SET WAGE RATE SCALE FOR PUBLIC WORKS PROJECTS FROM
JULY 1, 1984 TO JUNE 30, 1985
DEPARTMENT OF PUBLIC WORKS
WHEREAS, Section 66.293 of the Wisconsin Statutes provides that
it shall be the duty of every city which proposes the making of a
contract for any project of public works to determine the rate of
wage scale which shall be paid by the contractor to the employees
upon such project, and reference to such scale having to be pub-
lished in the notices issued-for the purposes of securing bids
for any projects;
NOW, THEF.EFORE, BE IT RESOLVED by the Common Council of the
City of Oshkosh that 'the attached schedule marked "Exhibit A" and
made a part hereof as though fully set out at length herein is
hereby determined to be the rate of wage scale for such public
works; and the City Clerk is directed to file same and to use
same in connection with and as directed by said statutes, same
being the rate of wage scale published by the Builder and
Construction Trades Council of Oshkosh and vicinity, and same shall
remain in full force and effect; and in the event that the present
contracts now under negotiations are adopted resultir.g in an
increase in the rate of wage scale over and above these established
in the schedule marked "Exhibit A", the same wage scale adopted
as the result of said negotiations shall automatically become
the rate of wage scale for the City of Oshkosh as required by
Section 66.293.

�� 7he "prevailing hours of labor" for all classes of laborers and mechanics are eight hour per day and forty
hours per calendar week. Al1 work perfornied in excess of these prevailing hours must be paid at a rate of at least
1-I/2 times the hourly basic rate of pay (plus fringe benefits if applicable).
?� A rate for learner, helper, preapprentice or trainee for this trade or occupation is available upon request.
If use of such rate is contemplated, request such rate rp ior to starting `+ork on the project.

Any contractor, subco�tractor or agent thereof, who fails to pay the prevailing rate of uages detertnined by the
department under this subsection or pays less than t-1/2 times the hourly basic rate of pay for hours worked on the
project in excess of the prevaiting hours determined under this subsection, shall be liable to the enployes
affected in the amount of their unpaid minimim wages or their unpaid overtime cmpensation and an additional amount
as liquidated dartages. Action to recover the liability may be maintained in any court of crnpetent jurisdiction by
any one or more employes for and in behalf of himself and other ertployes similarly situated. No employe shall be a
party plaintiff to any such action unless he gives his consent in Nriting to become such a party and the consent is
filed in the court in which the action is brought. The court shall, in addition to any judgnent awarded to the
plaintiff, allar a reasonable attorney's fee and costs to be paid by the defendant.
Each contractor, subcontractor or agent thereof participating in a project covered by this subsection shall keep
full and accurate records ctearly indicating the name and trade or occupation of every laborer, workman or mechanic
employed by him in connection aith the project and an accurate record of the nianber of hours rrorked by each ertploye
and actual Nages paid therefor.
