HomeMy WebLinkAbout32679 / 83-03�� First Reading December l, 1983 (CARRIED NIf7Y�7.Yii INITIATED BY LOST LAID OVER DUWE/VULCAN ANNEXATION DUWE PRECAST � �l 2 ORDINANCE WITHDRAWN ) PLAN COMMISSION RECOMMENDATION: Action planned on November 28, 1983 A GENERAL ORDINANCE OF THE CITY OF OSHKOSH ANNEXING CERTAIN TERRITORY TO THE CITY OF OSHKOSH AND SPECIFICALLY TO THE 13th WARD OF SAID CITY. WHEREAS, an annexation petition duly circulated has heretofore been signed by the owners of more than one-half of the real property in assessed value within such territory, and there being no electors residing in said territory, notice of intention to circulate an annexation petition for direct annexation having been duly published, and a copy of said notice with a scale map reasonably showing the boundaries of the area sought to be annexed and its relation to the municipalities involved, having been duly served upon the affected municipal and school district clerks and the Director of the Planning Function, Department of Resource Development, State of Wisconsin, within five (5) days of the date of publication of said notice, adoption of this ordinance shall constitute acceptance of the petition of annexation, and WHEREAS, more than twenty (20) days have lapsed since the publication of the notice of intention to circulate such annexation petition and not more than one hundred twenty (120) days have lapsed since the filing of the annex- ation petition, and WHEREAS, the Director of�the Planning Function of the Department of Resource Development of the State of Wisconsin has issued his opinion that the annexation is not contrary to the public interest, NOW, THEREFORE, the Common Council of the City of Oshkosh do ordain as follows: SECTION l. The following described territory, pursuant to a duly cir- culated and filed annexation petition for direct annexation is hereby annexed to and made part of the City of Oshkosh, a municipal corporation located in Winnebago County, more specifically to the 13th Ward of said City and is annexed for school purposes also and is hereby made a part of the City School District, and subject to all of the laws governing the same, all in accordance with Sec- tion 66.021 of ttte Wisconsin Statutes and the amendments thereto: - 3 - '• First Reading December l, 1983 ll 2 Cont'd. A parcel of land in the SW'4 and the NWZ of Section 27-18-16, Town of Algoma, Winnebago County, Wisconsin, described as follows: Commencing at the southwest corner of the NW� of the SW� of Section 27-18-16, thence north along the west line of said Section 27-18-16 to the west 1/4 corner of Section 27-18-16, thence east along the east and west 1/4 line of Section 27-18-16, to the northerly line of the former Chicago, Milwaukee, and St. Paul Railroad right-of- way, thence northeasterly along said right-of-way to the north and south l/4 line of Section 27, thence south along said 1/4 line to a point that is 126 feet, more or less, south of the north line of south 1/2 of SW� 1/4 of Section 27-18-16, thence west parallel to said north line of south 1/2 of SW 1/4 to a point that is located on a line, said line having a bearing of N. 18°37' W, and passing through a point that is on the north.line of the south 1/2 of SW 1/4 of Section 27-18-16, located 593 feet, more or less, east of the east right-of-way line of U.S. Hwy. 41, thence N. 18°37' W. 237 feet, more or less, thence northeasterly to a point on the southeasterly right-of-way line of the former Chicago, Milwaukee, and St. Paul Railroad that is 706 feet, more or less, northeasterly of the easterly right-of-way line of U.S. Hwy. 41, thence southwesterly along said railroad right-of-way line 706 feet to the east right-of-way line of U.S. Hwy. 41, thence south- westerly 93 feet, more or less, along said highway right-of-way to the north line of SW 1/4 of SW 1/4 of Section 27-18-16, thence west along said north line of SW 1/4 of SW 1/4 to the west line of Section 27 also being the point of beginning. Said parcel contains approximately 87.20 acres. SECTION 2. Section 1-28, 1-29, 10-1 and 10-3 of the Oshkosh Municipal Code pertaining to Boundaries, Wards, Polls, Benchmarks are hereby amended so as to reflect the provisions of this ordinance and the proper City officials are hereby authorized and directed to make such changes. SECTION 3. This ordinance shall be in full force and effect from and after its passage. section 4.
