HomeMy WebLinkAbout33032 / 84-02Augus� 16,1984 First Reading #9 ORDINANCE (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: HICRORY LANE ANNEXATION INITIATED BY: Shirley Doemel PLAN COMMISSION RECOMMENDATION: (Pending on 8/13/84 meeting) A GENERAL ORDINANCE OF THE CITY OF OSHKOSH ANNEXING CERTAIN TERRITORY IN THE CITY OF OSHKOSH AND SPECIFICALLY TO THE 15th WARD OF SAID CITY. The Common Council of the City of Oshkosh do ordain as follows: WHEREAS, an annexation petition duly circulated has heretofore been signed by the owners of all of the real property within such territory and all of the electors residing in said territory; and WHEREAS, Section 66.021(12) of the Wisconsin Statutes allows for petition to be filed without a notice of intention to circulate in an annexation by unanimous approval; and WHEREAS, said annexation petition together with a description of the territory to be annexed and a scale map showing the boundaries of such territory and its relation to the municipalities involved, having been filed with the City Clerk of the City of Oshkosh and the Town of Oshkosh; and WHEREAS, a copy of said annexation petition together with a description of the territory to be annexed and a scale map having been mailed to the Director of the Planning Function, Department of Resource Development, State of Wisconsin, and the appropriate School District Clerk within five (5) days of the filing of said petition; and WHEREAS, not more than one hundred twenty (120) nays have lapsed since the filing of the annexation petition; and _ WHEREAS, the Director of the Planning Function of the Department of Resource Development of the State of Wisconsin has issued his opinion that the annexation is not contrary to the public interest; and WHEREAS, the petitioners have ordinance temporarily designate the areas for zoning puxposes; and - 18 - requested that the annexation classification of the annexed August 16, 1984 #9 Cont'd. WHEREAS, the Plan Commission of the City of Oshkosh has recommended that the said property be temporarily zoned as follows: R-1B Single Family Residence NOW, THEREFORE, the Common Council of the City of Oshkosh do ordain as follows: SECTION 1. The following described territory, pursuant to a duly circulated and filed annexation petition for direct annexation is hereby annexed to and made part of the City of Oshkosh, a municipal corporation located in Winnebago County, more specifically to the 15th Ward of said City and is annexed for school purposes also and is hereby made a part of the City School District, and subject to Wisconsin Statutes and the amendments thereto: A parcel of land in the south 1/2 of Section 7, Township 18 North, Range 17 East in the Town of Oshkosh, Winnebago County, Wisconsin, described as follows: Commencing at a point on the south line of Section 7, being the intersection of the centerlines of East Murdock Avenue and Hickory Lane as shown in the Doemel Plat, then N. 2°15' W., 488.54 feet along the centerline of Hickory Lane, thence N. 87°45' E., 302 feet, more or less, to the westerly shoreline of Lake Winnebago, thence northeasterly along the westerly shoreline of Lake Winnebago to the westerly line of Lot 2 of the Doemel Plat, thence northerly along the westerly line of said Lot 2 to the northerly line of Hickory Lane (originally shown as Lake Drive), thence N. 73°55' E., along the northerly line of Hickory Lane 339 feet more or less, thence N. 1605' W., 30 feet, thence N. 61°5' W., 300 feet, more or less to the southerly shoreline of Lake Winnebago, thence southwesterly along the shoreline of Lake Winnebaqo to the extended centerline of Hickory Harbor, thence due south along the centerline of Hickory Harbor to the extended northeast side of Lot 248 of the Seventh Addition to North Point Plat, thence S. 45� E., 41 feet, thence due south 180 feet to the south line of Section 7 also being the centerline of East Murdock Avenue, thence east along the south line of Section 7 to the point of beginning. This parcel contains approximately 19.77 acres. SECTION 2. Sections 1-28, 1-29, 10-1 and 10-3 of the Oshkosh Municipal Code pertaining to Boundaries, Wards, Polls, Benchmarks are hereby amended so as to reflect the provisions of this ordinance and the proper City officials are hereby authorized and directed to make such changes. - 19 - �ugu�t 16, 1984 " " #9 Cont'd. The proper City officials are hereby authorized and directed to comply with the following requirements of Section 66.021(8) of the Wisconsin Statutes and the City Clerk shall give written notice to the appropriate Town Clerk of the acceptance of the annexation petition and the adoption of this ordinance. SECTION 4. That said property hereinabove described is hereby temporarily zoned as follows: R-1B - Single Family Residence SECTION 5. The Common Council of the City of Oshkosh do ordain as follows: WHEREAS, an annexation petition duly circulated has heretofore been signed by the owners of more than one-half of the real property in assessed value within such territory, and by a majority of the electors residing in said territory, notice of intention to circulate an annexation petition for direct annexa- tion having been duly published, and a copy of said notice with a scale map reasonably showing the boundaries of the area sought to be annexed and its relation to the municipalities involved, having been duly served upon the affected municipal and school district clerks and the Director of Planning Function, Department of Resource Development, State of Wisconsin, within five (5) days of the date of publication of said notice, adoption of this ordinance shall constitute acceptance of the petition of annexa- tion, and WHEREAS, more than twenty (20) days have lapsed since the publication of the notice of intention to circulate such annexation petition and not more than one hundred twenty (120) days have lapsed since the filing of the annexation petition, and WHEREAS, the Director of the Planning Function of the Department of Resource Development of the State of Wisconsin has issued his opinion that the annexation is not contrary to the public interest, NOW, THEREFORE, the Common Council of the City of Oshkosh do ordain as follows: SECTION 1.
