SUBMITTED BY APPROYED — 1� — � . day of RESOLUION # 14 � AGRF,ED1ENT FIRl: STATION AtANPOl9ER SERVICES � WITTMAN }�IELD AIRPORT ti4INArERAGO COUNTY THIS AGRf7EniF:PdT, made and entered into this , 1984, by and between the CITY OF OSHKOSN, A State of Z,'isconsin P9unicipal Corporation, hereinafte7- called "City", and 1YINA'EBAGO COUNTY, a State of it'itconsin D4�znicinal Corneration, hereinaf±er ca�led "County" 1�`HF.RF.AS, ti+;isconsin Statutes, Section 66.30, authorizes municipalities to enter into government contracts to nrovide services authorized by Wisconsin Statutes, and l9FiERF,AS, it is mutually beneficial for the City and the County to enter into a fire services agreement for idittman F.ield Airport, and l�1ilERIiAS, the governing bodies of thc City and County have duly adopted resolutions authorizing the execution of this Agreement, NOIU, THERF,FOR�, BE IT R�SOL\/EU that the City and the County for and in consideration of the mutua2 covenants and ur_derY.akings herein contained do agree as follolas: SF:CTION I FIRE STATION The County will provide and maintain, and the City will man and operate, the fire station located on 11'ittman Field Airport, City of Oshkosh, 1Vinnebago County, FVisconsin. Except as hereinafter - 19a - RESOLUTION # 14 provided, the City shall not be liable for any portion of the cost of ec{uipping or operating said fire station except throuph� the annual County tax levy. SECTIOId II EQUIPDIENT The County will, at its own expense, provide and equip the fire station with whatever fire fighting and rescue equip- ment the County is required to have at iVittman Field to satisfy the requirements of Part 139, Title 14 of the Code of Federal Regulations. The City ivill, at its own exnense, provide and equip the fire station with �ahatever fire fighting and rescue equipment deemed necessary by the City. The County CFR vehicles may be used only in major off-airport emergencies requiring a foam agent when, in the judgement of the responsible City fire commander, such major emergency exceeded the Ci.ty's regular and on call equipment capabilities, and is subject to the following conditions: L Petrochemical type of fire requiring foam capacity above the capacity of the City Fire Department. call list. Only then will the County CPR vehicles be released for off airport use. 4, A iaritten report describing the emergency and all actions involving airport fire fighting resources shall be furn- ished within twenty-four (24) hours to the Airport hlanager by the City Fire Department. A like report will be furnished the F.a.A. Great Lakes Region, Airports Division, Certification Staf£, �.ithin forty-eight (48) hours. The City agrees to replace any County ol�ned extinguish- ina agent, fuel and the like expencled h}� City fror,i Cotznty olvned fire fighting and rescue equipment at or in response to a City fire call, and to do so at the earliest possible opportunity so as to insure that County owned fire fighting and rescue equipment ti�ill not be out of service at t}ie airport. County agrees to re- place any City owned extinguishing agent, fuel and the like ex- pended by the City in response to an airport fire call. SF,CTION III UTILI'PIES The County will pay for all utilities necessary to operate the said fire station to include heat, light, setaer and �aater and telephone charges. -3- - 19c - RESOLUTION # 14 SECTION IV INSUKANCE The County �aill provide firc insurance on the fire station and all County-owned equipment located therein. The County will provide public liability and other insurance necessary to protect the County's interests with regard to the said fire station The City agrees to provide workmen's compensation insurance co�rerage for City employses engaged in fire fighting activities on Wittman Field, SF,CTIOTI V TRAINING FACILITY The City may construct and operate a fire fighting training facility on 1Vittman Field at a site thereon �ahich is acceptable to the City and the County. The County �aill not be liable for any construction, operation or maintenance costs connected with said training facility unless the County specifi- cally agrees to be liable. The City will hold the County harmless from any and all liability tvhich may arise from the operation of said training facility. The City agrees to construct and operate the said training facility in accordance i1�ith city, county, state and {ederal rules and regul.ations. SECTION VI SNOIP REhi0V�1L The County agrees to remove the snoi; from all the roads on ll'ittman Field leading to and from the fire station. -4- - l9d - c � RESOLUTION # 14 a SFCTION VII DIANNING OF F.QUIPDIENT The City agrees to provide properly trained personnel at its own expense to effectively operate the County-oianed fire fighting and rescue equipment located in the fire station on tiVittman Field. Properly trained personnel is defined as one (1) fire fighting company consisting of nine (9) men. Any additional fire fighting personnel required by V7innebago County shall be at the expense of the County. SECTIO�,' VIII T E RAt The term of this Agreement shall be for an indefinite period from the date first above �aritten, excePt that either party may terminate this Agreement upon furnishing the other party written notice one year in advance. Said notice to be addressed to the Clerk of the respective party. The City agrees to remove it's personal property from the fire station and training facility forthtiaith on the effective date of termination. SECTIO\r IX FIRES ON 1NITTbiAN FII;LD The City will, at no cost to the Count��, respond to any type of a fire which may occur on l':ittman Field provided it re- ceives a proper re�uest to �o so. For purposes of this Agreement, a proper request ot the City for fire fighting service shall be one received in accordance iaith the Standard Opei-ating Procedures -S- - 19e - . RESOLUTION # 14 ,� for aircraft incidents and accidents contained in the ll'ittman Field Airport Ope4rations Manual and Emergency Ylan. A copy of this nlan is maintained by the City of Oshkosh Fire Department and updated as needed. Nothing herein shall limit the City's obligation to respond to all types of fires or other emergencies i+�hich may occur on Wittman Field, aeronautical or otherwise.
