PHYSICALLY DISABLED PARKING ORDINANCE
CITY ADMINISTRATION
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH REPEALING AND RECREATING SECTIONS
27-38.3 and 27-38.4 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO PHYSICALLY
DISABLED PARKING.
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Section 27-38.3 of the Oshkosh Municipal Code pertaining
to parking for physically disabled persons is hereby repealed and re-created
to read as follows:
27-38.3 PARKING SPACES FOR VEHICLES DISPLAYING SPECIAL REGISTRATION
PLATES OR SPECIAL IDENTIFICATION CARDS
(1) In this section, "motor vehicle used by a physically disabled
person" means an automobile�or motor home displaying special registration
plates under s. 341.14(1),(la),(lm) or (lq) or a special identification card
issued under s. 343.51 or a motor vehicle registered in another jurisdiction
and displaying a registration plate, card or emblem issued by the other juris-
diction which designates the vehicle as a vehicle used by a physically disabled
person.
(2) The owner or lessee of any parking facility which offers parking
to the public shall reserve spaces for use by a motor vehicle used by a physi-
cally disabled person as follows:

At least one space for a facility offering 26 to 49 spaces.
At least 2% of all spaces for a facility offering 50 to
1,000 spaces.
3. At least one percent, in addition to that specified in subd. 2,
of each 1,000 spaces over the first 1,000 for a facility offering
more than 1,000 spaces.
Parking spaces reserved under this subsection shall be at least 12
feet wide.
(C) Parking spaces reserved under this subsection shall be located as
close as possible to an entrance which allows a physically disabled
person to enter and leave a parking facility without assistance.
Parking spaces reserved under this subsection in a parking ramp
shall be located as close as possible to the main entrance of the
parking ramp, to an adjacent public walk, or to an elevator which
allows a physically disabled person to enter and leave without
assistance.

(D) If the City or any other employer maintains a parking facility
restricted to use by employees, the employer shall, at the request
of a physically disabled employee, reserve a parking space for the
employee as provided by paragraphs (B) and (C) for use by a motor
vehicle used by a physically disabled person.
(3) The owner or lessee subject to the requirements of sub (2) shall post
official traffic signs indicating that the spaces are reserved.
(4) In addition to the requirements of sub(2) the owner or lessee of a
parking facility not open to the public and the owner or lessee of a parking faci-
lity which offers parking for 25 or fewer motor vehicles to the public may reserve
one or more spaces as provided under sub. (2)(B) and (C) for use by a motor vehicle
used by a physically disabled person. An owner or lessee reserving spaces under
this subsection shall post official traffic signs indicating that the spaces are
reserved.
(5) The official traffic sign shall include the international symbol for
barrier-free environments and a statement to inform the public that the parking
space is reserved for vehicles designated under sub. (2) or (4).
(6) (a) Any person violating the provisions of this section may be required
to forfeit not less than $50.00 nor more than $200.00.
(b) No forfeiture may be assessed under (a) if within 30 days after
the uniform traffic citation was issued the person provides proof that he or she
has complied with the provisions of Section 27-3�.3 for which the citation was
issued.
SECTION 2. That Section 27-38.4 of the Oshkosh Municipal Code pertaining to
parking prohibitions in spaces reserved for physically disabled persons is hereby
repealed and re-created to read as follows:
27-38.4 STOPPING, STANDING OR PARKING PROHIBITED IN PARKING SPACES
RESERVED FOR VEHICLES DISPLAYING SPECIAL REGISTRATION PLATES
OR SPECIAL IDENTIFICATION CARDS.
(1) Except for a motor vehicle used by a physically disabled person as
defined under Section 27-38.3, no person may park, stop or leave standing any
vehicle, whether attended or unattended and whether temporarily or otherwise,
upon any portion of a street, highway or parking facility reserved, by official
traffic signs, distinct markers or parking meters indicating the restriction,
for vehicles displaying special registration plates issued under s. 341.14(1),(la),
(lm) or (lq) or a special identification card issued under s. 343.51 or vehicles
registered in another jurisdiction and displaying a registration plate, card or
emblem issued by the other jurisdiction which designates the vehicle as a vehicle
used by a physically disabled person.
(2) Any person violating the provisions of this section may be required
to forfeit not less than $30.00 nor more than
