RESOLUTION
WITHDRAWN )
PURPOSE: APPROVE NEW COMPLIANCE SCHEDULE
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, the City of Oshkosh desires to continue to extend its
Sanitary Sewer System, and;
WHEREAS, the City of Oshkosh by previous resolutions, has agreed
to, and remains committed to the elimination of all Category 1
bypasses and overflows no later than July 1, 1986, and;
WHEREAS, those previous resolutions,as amended, also contained
interim deadlines for submittal of a Sewer System Evaluation
Survey (SSES), and for submittal of a facilities plan, and;
WHEREAS, said SSES and Facilities Plan have been submitted and
approved, and;
WHEREAS, design of corrective facilities has commenced prior to
Facilities Plan approval to ensure timely elimination of bypasses
and overflows by July 1, 1986, and;
WHEREAS, the initial Contract Plans and Specifications were
submitted on June 29, 1984 and the remaining six contracts have
been or will be submitted not later than October 11, 1984, and;
WHEREAS, current construction schedule estimates indicate that
corrective measures will require less construction time than had
originally been anticipated, and;
WHEREAS, the City of Oshkosh had already acted promptly to
correct infiltration and inflow problems as they were found by
its engineering consultants, instead of waiting for finalization
of the SSES, and;
WHEREAS, the City has taken measures to eliminate bypassing at
the State Street pump station pending completion of construction
of the Phase I Rehabilitation Contracts by July 1, 1986, and;
WHEREAS, the Wisconsin Department of Natural Resources is now
denying extension of city sewers in all areas of the City,
including those which have no effect whatever on the bypassing
and overflows, and;
WHEREAS, the City of Oshkosh is taking all measures over which it
has control to meet its commitments in good faith,

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the city
of Oshkosh, that the Wisconsin Department of Natural Resources is
hereby requested to establish a new compliance schedule for the
City of Oshkosh relative to the ability of the City to obtain
approvals for future sewer extensions as shown below and subject
to the conditions listed in the resolution adopted April 2, 1981:
