WHEREAS, the Common Council of the City of Oshkosh on December 6, 1979,
adopted a resolution establishing a uniform extension policy for the extension
of retirement dates of its protective service personnel, including both police
officers and firefighters, and
WI-IEREAS, the Congress of the United States amended the Age Discrimination
Employment Act, making it unlawful for employers to discharge an employee because
of an employee's age and included in that Amendment are protective service per-
sonnel; and
WHEREAS, pursuant to the Congressional amendment, the State of Wyoming
challenged the Congressional act in the case of Wyoming vs. Equal Employment
Opportunities Commission, which case has recently been decided by the U.S.
Supreme Court in favor of the Congressional action, and
WHEREAS, Chapter 41 of the Statutes of the State of Wisconsin still pro-
vides for the normal retirement date of police and firefighters to be age 55,
which provisions are in conflict with the federal pronouncements and which appear
to be in conflict with the recent Supreme Court decision,
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh
in order to reach a compromise between these conflicts, there is hereby established
a policy for retirement of police and firefighters who reach age 55, said policy
shall be as follows:
1. A member of the police or fire service will continue in the employ
of the City if he or she requests so in writing three (3) months prior to his or
her retirement period.
2. This annual extension will be granted until the employee reaches
age 70, at which time, he or she will retire.
3. This resolution and policy shall in no way affect the protective
service employee desiring to retire at either age 55 or any age prior to age
70.
4. The City administration will administer this policy.
