PURPOSE: GRANT PRIVILEGE IN STREET; ADJACENT TO 1221 KNAPP
STREET
INITIATED BY: WINNEBAGO COUNTY
PLAN COMMISSION RECOMMENDATION: Approved w/conditions
WHEREAS, Winnebago County requests the Common Council grant a privilege
in street to Multimedia Communications & Engineering, Inc and its contractors as may
be required to install a duct across Knapp Street right-of-way to house Winnebago
County Fiber Optic Cable; and
WHEREAS, Section 66.0425, Wis. Stats., provides for the granting of a privilege
in a right-of-way; and
WHEREAS, the Plan Commission has approved of this request with conditions.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are hereby authorized and directed to grant the
Winnebago County and its contractors, a privilege in street for installation of a Fiber
Optic Cable across Knapp, per the attached, with the following conditions:
1. Placement of the underground duct shall be coordinated with the Department of
Public Works to prevent conflicts with existing underground utilities.
2. The underground duct is installed in a manner that is approved by the
Department of Public Works with no modification or changes in construction
procedure without prior approval by the Department of Public Works.
3. If no longer needed, the underground duct be properly abandoned and removed
in accordance with City standards and under the direction of the Department of
Public Works.
4. Any problem that may arise as a result of placement of the underground duct be
the responsibility of the petitioner/owner to correct in coordination with the
Department of Public Works.
5. All appropriate permits be obtained prior to the start of placement of the
underground duct.
6. The underground duct shall be modified or removed immediately upon request of
the City.

7. The petitioner/owner secures and submits to the City Clerk a separate insurance
policy which names the City as an additional insured with a minimum coverage of
$200,000 per person and $500,000 in general aggregate.
8. It is the responsibility of the petitioner/owner to file in a timely manner a new
insurance certificate with the City Clerk upon expiration of an existing certificate.
Failure to do so will result in the revocation of the privilege in the right-of-way
permit within ten (10) days of notice.
9. The petitioner/owner execute a hold harmless agreement with the City.
10. The facility be part of and documented with Digger’s Hotline system.

BACKGROUND
The subject site is located at the 1200 block of Knapp Street. The area has predominantly
single family land uses along the east side of Knapp Street as well as the west side, north of
the subject location. To the west is the Winnebago County's Maintenance Facility and
Vulcan Quarry is located to the southwest.
ANALYSIS
The petitioner is requesting a privilege in the street permit to install 2' underground duct
across Knapp Street to house fiber optic cable to be connected to Winnebago County's data
network. The cable will then be connected to existing utility poles and will continue on
aerially. The duct will be installed via direction bore to minimize restoration work and is
scheduled to begin in August of 2015. The petitioner has been coordinating with the
Department of Public Works to ensure the proposed duct will not interfere with existing City
facilities. The Department of Public Works has reviewed the request and recommends
approval with the final design to be approved by their department.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of the request at its July 7, 2015 meeting.

GENERAL INFORMATION
Petitioner: Multimedia Communications & Engineering, Inc./Winnebago County

Action Requested:
Multimedia Communications & Engineering, Inc. on behalf of the Winnebago County Information
Systems Department requests a privilege in the street permit to install 2" underground duct across
Knapp Street east of Winnebago County's Maintenance Facility, 1221 Knapp Street. The conduit
will house fiber optic cable to be connected to Winnebago County's data network.

Property Location and Type:
The subject site is located at the 1200 Block of Knapp Street The area has predominantly single
family land uses along the east side of Knapp Street as well as the west side, north of the subject
location. To the west is the Winnebago County's Maintenance Facility and Vulcan Quarry is
located to the southwest.
ANALYSIS
The petitioner is proposing to install a 2" HDPE duct across the Knapp Street right-of way to
house Winnebago County Fiber Optic Cable. The cable will then be connected to existing
Wisconsin Public Service poles and continue on aerially.
The duct will be installed via direction bore which will minimize restoration work. The petitioner
states that work will be done between the hours of 7:00 AM and 5:00 PM, not to conflict with the
City's noise ordinance. Once the privilege in the street permit is approved, work is planned to
begin in August of 2015.
The petitioner has been coordinating with the Department of Public Works to ensure the proposed
duct will not interfere with existing City facilities. The Department of Public Works has reviewed
and recommends approval of the privilege request, however, they are requesting the final design be
coordinated and approved by the Public Works office.
RE COMMENDATION/CONDITIONS
Staff recommends approval of the privilege in street request for underground duct east of 1221
Knapp Street subject to the following conditions:
1. Placement of the underground duct shall be coordinated with the Department of Public Works

The Plan Commission approved of the privilege in street as requested with conditions noted. The
following is the Plan Commission's discussion on this item.
Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use and
zoning classifications in this area. He explained the reason for the request and stated that if the
privilege in the street is granted, the work was scheduled to begin in August of 2015 and the final
design would require approval by the Department of Public Works. He reviewed the site plan and
conditions recommended for this request.
There was no discussion on this item.

RE: Privilege in the Right of Way Narrative —County Owned Knapp Street Facility Connection
Winnebago County In#ormation Systems Department (County) is planning a fiber optic connection into
their Maintenance facility at 1221 Knapp Street via a fiber optic cable inside a 2" HDPE duct placed across
the City of Oshkosh Right of Way as well as on WPS owned poles (cable only). Please see the attached
map for route details.
All planned routes have been shared with the City's Engineering Department. As always the final route
takes into consideration any input from the Department regarding existing utilities, planned activities in
the area, and future adjustments to streets, sidewalks, and other City Owned utilities.
The construction method used to place the underground duct and fiber optic cable within the City's Right
of Way will be Directional Bore. This method creates minimal noise and vibretion levels that do not exceed
the limits established in the municipal code. The benefit to the Directional Bore method is that it
minimizes the amoun# of surface excavation necessary for installation. Operation of this equipment
would be limited to normal working hours of 7:00 AM to S:OOPM and will take into consideration any
hours of work restrictions placed by the City. At no time would the construdion activities extend outside
the boundaries of the City ROW or County-owned properties.
Once approved, this connection will likely be installed in August of 2015. Once construction is completed
and restoration has finished there will be no evidence of the work havingtaken place.
