APPROVE EMERGENCY AMBULANCE SERVICE AGREEMENT
BETWEEN WINNEBAGO COUNTY AND THE CITY OF OSHKOSH
CITY ADMINISTRATION
BE IT RESOLVED by the Common Council of the City of Oshkosh
that the proper City officials are hereby authorized and directed
to enter into the attached Emergency Ambulance Service Agreement
between Winnebago County and the City of Oshkosh.
Motion made by Council Member Kutchera, seconded by Council
Member Mather, to amend the resolution as £ollows: delete
the parenthetical addition w;iich reads "Also Town of Black
Wolf and Town of Nekimi upon written request of the County."
CARRIED: Ayes (6) Mather, Propp, Teichmiller, Hulsebosch,
Kutchera, Pung; Excused (1) Chapin.

AGREEMENT BETFTEEN
WZNNEBAGO COUNTY ADiD THE CITY OF OSHKOSH
THIS AGREII`fENT is made and entered into this 22nd day of December,
7,gg3� by and between Winnebago County, a State of Wisconsin tiunicipal Corpora-
tion, by its County Executive and County Clerk, hereinafter called "COUN?Y",
� proper officers,
and T4iE GITY OF OSkIICOSH, a State of Wisconsin Municipal Corporation, by its/�
hereinafter called "PROVIDER".
WITNESSETH:.
For and in consideratiori of the mutual agreements herein contained
and other good and valuable consideration, the County and Provider do agree
as follows:
1. DESCRIPTTOV, TYPE tVVD ALAIVNER
OF SERVICE TO BE PERFOR�fED:
Provider agrees to provide energency ambulance service as herein-
after defined in that portion of Winnebago County, �discoasin, as
identified on Eh1-IIBIT "A" attached hereto and made a part hereof. The
area to be served by Provider may be amended by mutual agreement of the
parties. Provider agrees to give the County at least thirYy (30) days
advance written notice of a request for amendment of area to be served.
For purposes of this agreement, emergency ambulance service shall
be defined as that acibulance service which is necess�:ry to respand to a
condition that in the opinion of the person, his family or whoever calls
for and/or attends the person, requires immediate medical a[tention and
specifically escludes noa-emergency transfer calls.

The term of this agreement shall be from January 1,1984, through
December 31, 1984, unless terminated sooner pursuant to other provisions
of this agreement.
3. EQUIPMENT AND STAFFING OF AhIBULANCES:
Provider agrees to have available on a 24-hour basis at least
TWO ( 2:) fully equipped and staffed ambulance(s} for use in the area
to be served by Yrovider.
Provider further agrees that the provisions of sec. 146.SO, Stats.,
shall prevail insofar as equipping and staffing ambulances used by
Provider to satisfy the requirements of this agreement.
4. ZNSURANCE:
Provider agrees to carry not less than the follo�aing types and
amounts of insurance:
Comprehensive Vehicle
Liability Insurance ..............$250,000/$1,000,000
(bodily injury)
$ 50,000/$ 100,000
(property damage)
Uninsured Motorists ..............$ 15,000/$ 30,000
Workers' Compensation ............Statutory limits or
Self-Insured
Professional Liability ...........$250,000/$ 500,000
Provider further agrees to furnish a certificate of insurance in
force with a ten (10) day notice of cancellation to the Winnebago County
Insurance Administrator, c/o Cour[house, Oshkosh, Idiscor.sin, 54903.

5. HOLD HAR1�iLESS CLAUSE:
Provider Will indemnify and hold the County har¢less from all
liabilities, judgments, costs, damages and expenses which may accrue
against, be charged to, or recovered from the County by reason o� or
on account of damage to the property of, injury to, or death of any
person arising from Provider`s performance of its duties under this
agreement.
6. EXPENDABLE SUPPLIES:
Supplies for emergency use as hereinafter defined shall be furnished
by Provider as necessary. Provider may establish a reasonable charge to
the ambulance user for providing said e�cpendable supplies. Provider
agrees that any charge established hereunder shall be uniform throughout
the area s�rved by Provider pursuant to this agreement.
For purposes of this agreement, supplies for emergency use shall be
defined as those medical supplies which are essential for the personnel
who are staffing ambulances used by Provider to proviee adequate care
for the critically ill and injured at the emergency scene and during

transport to medical facilities, including, but not linited to the
fpllowing:
(a) Osygen
(b) Disposable blankets
(c) Universal dressings
(d) Sterile gauze pads
(e) Soft roller-type bandages
(f) Adhesive tape
(g) Splints
(h) Soards
In addition, Provider may charge the ambulance user an amount not
to exceed Thirty-f.ive and No/100 Dollars ($35.00) for each of the fo1lo�+inG

services if prescribed by a physician:
(a) Intravenous
(b) Drugs
(c) Heart monitoring
7. MILEAGE:
Resolution #4
Provider may establish a charge to the ambulance user to cover
mileage costs. Provider agrees that the nileage rate established for
emergency service rendered by Provider outside Provider's municipal
boundaries shall not exceed Three and No/100 Dollars ($3.00) per mile
for the distance from the emergency scene to the medical facility to
which the ambulance user is transported.
8. PAYMENT BY COUNTY
For the emergency ambulance services rer.dered by Provider hereunder,
the County-egrees to pay Provider the annual sum of Forty Thousand
Dollars ($40,000.00) per ambulance used to provide services hereunder,
but not to exceed Eighty Thousand Dollars ($50,000.00). Payments by
the County of its obligation hereunder shall be made in tcaelve (12)
monthly installments, each installment to be made not later than the
tenth (lOth) of the month follo�aing the nonth of service.
Provider agrees that the aforementioned payments by the County shall
be the only financial oblioation on the part of the County for any
emergency ambulance services, expendable supplies, mileage, equipment,
or any other costs incurred by Provider to provide the emer�ency ambulance
services covesed by this aoreement.

9. AhIBULANCE RATES, BILLINGS AND COLLECTIONS:
Provider agrees to establish the rate to be charged for emergency
ambulance service rendered pursuant to this agreement. Provider agrees
that the ambulance rate established for emergency ambulance service
rendered by Provider outside Provider's municipal boundaries shall not
exceed One Hundred Thirty and No/100 Dollars ($130.00) per call.
Provider agrees to do the billing and collections of all charges
made for emergency ambulance services rendered pursuant to this agree-
ment. Any such collections made by Provider shall be the sole property
of the Provider and the County agrees it will not make any claim
therefor.
10. TERPIINATION:
The County or Provider �ay terminate this agreement at any time
upon advance written notice of not less than six (6) months.
IT IS iNDERST00D by the County and the Provider that all agreements
and understandings have been embodied in this agreement and no chan�es shall
be made herein except in writing and duly signed by the County and the Provider.

granted by sec. 59.07(41) and sec. 66.30, Stats.
IN WIT\ESS GIHEREOF, the parties hereto have executed this agreement
on the date first above written.
