The decision of the Board was filed in the Planning Office of the Department of Community Development on May 24, 2001. Section 30-6(C)(1) and (2) of the City of Oshkosh Zoning Ordinance allows the same variance request to be heard 3 times in any 12 month period. If this is the first or second time you have requested this vaziance within 12 months, you may re-apply if you wish. If your variance request has been denied 3 times within a 12 month period, but you feel there has been a change in the circumstances affecting your request, you may submit a request for an additional hearing stating the changes which have occurred. The Board will review this request, and if three Board members feel there is sufficient change in circumstances to warrant an additional hearing, then you may re-submit your variance request through the normal procedure. ROLL CALL APPROVAL OF May 9,2001 MEETING MINUTES I: 659 WEST SOUTH PARK AVENUE -Timothy Leiby This is an appeal of a requirement of the City's Building Code. Per Oshkosh Building Code Section 7- 33, persons may file an appeal to the Boazd of Zoning Appeals as provided in the City Zoning Ordinance, Section 30-6(B)(2)(a) if an equally good or better form of construction is proposed. All appeals shall be accompanied by supporting data. II: 2807 NEWPORT AVE. Scott& Anne Boyce, applicants and owners, requests a vaziance to allow construct a driveway with 32 feet of width at the front lot line, whereas; Section 30-36 (C)(5)(b) of the City of Oshkosh Zoning Ordinance requires that driveways leading to garages shall be no wider than 24 feet at the lot line III: 71 SENNHOLZ CT. Bruce Spaude, applicant and owner, requests a variance to allow a 10' by 12' or 120 square foot utility shed in the rear yard setback, whereas: Section 30-17 (B)(4)(e)(iii) of the City of Oshkosh Zoning Ordinance allows for utility sheds up to 100 square feet in size. IV: 1449 KNAPP STREET Valerie Zapolski, owner and Terry Laib, applicant, request a variance to construct a 24' x 48' detached garage in the rear yard area, which would make the garage 1152 square feet in size, whereas; Section 30-17 (B)(4)(b)(vi) of the City of Oshkosh Zoning Ordinance allows for an 800 square foot detached : garage. Board of Appeals Minutes -3- May 23, 2001 Boazd discussion followed with Mr. Schorse stating that Mr. Leiby has been there for 16 years with no problem. He further added that the snow would be a definite factor in impaired visibility if the steps were extended further out. Chairman Krueger stated his concern with the steps not having enough room to step to the side to allow the door to pass you. Mr. Husman said that the fact that there is an enclosed porch adds to the safety issue. Motion by Hentz for approval to allow the front steps without providing a minimum of a 3' wide by 3' deep landing between the entrance door and the stairs. Schorse seconded the motion. Motion carried 4-1. Nay: Krueger. Findings: Ms. Hentz stated that Mr. Leiby was basically replacing what was there for all those years and that the steps had been there for an additional two years with no problems. Mr. Husman stated that there was a concern with safety and visiblity was the factor. II. 2807 NEWPORT AVENUE Scott& Anne Boyce, applicants and owners, request a variance to allow construction of a driveway with 32 feet of width at the front lot line, whereas; Section 30-36 (C)(5)(b) of the City of Oshkosh Zoning Ordinance requires that driveways leading to garages shall be no wider than 24 feet at the lot line. Matt Tucker introduced the item with pictures. Anne Boyce stated that she would like to keep the current 32'opening at the right-of-way line for the driveway,which has a three car garage. She stated that she has 4 cars with one of the cars being parked outside of the garage. Mrs. Boyce said that if the variance is not granted, her vehicle will not fit in the driveway according to the way she has been told her driveway would have to be configured. She was informed that she would have to go up 5' and then taper over to make the driveway cut. She noted that she does not find where the code states this. She stated that the hardship is that her vehicle will not fit in the driveway and that street pazking is narrow and could be a safety issue with a school zone. She further noted that her house is 1 yeaz old and she was unaware of the code violation until this year. She said she investigated her options with the Engineering Department and was told that driveways could be up to 30' wide, whereas the zoning code allows for a maximum of 24'. The apron was poured to accommodate the wider driveway. She further stated that the Building Code Department said they must use the least restrictive code. She further stated that with the cuts recommended she would be gaining between 12-54 square feet of green space, which would amount to 2%-8%of storm water runoff, which she believes is a minimal reduction. Discussion followed as to the original building permit that was taken out for a 17' driveway. It was pointed out that by code the driveway could have been expanded up to 24' wide at the right-of-way line. Mrs. Boyce stated that she requested, in June of 2000,that her builder install the driveway to its present configuration, and at the time she was not awaze that the request was a violation of the Zoning code. Discussion followed stating that the street was installed in October of 2000 at which time the approach : was sized appropriately for a 32' wide driveway. Board of Appeals Minutes -4- May 23, 2001 Mr. Bluemke stated that in regard to the two ordinances that were mentioned by Mrs. Boyce, the zoning code applies to private property. He clarified that Public Works has authority over the portion of the apron between the sidewalk and the street. He also stated that the ordinances are in the process of being reviewed for consistency. He said that the intent of a maximum 24' opening is to avoid large concrete parking areas and the tapering is to allow flexibility in terms of the ordinances. Mr. Schorse raised the question as to who should be responsible for the driveway, since the builder was the installer of the driveway and the building permit was for a different size driveway than what was actually installed. Mr. Bluemke stated that ultimately the homeowner is responsible for what is done on their property. Mr. Husman inquired as to why the applicant was not cited until this spring. Mr. Tucker said that the violation came to the attention of inspectors as the result of a neighbor's complaint. Mrs. Boyce said 3 to 4 new houses have been constructed since the driveway was installed and the violation was not noted before this time. Mr. Schorse questioned why this would not be noted in the final inspection. Mr. Dannhoff responded that contractors do not contact the inspectors when driveways are completed. More discussion followed on the appearance of the large apron compared to the width of the driveway. Chairman Krueger commented that looks are not the issue. The question is whether there is a hardship. Mr. Bluemke explained the history of the ordinance, stating that it was amended in April of 1999 and modeled somewhat after neighboring cities. The intent of the new ordinance is to allow parking options, yet minimize potential negative impact on neighbors. Mr. Schorse stated that he did not believe the intent of the applicant is to park a lot of vehicles in the driveway and that is why the committee is here to make the adjustments as necessary. Mr. Bluemke stated that if you allow the full width of the driveway, parking of many types of vehicles could occur there. He also stated that the intent of the ordinance is to keep vehicles from impacting the neighborhood and to not allow for front yazds full of concrete. He added that it is possible to design a home in advance that would allow properties to meet the codes, and have the parking that they may want. Motion by Hentz to allow construction of a driveway with 32 feet of width at the front lot line. Motion seconded by Husman. Motion denied 3-2.Nays: Dahl and Krueger. III. 1449 KNAPP STREET Valerie Zapolski, owner and Terry Laib, applicant request a vaziance to construct a 24' x 48' detached garage in the rear yard area, which would make the garage 1152 square feet in size, whereas; Section 30- 17 (B)(4)(b)(vi) of the City of Oshkosh Zoning Ordinance allows for an 800 square foot detached garage. Matt Tucker introduced the item and presented pictures. Terry Laib presented pictures of a larger plan in scale showing the proposed garage. He said that the previous owner had the existing carriage house moved on to the property from another site. The general area is characterized by residential land uses, and the subject property is zoned R-1 Single Family Residence District. The subject properly is a single family home. ANALYSIS AND RECOMMENDATION In reviewing a variance request, the following questions should be addressed: Is there an unusual or unique characteristic about the subject property which creates a hardship? Is the hardship self-created? Is the variance being requested the least possible needed to remove any hardship? Will granting of the variance have a considerable adverse impact on the neighboring properties? The applicant is requesting a variance to allow a driveway with a 32' width at the lot line. The home and driveway were constructed in 2000. At the time of construction, a building permit was issued that depicted the driveway tapering to a width of 24 feet at the lot line. ' The intent of the 24' width restriction is to provide for additional green space between neighboring yards, as well as prevent the cluttering effect of having wide parking areas within the front yard of homes. In addition, narrowing the paved azea of the driveway reduces the amount of storm water runoff off of a property. The home has an attached three car gazage, which provides 3 code compliant parking spaces within the garage area. Since the property is not substandard in terms of width and depth, there does not appear to be anything that creates a hardship warranting the granting of this variance. EXPLAIN YOUR PROPOSED PLANS AND WHY YOU ARE REQUESTING A VARIANCE: We are requesting a variance to keep our driveway at its current width of 32 feet(SEE ENCLOSED PICTURES A-G). Construction on our house started October 1999. We moved in March 2000. During the building process we saw many houses with 3 car garages that had full driveways and liked the symmetrical look of this and requested ours to be put in this way. Driveway was installed June 2000 and we recently (April 2001) became aware that it was in violation of the city ordinance. 2. DESCRIBE HOW THE VARIANCE WOULD NOT HAVE AN ADVERSE EFFECT ON SURROUNDING PROPERTIES: If the variance is approved, our driveway could be kept at its cunent width of 32 feet. We have more than enough green space available. Currently there is an 8 foot green space from our driveway to side lot line and 18 feet 7 inches of green space (or soon to be green space when neighbors yard is put in) between our driveway and the neighbors' driveway (2801 Newport Avenue) (SEE ATTAC�IIvIENT 1). This area is large enough to hold the winter snow shoveled from the area. The driveway, as it cunently is has had no negative effect on the surrounding properties or caused any hardships to anyone or anything in the past year that it has been in. Many other driveways in the area(Fox Chase area behind us) are similar to ours in size and shape, are pleasant to look at and have caused no known problems to the area(SEE ATTACI�vvIENT 2). 3. DESCRIBE THE SPECIAL CONDTTIONS THAT APPLY TO YOUR LOT OR STRUCTURE THAT DO NOT APPLY TO SURROUNDING LOTS OR STRUCTURES: There are no special conditions that apply to our lot that do not apply to the surrounding lots except that we have a 3-car garage. Neighbors on both sides (2801 and 2815 Newport)have two car garages. Driveways in all three were poured to match the width of the garage. This makes the area consistent and pleasing to the eye when viewed from the street. 4. DESCRIBE THE HARDSHIP THAT WOULD RESULT IF YOUR VARIANCE WERE NOT GRANTED: If the variance were not granted to keep our driveway at its current width of 32 feet wide, we would be required to bring it into compliance with the code. The plans that were discussed include either cutting out a large section of one side (SEE ATTACHED OPTION 1) or cutting out two smaller sections from both sides (SEE ATTACHED OPTION 2). Either of these options would: a. create a problem parking our car (Intrepid) or our truck (Tahoe) or visiting vehicles appropriately in the driveway without blocking a stall. b. require parking a car on the street, which could create a hazard to the already narrow, well- - traveled road(school route to Traeger). _ ' c. possibly cause the cement in the driveway to prematurely crack and split throughout. This would decrease our property value and have an adverse effect on other properties in the . neighborhood. Upon speaking to Planning and showing them OPTIONS 1 and 2, I was told I could make it a curved cut to fit the car/truck in the spot (SEE OPTION 3) . However this is next to impossible unless I would cut out a large section of the concrete, refortn and repour a curved cut. I was informed that when cutting concrete a straight cut is all they can do, any curves must be reformed and repoured. 1 � ` i l �.
