HomeMy WebLinkAbout32382 / 83-01May 5, 1983 N1 RESOLUTION (CARRIED PURPOSE: INITIATED BY LOST IAGU�I�]�1�: WITHDRAWN ) FINAL RESOLUTION VACATING PORTION OF MARION ROAD (NOW CEAPE AVENUE)AND ALLEY SOUTH OF MARION ROAD (NOW CEAPE AVENUE) CITY ADMINISTRATION WHEREAS, pursuant to Section 66.296(2) of the Wisconsin Statutes, the Common Council has heretofore initiated proceedings on March 17, 1983, at a regular meeting of the Common Council to vacate and discontinue the following described street and alley: That part of the First Ward, City of Oshkosh, Winnebago County, Wisconsin, which is bounded and described as follows: Commencing at the N.E. corner of Lot 1 in Moo 2's Subdivision, thence North 00° 59'09" East along the West line of Main Street 28.00 ft. to a point, thence North 89°17'14" West parallel with the existing South line of Marion Street (now Ceape Avenue) 153•00 ft. to a point, thence South 49°38'43" West 42.62 ft. to a point on the existing South line of Marion Street (now Ceape Avenue), thence South 89°17'14" East along the existing South line of Marion Street (now Ceape Avenue) 185•00 ft. to the point of beginning. Said parcel contains 4731•95 sq. ft. (0.109 acres). Generally located extending West from North Main Street. (See Exhibit A attached hereto.) An alley beginning at the south line of Marion Road (now Ceape Avenue) extending south to the dock line, as per attached map. (Exhibit B.) WHEREAS, a public hearing on the passage of such resolution has been set by the Common Council, which hearing was set for 7:00 P.M. in the Council Cham- bers of the City Hall, Oshkosh, Wisconsin, on the Sth day of May, 1983, and written notice of such meeting was duly served on the owners of all of the frontage of the lots and lands abutting upon tliat portion thereof sought to be discontinued as provided by law; and WHEREAS, a public hearing was duly held pursuant to said notice at the time and place therefor affixed and all persons so served and interested were then and there given an opportunity to be heard; and WHEREAS, a proper notice of the pendency of said petition for vacation and discontinuance and maps covering the proposed vacation was duly filed in the office of the Register of Deeds for Winnebago County as required by the Wisconsin Statutes; and WHEREAS, the lots and lands abutting on said street and alley affected by this resolution are all in the lst Ward, City of Oshkosh, the description of said street and alley heretofore set out in this resolution. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that it is hereby declared that since public interest requires it, the following described street and alley in the lst Ward, City of Oshkosh, Winnebago County, Wisconsin, are hereby vacated and discontinued, reserving unto the City of Osh- kosh the right to maintain, service, repair, add or replace all sanitary sewer, storm sewer, water and gas mains and fittings in said vacated street and alley: That part of the First Ward, City of Oshkosh, Winnebago County, Wisconsin, which is bounded and described as follows: Commencing at the N.E. corner of Lot 1 in Moore's Subdivision, thence North pp°59'09" East along the West line of Main Street 28.00 ft. to a point, thence North 89°17'14" West parallel with the existing South line of Marion Street (now Ceape Avenue) 153•00 ft. to a point, thence South 49°38'43" West 42.62 ft. to a point on the existing South line of Marion Street (now Ceape Avenue), thence South 89°17"14" East along the existing South line of Marion Street (now Ceape Avenue) 185.00 ft. to the point of beginning. BE IT FURTHER RESOLVED that the City Clerk record a certified copy of this resolution accompanied with a map showing the location of said vacated street.and alley in the office of the Register of Deeds for Winnebago County. Motion made by Council Member Kutchera, seconded by Council Member Propp to amend the resolution to read "now known as Ceape Avenue wherever Marion Road �ppears".
