PURPOSE: GRANT PRIVILEGE TO MAINTAIN FOOT BRIDGE
IN PUBLIC RIGHT OF WAY
INITIATED BY: PIONEER INN b MARINA
PLAN COMMISSION RECOMMENDATION: Action planned on December 12, 1983
WHEREAS, Pioneer Inn & Marina has requested the Council to grant them
the privilege of maintaining a foot bridge in the public right of way, and
WHEREAS, Section 66.045 of the Wisconsin Statutes provides for the
granting of a privilege in a right of way,
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are hereby authorized and directed
to grant Pioneer Inn � Marina, subject to the conditions contained in Sec-
tion 66.045i2) of the Wisconsin Statutes, the privilege of maintaining a
foot bridge in portions of public right of way described as follows:
All that portion of Pioneer Drive lying in Block 12, Original
3rd Ward, City of Oshkosh, part of Sec. 24, Town 18 North,
Range 16 East, City of Oshkosh, Winnebago County, Wisconsin,
more fully described as follows:
Commencing at the intersection of the E line of 5 Main St.
and the N. line of E. lOth Avenue; thence N 89� 12' 22" E,
along the N line of said E lOth Ave., 1051,35 ft. to a point
on the Ely iine of Pioneer Dr.; thence N 160 54' 00" E, along
the said Ely line of said Pioneer Dr., 150.00 ft. to the point
of beginning; thence continuing N 16° 54' 00" E, along the said
Ely line of Pioneer Dr. 40''; thence N 73° 06' 00" W. 30.00 ft;
thence 5 16° 54' 00" W. 40.00 ft.; thence 5. 73° 06' 00" E,
30.00 ft., to the point of beginning.

The Pioneer Inn and Marina, John Bergstrom, President, 1000 Pioneer
Drive, Oshkosh, WI 54903 completed filing an application with the
�epartment of Natural Resources for a permit under Section 31.23 ,
Wisconsin Statutes, to construct a pedestrian free span bridge over the
Pioaeer Inn Ca�al off the Fox River located in the NE} NW#, Section 25,
7ownship 18 North, Range 16 East, City of Oshkosh, Winnebago County, WI.
NOTICE IS HEREBY GIVEN as provided in Section 31.06, Wisconsin Statutes,
that unless written objection to such an application is filed with the
Oepartment of Natural Resources, Box 3600, Green Bay, WI 54303-1208,
within 30 days after publication, the Department of Natural Resources may
grant such application without hearing. A copy of said applicatian can be
obtained from or reviewed at the Lake Michigan District Headquarters.
Written objection or request for hearing shall contain a statement to the
effect that the petitioner or an authorized representative will appear at the
hearing.
The applicant proposes to construct a pedestrian free span foot bridge
over the Pioneer Inn Canal. Said bridge, 75 feet in length, 7 feet wide
with guard rails will span the 60 foot canal and be anchored to treated
piling abutments at each end. The bridge will have a 10# foot clearance
from low steel to normal water level.
NOTICE IS fURTHER GIUEPJ that if objection is filed, the Department of Natural
Resources will set the application for public hearing with notice of such
hearing given by publication and mailing as required by Statute.
