COMMON COUNCZL OF THE CITY OF OSHKOSH Resolution No. RESOLUTION REGARDING WAIVER OF WISCONSIN STATUTES SECTION 66.521(11)(b)(1) REGARUING INDUSTRIAL DEVELOYMENT REVENUE BONDING ON IIEHALF OF CHAMCO, INC. WHEREAS, the Common Council of the City of Oshkosh, Winnebago County, Wisconsin at a lawful meeting held on the 21st day of July, 1983 adopted a resolutior� pursuant to Section 66.521 of the Wisconsin Statutes, authorizing the issuance of City of Oshkosh Industrial Revenue �onds ir� an amount not to exceed $375,000.00 on behalf of Chamco, Inc. Said bonds are for the purpose of constructing a building upon land in the City of Oshkosh for use as a facility in the City of Oshkosh Southwest Industrial Park (hereinafter the "Project"); and WHEREAS, Wisconsin Statutes Section 66.521(11)(b)(1) requires that proposals for contracts which exceed an estimated cost of $5,000.00 for the construction work connected with the Project be advert.ised in a class 2 notice in the official newspaper of the municipality, that said contracts be let to the lowest responsible bidder, and said contracts include a clause prohibitng discrimination in employment and subcontracting; and WHEREAS, Wisconsin Statutes Section 66.521(11)(b)(2) permits the governing body of a municipality to waive the requirements of Wisconsin Statutes Section 66.521(11)(b)(1) with respect to a particular project; NOW, THEREFORE, BE IT RESOLVED by the Cvmmon Council of the City of Oshkosh that the reqirements of Wisconsin Statutes Section 66.521(11)(b)(1) with respect to the Project and the issuance of the Industrial Revenue Bonds therefor are hereby waived because: 1. The City of Oshkosh will not control the costs or construction of the Project; 2. No public money will be expended for the Project and the City will have no beneficial ownership in the Project; 3. It will be more efficient and expedient for the accomplishment of the public purposes of the industrial revenue bond issue if Chamco, Inc. has complete control over the letting of the construction contracts for the Project. BE IT FURTHER RESOLVED that the anti-di.scrimination policy as expressed in Wisconsin Statutes Section 66.521(11)(b)(1) shall be effectuated by the inclusion of anti-discr.imination clauses satisfactory to the City in the revenue agreement to be entered into between Chamco, Inc. and the City.
