INITIAL RESOLUTION - 1984 PAVING PROGRAM -
PORTLAND CEMENT CONCRETE PAVING
DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED by the Common Council of the City of Oshkosh as follows:
L The Common Council hereby declares its intention to exercise its power
under Section 66.60 of the Wisconsin Statutes to levy special assessments upon
property within the following described areas for benefits conferred upon such
property by improving the following named streets, said public improvement to
include the following:
PORTLAND CEMENT CONCRETE PAVING
1. CUMBERLAND TRAIL - West 9th Avenue to Maricopa Drive
2. PORTER AVENUE - North Eagle Street to N. Sawyer Street
3. NEBRASKA STREET - West Sth Avenue to West 6th Avenue
4. SOUTHLAND AVENUE - North Sawyer Street to Sosslyn Street
5. WEST 14th AVENUE - South Main St. to Oregon St.
2. Said improvements shall consist of concr.ete paving as described above
and appurtenant work with concrete curb and gutter on both sides of the street
at a grade heretofore established by special ordinance of the City of Oshkosh.
3. Before such improvements are made, the Board of Public Works is directed
to cause water and sewer service pipes to be laid in said streets from the mains
to the curb line of each lot fronting on the said streets and to keep an accurate
account of the expense incurred in front of each lot and report the same to the
Comptroller who shall cause the amount charged to each lot to be entered on the
tax roll as a special tax against said road, provided, however, that the Board
of Public Works shall not cause such laterals to be so laid for any particular
lot, or parcel where, in the opinion of the Board of Public Works, it would be
impractical to do so.
4. The total amount assessed against such district shall not exceed the
total cost of the improvements and the amount assessed against any parcel shall
not be greater than the benefits accrued thereto from said improvements.
5. The assessments against any parcel may be paid according to the provisions
of Section 25-83 thru 25-89 of the Oshkosh Municipal Code.
6. The Board of Public Works is directed to prepare a report consisting of:
(a) Final plans and specifications for said improvements.
(b) An estimate of the entire cost of the improvements and laterals.

(c) An estimate as to each parcel of property within the assessment
district of:
(1) The assessment of benefits to be levied for each improvement.
(2) The damages to be awarded for property taken or damages by
each improvement.
(3) The net amount of benefits over damages or of damages over
benefits for each improvement.
Upon completion of such report, the Board of Public Works is directed to
file a copy thereof in the City Clerk's office for public inspection.
7. Upon receiving the report of the Board of Public Works, the City Clerk
is directed to give notice of a public hearing on such reports as specified in
Section 66.60(7) of the Wisconsin Statutes. The Hearing shall be held by the Board
of Public Works at the Council Chambers in the City Hall at a time set by the Clerk
in accordance with Section 66.60(7) of the Wisconsin Statutes.
8. The installation of said street improvements shall be accomplished
according to the provisions of Section 25-3 thru 25-11 of the Oshkosh Municipal
Code.
