PURP05E: AGREEMENT WITH OSHKOSH FIRE DEPARTMENT CHIEF OFFICERS
INITIATED BY: PERSONNEL DEPARTMENT
BE IT RESOLVED by the Common Council of the City of Oshkosh
that the proper City officials are hereby authorized and directed
to enter into the attached agreement with the Oshkosh Fire Depart-
ment Chief Officers for the 1984 calendar year.

ARTICLE I
WORR WEER

Chief Officers are supervisory personnel and as such are charged vith the
responsibility of controlling and directing subordinate personnel in executing
their specified assignments.
Therefore, the duty week shall be determined by the Chief, based upon
department manpower requirements.
ARTICLE II
PAY POLICY
Chief Officers shall be compensated within the pay range as aet forth in
Schedule "A", attached hereto and made a part of this agreement.
ARTICLE III
COMMON MEALS
It being in the interest of the employer and employees to require coffion
aeals for the morale of the department and for the harmonious working rela—
tionship between firefighters, therefore, members shall contribute into a
co�on foed kitty.
ARTZCLE IV
HOSPITAL AND MIDICAL INSURANCE — LIFE INSURANCE
HOSPITAL AND MEDICAL INSIIRAt:CE
The employer shall provide health coverage equal to the level of benefits
available to the employees under the HMP type program in effect during 1982.
The full cost of this plan shall be paid for by the City.
LIFE INSIIRANCE
The employer shall pay one hundred per cent (IOOX) of the Chief Officer`s
State group life insurance policy.

AUTHORIZED ABSENCE
Vacation
Each employee with more than one (1) calendar year of continuous service,
shall be granted six work days of vacation leave. Each employee with more
than five (5) years of consecutive calendar service, shall be granted eight

work days of vacation leave. Each employee with more than eight (8) years of
consecutive calendar service, shall be granted ❑ine (9) work days of vacation
leave. . Each employee with more than fifteen (15) years of consecutive calendaz
service shall be granted eleven (11) work days of vacation. Each employee
with more than twenty (20) years of consecutive calendar service:shall be
granted thirteen (13) work days of vacation. Each employee vith less than a
full calendar year of aervice in the calendar year preceeding shall be granted
a vacation in the succeeding year on a prorated basis equal to the percentage
of the year worked as bears to the prescribed vacation period. Those employees
completing their fifth, eighth, fifteenth and twentieth years of service shall
earn their vacation for that year on a prorated basis. On separation, all
vacation shall be paid in proportion�to the time worked.
ARTICLE VI
SICIC LEAVE
All employees shall be entitled to sick leave credits on the following
basis:
All Chief Officers shall accumulate sick leave with pay at the rate of
one (1) working day for each month of service, an unlimited accumulation of
sick leave. A Chief Officer may use sick leave with pay for absence neces—
sitated by injury or illness, or exposure to contagious disease when confirmed
by a physician In order to qualify for sick leave payment, an employee must:
a. Report his absence to his Chief prior to the start of each work day.
b. Reep his Chief informed on the condition if the absence is more than
one working day.
c. Submit a doctor's certificate for such absence upon request of the
employer. The certificate must state the kind and nature of sick—
ness or injury and �ahether the employee has been incapacitated for
such period of absence.
d. Apply for such leave according to the procedure established by the
employer.
e. Record of sick leave will be maintained by the Personnel Office.
It is recognized that the serious injury or illness of the spouse or
child of the employee may adversely affect the ability of the employee to
perform his duties efficiently and may necessitate the use of sick leave.
However, no leave shall be granted under this subsection if the spouse of the
employee is employed
and continues to work during the absence of the employee. Any leave granted
for reasons listed in this subsection shall be subject to the general sick
leave provisions with approval of the Fire Chief.

Resolution #li
In addition to the employee's right to accumulate sick leave without
limitation, unused accumulated sick leave up to 100 days shall be paid at 357,
the employee's rate in effect at the time of separation, death or disability
for those employees who retire at normal retirement age or older. Maximum is
35 work days.
Section 2-138 (d) (4) of the Oshkosh Municipal Code provides as follows:
"IIpon written election by the emplayee filed with the Director of Admin-
istration, an employee injured while on duty and othervise covered under
the provisions of the Workmen's Compensation Act, may use accumulated
sick leave so as to draw as paid sick leave an amount which equals the
difference between regular salary and Workmen's Compensation weekly
benefits and such sick leave accumulations charged vith 1/3 of a day for
each such day; in the case of inembers of the police and fire departments
for the first year of injury. See Sections 2-162 and 2-163 of this
Code."
ARTICLE VII
EMERGENCY LEAVE
Each employee shall be allowed three (3) consecutive calendar days off
with pay in the event of the death of such employee's mother, father, son,
daughter, wife, father-in-law, mother-in-law, brother, sister, or step-child,
step-father, step-mother, grandchildren, grandparents or guardian. In the
event an employee is called off from duty because of the death of an above
relative, that duty day shall not be counted as part of the three (3) day
leave provision.
ARTICLE VIII
HOLIDAY LEAVE
All Chief Officers shall receive six (6) working days off duty with pay
in lieu of the following holidays: New Year's Day, Good Friday afternoon (1/2
day), Memorial Day, Independence Day, Labor Day, Thanksgiving Day, Christmas
Eve afternoon (1/2 day), Christmas Day, and two Floating Holidays which shall
be earned at the rate of 2/10 day for each month worked, but not to exceed two
days. These Chief Officers may, at their option, forfeit the time off and
receive six (6) days at the employees current rate. Employees selecting the
option payment must notify the department prior to September lst of the
current budget year for the following year.
ARTICLE IR
LEAVE OF ASSENCE WITHOIIT PAY
Requests for leave of absence without pay for justifiable reasons as
determir.ed by the employer will be granted for reasonable periods of time by

the employer except that no employee shall be granted a leave of absence in
order to seek other employment.
ARTICLE R
WAIVER OF RIGHTS
Neither party to this agreement by such act at the time hereof or sub—
sequent hereto agrees to and does waive any rights possessed by it or them
under state and federal laws, regulations or statutes. In the event any
clause or portion of this Agreement is in conflict with Statutes of the State
of Wisconsin governing municipalities or other Statutes, such clause or
portion of the Agreement shall be declared invalid and negotiations shall be
instituted to adjust the invalidated clause or portion thereof.
ARTICLE RI
PRESENT BINEFITS
The employer agrees to maintain in substantially the same manner such
present benefits not specifically referred to in this Agreement.
ARTICLE %II
TERMIP:ATION OF EMPLOYMENT
The employer shall pay a11 monies due employees upon the termination of
employment and shall furnish such employees with a statement of employment if
requested to do so by such employee.
ARTICLE RIII
PENSION
In addition to the Statutory requireaents, the employer sha11 pay to the
retirement fund up to 8% of the employees gross wages.
ARTICLE XIV
IINIFORM ALLOWANCE
The empioyer will provide a uniform allowance of Two Hundred and Twenty—
five Dollars ($225.00) per year to be paid in .7anuary of each year. In the
event an employee has worked less than twelve (12) months in the year preced—
ing, the amount shall be pro—rated.

DURATION

This Agreement shall become effective Pay Period 1, 1984 and shall zemain
in full force and effect until and including December 31, 1984 and shall be
automatically renewed from year to year unless negotiations are instituted by
September 1, 1984 and the firat day of September of any subsequent effective
year of this Agreement.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement on
