NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the Common Council determines that it is necessary and a public purpose for the City to acquire properties described in the attached for reconstruction of North Main Street, from New York Avenue to Murdock Avenue BE IT FURTHER RESOLVED by the Common Council that this resolution constitutes a Relocation Order for acquisition of property described in the attached in accordance with the title acquisition procedure set forth in Wisconsin Statutes, Section 32.05, said properties being located in the City of Oshkosh on North Main Street, and adjacent side streets as noted in the attached “Exhibit A”. BE IT FURTHER RESOLVED that the proper City officials are hereby authorized and directed to execute any and all documents necessary for implementation of this order and that a certified copy of this Resolution shall be filed with the Winnebago County Clerk within twenty (20) days of its adoption. Main Street Reconstruction project. Per the City's agreement with the DOT, the City is responsible for land acquisitions and acceptance of temporary limited easements as part of the relocation order which will go before the Common Council for approval. The affected area involves N. Main Street from New York Avenue to Murdock Avenue. The project involves 88 properties consisting mostly of low density residential uses. The land acquisition involves a single property located at 1155 N. Main Street which is used as a commercial business. ANALYSIS The Common Co�ncil previously approved an agreement with the DOT for the road reconstruction project which is not designed to increase capacity, only to replace aging infrastructure. As designated by the DOT, the proposed reconstructed street would be 40-foot wide including two 11-foot drive lanes, five-foot bike lanes in both directions, an 8-foot parking lane on the west side, 5-foot sidewalks and 7.5-foot terraces and will allow the City to upgrade water main, sanitary sewer and storm sewer facilities. The subject area to be acquired is a 260 square foot triangle-shaped area located at the southwest corner of New York Avenue and N. Main Street which will be dedicated as public right-of- way for the installation of an accessible handicap ramp at that corner. The road reconstruction is scheduled for late 2016 and will be included in the 2016 Capital Improvements Program. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of the request at its July 7, 2015 meeting. As designated by the DOT, the proposed reconstructed 40-foot wide street will include two I 1-foot drive lanes, five-foot bike lanes in both directions, an eight-foot parking lane on the west side, five-foot sidewalks and 7.5 foot terraces. The proposed project will also allow the City to upgrade aging facilities (water main, sanitary sewer and storm sewer). One small land acquisition is required for this project. RECOMMENDATION/CONDITIONS Staff recommends approval of the property acquisition, and right-of-way dedication for reconstruction of N. Main Street from New York Avenue to Murdock Avenue as requested. The Plan Commission approved of the land acquisition and right-of-way dedication as requested. The following is the Plan Commission's discussion on this item. Mr. Nau presented the item and reviewed the site and surrounding area and discussed the City's agreement with the DOT for the reconstruction of this area. He described the project in further detail which would include upgrading the aging infrastructure under this street and the necessity to acquire a triangular shaped portion of property for the installation of a handicapped ramp at this corner. He further explained that the work was scheduled for completion in 2016 and reviewed a site plan depicting the area to be acquired. Mr. Gray questioned if the city has discussed this acquisition with the property owner. Mr. Rabe responded that the city contracts services for land acquisition negotiations and he was not sure if the contractor had yet made contact with the property owner at this time.
