to isolated, moderately handicapped older Oshkosh persons at its facility located at 1150 Van Buren Avenue, Oshkosh. B. To provide services at reasonable rates with adnission preference given to moderate- to low-income families at rates not to exceed $18.00 �or a full day or $10.00 for a nalf day anti sucn t��es will ir,c!ede t.he cost r2lated Lo tne orovisio� of ineals and snacks. C. To provide admission and employment that does not discriminate against individuals based on religion, sex, race, or national origin. D. Eldercare shall, prior to the last payment for services by the City, submit a detailed status and progress report to the Community Development Director and a detailed financial report on Eldercare operations at the end of the contract year. -16- RESOLUTION # 12 PAGE TWO E. To provide, at a minimum, the following services: nutrition services, recreational activities, socialization, rest facilities, and services that are consistent with the Wisconsin Administrative Code H 32.06. INSURANCE: FINANCIAL RESPONSIQILITY A. Eldercare agrees to and does hereby hold the City harmless and does hereby indemnify the City against any claims or demands of any person arising by reason of Eldercare's operation of said services. B. Eldercare shall carry the required workmen's compensation insurance, property damage insurance of not less than $5>000 coverage per occurrence and bodily injury liability insurance of $150,000 coverage per occurrence. C. Eldercare shall require that any claims arising from said operations shail be handled by Eldercare or its insurance carrier and said parties shall defend the City in any litigation arising from such claims, and pay any judgments obtained in any such litigation. PERMITS AND LICENSES A. Eldercare shall obtain and pay for all required permits and licenses in its operation of the service. AMENDMENT TO THE CONTRACT A. Whenever either the City or Eldercare are unable to meet their full responsibility under the terms of this Agreement, adjustments to this Agreement may be mutually agreed upon.
