PURPOSE: APPROVE HIGHWAY AGREEMENTS
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED by the Common Council of the City of Oshkosh
that the proper City officials are hereby authorized and directed to
enter into appropriate agreements with the State of Wisconsin for
Westhaven Drive and Hazel Street.

This reGU?st for the proSramming and construction of a highwzy improvement, upon acceptance by the FiighwaPy�-r,,,.,r,.:<��.,
sha�l constitute an Aqreement between the Wisconsin Department of Transportation and the Municipality, and unless specifically
mcdified or amended by supplemental written agreement between the State and the Municipality is subjed to all of the following
terms and conditions.
Terms and Conditions
1. When Federal Funds are involved in the improvement, the initiation and accompGShment of the improvement will be zu4ject
to tne applitabie Federal Aid Hi9hway Acts and Regulations of the Federal Highway Administration, U.S. Department of Transportation.
2. 7he 6lunidpality will contribute and pay to the State al1 cost incurred by the State in connection with the improvement whlch
is not eligible (or State and/or Federal fund financing.
• 3. Federal aid and/or State hiqhway fund financing will be limited to __'? _ percen± (%) participation in the construction

(a) New instaliations of or alteration of sanitary sewers and connections, wa[er, 9zs, electric, telephone, tele9raph, fire or
police alarm facilities, parking meters, and similar utilities.

Damages to abutting property due to chanqe in street or sidewaik widths, 9rades or drainage.
Conditioning, if required, and maintenance of detour routes.
(d) Repair of damages io roads or streetr caused by reason of their use in hauting matcrials incident to the improvement.

6. The State will, at rts cost and expense:
(z) Place and malntain si9n5 and markers for approved detours of state trunk route5.
(b) Finance State expenscs of purely an admini5trative nature.
(c) CondiYion, if requlred, and malntaln the portlons ofi apProved detour5located on hl9hways whidi are maintained by
the State.
7. The work on projeds, insofar as that eligible for State and/or Federal participation is concerned, will be performed under
contracts I�t and administered by the State and under its cupervision, Such contracts may also indude items of work �iot eligible
for Federal or State participation which are considered necessary to mmplete the project.
Work to be performecl by the Municipality without Federdl aid or State highway fund participation, necessary to insure a com-
plele improvzrnent ,cteptable to the Federa Hinhway Admii�.istration and,ior the S;ate, may be done in a manner at the election of
ihe Municlpa�'rty b�t must be coordinated with tlie �n�ork un< .�rtal<en by the State.
The funds t� be provided by the Municlpality (except for work performed by the Municipality) wifl 6e deposited with the
St�te. The authority for the Municipality to provide funds for wch improvernents ard to enter into agreements with the Sta�e is er�
tznded by Secti�n 8G25(1), (2), and (3) of the Statufes.

Before execution ot a contract for the work, the Municipality, upon request of the State, will deposit with the Sta[e funds In
an amount ESl'INATED by the State to defray all necessary costs incident to the project which are not chargeabie to Federal or
S;z;< H,qhway funds. Should the Municipality ded!ne to make the required depo5it, ii 15 unde�stood that no Gontract fo� the eze-
cu[�on of the work will be entered into and disposition of the project will be the subject of further negotiations between the Muni-
c�oall!y and State. If the Municipality should wilhdraw the project, it wili Pay to the State any cost that has been inwrred by ihe
Sta[e in behal� of the project.
Upon completion of construction, a final autlit will be made to determine the final division of costs of the project.
8. The D�strlct Office Ot the Division of Highways will cooperate with and advise the Municlpality during the survey and plan
development phase. The cost of any survey, pian, and preconstruction engineering undertaken by the State, other than atlministra-
;ive expenses, will be charged to the Municipality.
It is understood that, upon completioo of the planz anrl prior to the execution of the contract for the work, the project wifi be
subiect to further agreement between the MunicipaGty znd the State with resped to the detail of Cesign, apprOVal of plans, and if
reCeral aid is to 6e used, cer,ain reGUirements to satisfy the p�ovisions of the Federal Aid Hlghway Act and the regulations iswed
pursuart thereto. It is further agreed by the Municipality that:
(a) It will maintain, 2t its ov,-n cost and expense, all portions of the project that lie within its jurisdiction for suCh main-
te^.�nce tnreugh statutcry requireme.^.!s, in a manner satisfactory to the State or the Federal Highway Admini5lration or both, or
tne,r autnorized representatives, anC will make ample provision for such maintenance each year.
(b) It will keep recortls ot cost of co�struct9oa, inspection, tests, and maintenance done by it as will enabie the State
tn re::ort, upon request of the Federal Hi9hway Administrztion, the amount and nature of the ezpenditure for these purposes: that
the account< ar,d records of tuch ezpenditures, to5ether w-� :h all supporting document, wfll be kept open at all times to inspection
by authorizetl representatives of !he Federal HigP.way Administra#ion; and that it witl fumish copies thereof when reque5ted,
(c) All signs anC traffic controi devices and other protective strudures erected on or in connectlon with the project,
includ�ng such o' these as are insta�led at the sole cost and expense ot the Municipallty or by others, will be in contormity with such
r-�ar�uai of uriform traffic centrol devices as may he adopteA by the American Association of State Highway and Transportation o`fi-
c�a's, aGPro�ed by the State, and ccncurred in by the Feceral Hlghway Admi��: ���.ztration.
(tl) The right ot way availabie or provided for the project will be heid and maintained inviolate for public highway or street
purposes. Those signs prohibited under Feder:��l aid hiqhway regulations, posters, billboards, roadside stznds, or other private installa-
tiocs prohibited by Federal or State hiqhway regulations will not be permitted within the riqht of way limits of the project. The tdun-
Icipallty, within its jurisdictional limits, will remove or cause to be removed from the right of way of the project all private instailations
of v:hatever nature which may be or cause an obstruction or interfere with the free flow of traffic, or wi�.ich m��ry be or cause a hazard
co traffic, or which impair the usefulness of the project and all other encrc:;chmenY which may 6e reGuired to be removed by the State
z± �u own eiectien or at the request of the Federat Highway Administratic;�, and that no such private installations will be permittzd to
be e:ected or maintained in the future.
(e) It will prohibit angle parking.
(`) It wiil regulate o� prohibit ali parking at locations where and when the pavement area usually occupied by parked vehicies
will be needzd to carry active traffit in the street.
(;) It will assume general responsibility for ail public information and public relations for the projed and to make fitting
ar;no�ncement to the press and such outlets zs woultl generally a�ert the aHected property owners and the community of the nature,
extent, and tlming of the project and arrangements for handling traffic within and around the projeds.
(f-�) It will comply with ail appiicable provisions of the Wisconsin Action Plan.
(i) V,'hen the acquisition ol right of way is to be finanted eithcr in whole nr in part with Federal f�_mds, such purchases or acyuis-
�tions wlu compiy with the provisions of Titles fI and III of the Uniform Relocation Assistance and Real Property Acquisition Policies
Act oi 1970 (d2 U.S.C. 4601 et seq.) as may be amended from time to time, and the requirements set forth in Section Il of the State'S
Mim.mum Right of Way Repuirements for Federal Aid Urban Systems & TOPICS Projects of July 1973 a5 may be amended trom timr
to time.
(j) When the acquisition ol right ot way is to be financed 6y the Municipality or other utility or faulity o�vner, such purchases
cr acquisitions will comply vaith the provisions of 7i{les II and fIl of the Uniform Relocation Assistance and Real Property Acquisition
Policies Act of 1970 (42 U.S.C.4601 et seq.) as ntay be amended from time to lime, Title VI of thc Civil Rights Ad of 196d, and the
reqwrements as set torth in Settion 1 of the State's Minimum Right of Way Requirements for Federal Aid Urban System & TOPICS
