A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 30-68
OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO THE OFFICIAL MAP.
WHEREAS, a public hearing, after due and proper notice, was duly held before
the Common Council of the City of Oshkosh concerning the adoption of this amendment
to the Official Map of the City of Oshkosh, and the Plan Commission having duly
recommended the adoption of this Ordinance.
NOW, THEREFORE, the Common Council of the City of Oshkosh do ordain as
follows:
SECTION 1. That Section 30-68 of the Oshkosh Municipal Code pertaining to
the Official Map of the City of Oshkosh and its extraterritorial jurisdiction shown, is
hereby amended by deleting therefrom the present map sheet, and the substituting
therefore an amended map sheet, thereby making revisions to the official map as
described in the attached.
SECTION 2. Immediately upon these amendments to the Official Map becoming
effective, the City Clerk shall file a certificate with the Register of Deeds for Winnebago
County showing that the City has amended its official map; and shall remove from the
Official Map the obsolete map sheet and shall replace it with a copy of the map sheet
attached hereto; the obsolete map sheet shall be retained by the City Clerk in a hard-
bound folder and each sheet thereof marked to the effect that it was rescinded by action
of the Common Council this date; the new sheet added to the Official Map shall be
marked to the effect that the amended sheet was adopted by action of the Common
Council of this date.

SECTION 4. Publication Notice. Please take notice that the City of Oshkosh
enacted Ordinance #15-XXX APPROVE OFFICIAL MAPPING OF SAWYER CREEK
WATERSHED; 2700 BLOCK CLAIRVILLE ROAD TOWN OF ALGOMA on July 28,
2015. The Ordinance reserves an area in the Town of Algoma for a future City storm
drainage detention area. The full text of the Ordinance may be obtained at the Office of
the City Clerk, 215 Church Ave. and on the City's website at www.ci.oshkosh.wi.us.

RE: Approve Official Mapping of Sawyer Creek Watershed; Western 2700 Block of
Clairville Road Town of Algoma (Plan Commission Recommends Approval)
BACKGROUND
The subject site is a 59.13 acre area of undeveloped land partially adjacent to the city limits
to the south and is currently used agriculturally on the western 2/3 of the site with a grove of
young evergreen trees on the eastern 1/3 of the site. The surrounding area consists of
mostly agricultural uses with sporadic single family dwellings along Clairville Road. The Pian
Commission recently approved a 3-lot certified survey map and recommended approval to
the Common Council for a zone change from A-1 ETZ to R-1 ETZ and A-2ETZ affecting the
eastern 1/3 of the subject site. Official mapping is the process by which a municipality can
designate or reserve areas for specific public uses for future acquisition and development.
Once mapped, those areas are treated as right-of-way from a setback perspective and
building permits cannot be issued for new construction or expansion that does not conform to
the location of the official map unless authorized by the local legislative body.
ANALYSIS
The Department of Public Works requests approval to officially map a storm drainage
detention area within the Sawyer Creek Watershed for future storm water improvements.
The official mapping affects two parcels currently located in the Town of Algoma, Zone D-City
Expansion Area located west of Clairville Road '/z mile north of W. Waukau Avenue. 37.24
acres of the proposed mapping request is located on a single parcel on the western portion of
the site with the remaining 21.89 acres located on the eastern portion which was recently
divided and being considered for a zone change but the property owner's immediate plans
will not be affected by this mapping action. Since 2007, the Department of Public Works has
been working with a consultant on implementing recommendations of the Sawyer Creek
Storm Water Management Plan which originally recommended acquisition of the Westhaven
Golf Course which was removed from consideration requiring alternative sites to be
researched. Numerous criteria were used to determine adequate sites and the proposed site
best meets the criteria considered. The Sawyer Creek Storm Water Management Plan is
currently being updated and should be completed by the end of 2015 which will determine if
this subject site will serve the purpose or if an amendment to this mapping action is
necessary. The proposed mapping action and eventual construction of the storm water
detention basin is consistent with the Comprehensive Plan as this area is recommended for
residentiai development of which storm water management is a necessary component.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of the request at its June 16, 2015 meeting.

Applicable Ordinance Provisions:
Section 2-52 of the Municipal Code and Section 30-8 of the Zoning Code designate a function and
duty of the Plan Commission to make recommendation on the establishment and amendment to the
City's Official Map.
Property Location and Background Information:
The subject site is an approximately 59.13 acre azea of undeveloped land partially adjacent to the
Oshkosh city limits to the south. The property is currently used agriculturally on the westem 2/3
of the site and a grove of young evergreen trees on the eastern 1/3. The surrounding azea consists
of mostly agricultural uses with sporadic single family dwellings spread out along Clairville Road.
On June 2, 2015, the City of Oshkosh Plan Commission approved a 3-lot certified survey map and
recommended approval to the Common Council for a zone change from A-lETZ to R-lETZ and
A-2ETZ affecting the eastern 1/3 of the subject site owned by Kay Spanbauer.
Official mapping is the process by which a municipality can designate or reserve azeas for specific
public uses for future acquisition and development. Once officially mapped, those azeas aze
essentially treated as right-of-way from a setback perspective and no building permit may be
issued for new construction or expansion that does not conform to the location of the official map
unless otherwise authorized by the local legislative body. In Wisconsin, municipalities may use
official mapping to establish an official street network and future streets, historic districts, parks
and playgrounds, railroad right-of-way, public transit facilities, and waterways.

The Department of Public Works requests approval to officially map a storm drainage detention
area within the Sawyer Creek Watershed for future stormwater improvements. The Sawyer Creek
basin begins southerly at Fisk Avenue and westerly at County Road FF and runs northeasterly
towards the Fox River.
The official mapping affects two pazcels currently located in the Town of Algoma, Zone D- City
Expansion Area. The site is located just west of Clairville Road, approximately YZ mile north of
W. Waukau Avenue. 37.24 acres of the proposed 59.13 mapping request is located on a single
parcel owned by Carol A. Neubauer. This azea is located on the westem 2/3 of the mapping
request and is used exclusively for agriculture. Sawyer Creek runs through Ms. Neubauer's
property neaz the northwest corner with its centerline matching the boundary of the proposed
official map area. The remaining eastem 21.89 acres owned by Kay Spanbauer is also an
undeveloped single pazcel with a grove of evergreen trees. Recently, Ms. Spanbauer's land was
approved for a 3-lot land division and zone change to allow for one single family development
along Clairville Road. Based on the limits of the proposed official mapping, her immediate plans
for the one single-family development will not be affected by this mapping action.
Since 2007, The Department of Public Works, together with their engineering consultant Sh�and
Associates has been working on implementing recommendations of the Sawyer Creek Storm
Water Management Plan. The original plan recommended for acquisition of the VJesthaven Golf
Course which would have provided for a significant amount of storm water storage. However, the
golf course was removed from consideration requiring the Depar[ment of Public Works to seek
altemative sites suitable for large-scale detention.
Significant progress has been made to address storm water mitigation within this watershed, but
there is still need for additional storage due to the loss of the golf course site. Several criteria were
used to determine adequate sites for the proposed detention basin including:
• Preservation of developable land along existing roadways
• Potential storage volume

• Proximity to available fill/disposal sites
• Conflict with electrical transmission lines
• Conflict with Westside Arterial comdor

Based on initial analysis, the subject site best meets the aforementioned criteria. The official
mapping will preserve and protect this land for development of the detention basin as there are
very few large tracts of land remaining suitable to meet the recommendations of the study.
Work is underway by the Department of Public Works and Strand Associates to update the Sawyer
Creek Storm Water Management Plan which will incorporate projects implemented since 2007.
Once the update is completed by the end of 2015, new information will be available to determine if
this subject site will serve the purpose the preliminary reviews have shown it could accommodate.
Findings from the plan may necessitate an amendment to this mapping action afrer review and
recommendations by the Departrnent of Public Works.
The Comprehensive Plan recommends the subject site suitable for residential development. Staff
is in the opinion that the proposed mapping action and eventual construction of the storm water
detention basin is consistent with the Plan's recommendation. Storm water management is a
necessary part of residential development and provides flooding relief and will lessen potential
residential flooding damage downstream from the proposed basin.
Construction of the basin has not been scheduled. It is anticipated that the project will be included
in the Capital Improvements Program within the next few years for land acquisition, engineering
and construction.
Planning staff recommends approval of the official map action as requested.
The Plan Commission approved of the official mapping as requested. The following is the Plan
Commission's discussion on this item.
Mr. Nau presented the item and reviewed the site and sunounding area as well as the land use and
zoning classifications in this area. He explained the official mapping process and how it affects
the property which is essentially treated as right-of-way from a setback perspective once mapped.
He reviewed the 20-year Comprehensive Plan map which recommends this area for residential
development and reviewed the parcels to be affected by this action and the boundazies of the
official mapping area. He also discussed the certified survey map and zone change that was
recommended for approval at the last meeting and stated that the official mapping action would
not affect the property owner's plans for the site. He discussed the storm water management plans
and reviewed a map of the Sawyer Creek Watershed and displayed on the map the location of the
James Road detention basin and the proposed detention basin location involved with this official
mapping request. He discussed the criteria considered in this process to select an appropriate
location for the basin as well as the update to the Sawyer Creek Storm Water Management Plan
which will be completed by the end of 2015. Findings from this plan may necessitate an

amendment to this mapping action and construction of the detention basin is not scheduled at this
time.
Mr. Thoms questioned what the urgency was to take action now on this official mapping if the
Department of Public Warks and the consultant were still in process of evaluating the storm water
management plan. He felt it would be more appropriate to take action after the study was
complete.
Mr. Rabe responded that they have continued to update the analysis on the Sawyer Creek
Watershed study and have been researching alternate sites for the detention basin since the
Westhaven Golf Course property was removed from consideration for this purpose. Based on the
analysis and updates to the study was what initiated taking action on the official mapping at this
time. He further explained plans to refine the scale of the detention basin and how analysis of the
results concluded with potentially choosing this location however they will still need to analyze if
this azea will meet the goals of the watershed or if fiirther work needed to be done.
Mr. Thoms then questioned if this property is an integral part of the Sawyer Creek Watershed
plans.
Mr. Rabe responded affirmatively.
Mr. Thoms stated that the City's Comprehensive Plan recommends this area as suitable for
residential development and questioned how a detention basin was consistent with this
recommended use.
Mr. Nau indicated that storm water management and related infrastructure is part of the
development process as any residential development in this azea would require related storm water
detention plans to serve the azea.
Mr. Thoms questioned if this was still consistent with the Comprehensive Plan as storm water
detention was to serve properties downstream of this site and not this site in particulaz.
Mr. Nau responded that it is part of the necessary infrastructure and another segment of public
infrastructure and the efforts to alleviate flooding issues and it would provide flooding relief to
properties downstream of the proposed detention basin.
Mr. Thoms again questioned if this use was consistent with the Comprehensive Plan.
Mr. Burich explained that the zoning code permitted these types of community facility uses in
residential districts so it is consistent with the Comprehensive Plan. He further discussed how the
zoning code implements the criteria that are contained in the Comprehensive Plan and a detention
basin was a public institutional use and a community need to alleviate flooding issues.
Mr. Nau added that this proposed detention basin azea follows the same model as the James Road
detention basin.

Mary Klemz, 4676 County Road E, stated that she was one of the property owners of the land
being considered for this potential detention basin and questioned when the land would be
acquired.
Mr. Rabe responded that a time line had not yet been determined.
Ms. Klemz stated that she was not sure what the term watershed meant and questioned how it
affects the surrounding property as another one of the owner's homes is adjacent to this site and
she had concerns with what impact it would have on her residence.
Mr. Rabe explained the process of the completion of the update to the storm water management
plan which would take 9 to 12 months and that further action would start proceeding at that time of
implementing the project. He further explained that the acquisition process would begin once a
determination was made regazding the site's effectiveness according to the results of the updated
plan. He also described how the detention basin would function as when the creek rises, water
would spill into the detention basin which would result in the water elevation in the area being
lowered rather than continue to rise. This would reduce any negative impacts on the property
owner's adjacent residence.
Ms. Propp inquired if it would be a wet or dry detention basin.
Mr. Rabe responded that it would be primarily a dry basin similar to the one constructed on James
Road.
Mr. Thoms stated that once the city and their consultants determine if this azea would work for the
proposed detention basin, what the timeline would be for the project.
Mr. Rabe explained that at this time next yeaz they should know when the land acquisition will
occar and discussed how the land acquisition, design of the basin and necessary permitting all take
time and if the process begins in 2017 the construction would begin possibly in 2020.
Ms. Propp questioned at what time it would be appropriate for the property owners to come in and
discuss the process with the Department of Public Works and the legal process that takes place.
Mr. Rabe indicated that Steve Gohde, Interim Director of Public VJorks, has attempted to contact
the owners regazding this matter and explained the process of land acquisition which would begin
once the area has been identified and that a consultant will handle the negotiations for the
acquisition with the property owner.
Ms. Propp commented that the Department of Public Works should contact the property owners by
tomorrow or the near futwe to discuss this process so they are informed on how it would proceed.
Mr. Rabe stated that the Department of Public Works reaches out to the affected property owners
and discussed the document that regulates the process of land acquisition by a municipality and
describes the rights of the property owner. He further stated that the State Statutes protect the
property owners and they have specific steps to be taken by the municipality and that they can
contact the Public VJorks office for updates on the project.

meeting to divide and rezone the property but she understood the need to do the official mapping
at this time.

What is it?
State statutes permit cities, villages and towns to prepare official mapping. T1us mapping is
intended to serve as a formal public record to indicate where the government unit is likely to
requue right-of-way, easements, or land for future roads, drainageways, utilities, recreation
facilities, etc. This enables landowners to plan future construction to avoid costly removal of
sh-uctures later when a public facility identified on the official map is built tF�rough or neaz theu
properties.
Official mapping is also an excellent way to unplement recommendations made in a land use
or comprehensive plan. Further, it ensures new developments will be linked to existing and
future street eactensions and connections in a planned manner. Finally, when paired with careful
building code administraUon, it reduces land acquisition costs to govemment units by virtually
ensuring that criticalland segments will remain unnnproved by private landowners.
What is the broad administrative process to initiate official mapninQ?
The local govemment unit may by ordinance or resolution establish an official map of its
territory or any part thereof showing with survey accuracy the streets, highways, utility corridors,
drainageways, historic districts, parks and playgrounds laid out, adopted and established by law.
The location of railroad rights-of-way, waterways,, airports, and public transit facilities may also
be shown on the map. The inifial adoption typically maps existing features and may be done
without a public hearing. Subsequently amended maps show proposed features and require plan
commission review and a public hearing prior to adoption. (Changes or additions made by an
approved subdivision plat do not require the public hearing if the changes or additions do not
affect any land outside tbe platted azea.)
The ordinance or resolution shall require the city/village/town clerk at once to record with
the County Register of Deeds a certificate showing that the city/village/town has established an
official map.
How '�ripid" is a eovernment unit's offcial manpinp?
The map must be conclusive in regazd to the location, width, and extent of anticipated
facilities. However, there is no requirement to establish a timeline for construction nor is there
any guazantee required that the facility will actually be built. Further, the statute does provide an
amendment procedwe for changing the location, width, or ea-tent of a mapped facility.
Can streets and utilities be constructed that are not on an adovted offcial man?
In any city/village/town that has established an official map, no public sewer or othet
municipal street utility or unprovement shall be constnxcted in any street until such street is duly
placed on the official map. Further, no permit for the erection of any building shall be issued
unless a street giving access to such proposed shucture has been duly placed on the official map.
These provisions are helpful in controlling "sprawl" in the oudying rural-urban fringe areas.
Once an official map is in place, a community puts itself under a constraint. Only
unprovement projects already on the map_can move forward. Therefore, most communities will

want to make sure their map is as complete as possible. It is permissible for a community to
create an official map that covers only certain improvements or is limited to a certain part of the
community, but any unmapped improvements cannot move forwazd without first being put on
the map, which requues a map amendment process. Being constrained in this way by an official

If landowners build improvements in the right-of-way of a facility already identified on the
official map, they may have to remove the unprovement.at their own expense if the public
facility is eventually built.
However, if a private improvement already e�sts on private property and an official map is
subsequently created or amended to propose a public facility on said private property that would
require the removal (condemnation) of the private improvement, the local government unit must
compensate the affected property owner at market value.
Courts have also overturned official mapping that resulted in a landowner losing all use of a
single parcel located entirely within an officially mapped street right-of-way.
Whose offzcial mappinp nrevails when there is a conflict?
Cooperation between government units is essential, since Wisconsin law allows
cities/villages to extend their official mapping into their ea�traterritorial jurisdiction, which
mcludes lands under town control that may also be included in a town's official mapping. (To
fiu�ther complicate the issue, counties and the Wisconsin Deparhnent of Transportation can also
adopt modified official maps that pertain to transportation facilities: Ch. 80.64; 84.295(10).)
Neither state statute nor case law indicates whether the city/village or town's official
mapping would take precedence in the event of a dispute. In order to avoid the uncertainty and
cost of a judicial decision in such a case, government units would need to cooperate closely.
What are some wavs eovernment units can work to2ether?
1. Examine public facility needs jointly.
2. Provide notice to adjacent municipalities, the county, the RPC, the MPO, and the state, if
necessary, regazding the creation of, or amendment to, your official map.
3. Be awaze of the eacistence of official maps in your area and exchange copies with
neighbors.
4. Develop your official map concurrenfly with neighboring municipalities, if possible, to
promote consistency and a"region-wide" perspective.

Sawyer Creek Watershed
Official Mapping
Project Narrative
The Department of Public Works along with their engineering consultant, Strand Associates,
Inc., has been working on implementing recommendations of the Sawyec Creek Storm Water
Management Plan since approximately 2007. Several recommendations from the Storm Water
Management Plan have been constructed. The constructed projects include the dredging of
Sawyer Creek east of USH 41, the James Road Area Detention Basin and the Oakwood road
Detention Basin. The plan also recommended the acquisition of the Westhaven Golf Course to
provide approximately 200 acre-feet of storm water storage within the Sawyer Creek
Watershed. Ultimately, the Westhaven Golf Course option was removed from consideration,
removing a significant amount of flood storage from the plari.
While significant progress has been made, there is still a need for large-scale detention in the
Sawyer Creek watershed to replace the am
Westhaven Golf Cou�se option. Potential areas
reviewed for the following criteria:

Initial reviews indicate the location that best satisfies the criteria above is the one identified for
official mapping. We request this area be offcially mapped for future storm water management
to preserve potentially the last remaining large open parcel of land most conducive to storm
water management before Sawyer Creek enters the urbanized area of the city.
We are currently working with Strand Associates, inc. to update the Sawyer Creek Storm Water
Management Plan. The update will document what has been accomplished since 2007 and
identify what is still needed to achieve the goals previously established for the watershed. We
anticipate the update to be completed by the end of 2015. The completion of the update to the
Storm Water Management Plan will provide the necessary information to determine if this
location will serve the purpose the preliminary reviews have shown it could.
