APPROVE AGREEMENTS WITH STATE OF WISCONSIN
DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED by the Common Council of the City of Oshkosh that the
proper City officials are hereby authorized and directed to enter into appro-
priate engineering and construction agreements with the State of Wisconsin for
the Congress Avenue to Roosevelt Avenue project.
BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated
from: Account No. 338-999 - Street Improvement Fund Expenditures.

Attached are three copies of an engineering services agreement for the above
project. Before we can proceed with the services indicated on the agreement,
we will need two signed copies returned to this office. We estimate the cost
of these services to be $4,000.
A preliminary estimate of the construction is $80,000. The estinate includes
mi113ng off approximately 2 inches of the existing surface, resurfacing with
3 inches of bituminous recycled pavement and other miscellaneous items. This
construction work is planned for the summer of 1986 and would be combined
with our project from Roosevelt Avenue to USH 41.
We will wait for a response from you before we proceed any further.

Attached are three copies of the standard Project Agreement forms for the
construction of this projeet. This agreement sets the terms and estimated
cost of the project.
A preliminary estunate of the construction is $80,000. The estimate includes
milling off approximately 2 inches of the existing surface, resurfacing with
3 inches of recycled bituminous pavement, and other miscel2aneous items. This
construction vaork is planned for the summer of 1986 and will be combined with

The signatory city, village, town or county, hereinafter called the Municipality, through its undersigned duly authorized officers
or otficials, herehy reQUests the State of Wixonsin Department of Tronsportation, through its Division of Highways, hereinafter called
the State, to initiatz proceedings and engineering development and to effect the construction of the highway or street improvemenl

This �equest for the programming and construction of a highway improvement, upon ac[eptance by the)tP�HW�t{C4rYrt(�SYS1Gi5H
shall constitute an Agreement between the Wisconsin Department of Transportation and the Municipality, and unless specifically
moditied or amended by supplemental writteA agreement between the State and the Municipality is subject to all of the following
terms and conditions.
Terms and Conditions
1. When Federal Funds are involved in the improvement, the initiation and accomplishment of the improvement will Ce subject
to the applicable Federal Aid Highway Acts and Reyulations of the Federal Highway Administration, U.S. Department of Transportation.
2 The Municipality will contribute and pay to the State all tost inw« ed by the State in connection with the improvement which
iz not eligible for State and/or Federal fur.d financing.
3. Federal aid and/or State highway fund financing will be limited to ��— percent (%) participation in the construction
costs of the following items: (State funds limited to State trunk highway routes and connecting streets.J �
(a) The pavement, base, curb and gutter, together with all grading. �
(b) Catch basins and inlets for surface water Grainage of the improvement, with connections to the storm sewer main.
(c) Construction engineering incident to inspection and supervision of actual construction work.

4. Work necessary to complete the improvement to be financed entirely by the Municipality or other utility or facility owner

New installations or alteration of street lighting and traffic signals or devices.

5. Work necessary to complete the improvement to be financed entirely by the Municipality or other utility or facility owner

police alarm facilities, parking meters, and similar utitities.
(h) Damages to abutting property due to change in street or sidewalk widths, grades or drainage.
(c) Conditioning, if required, and maintenance of detour routes.
(d) Repair of damages to roads or streets caused by reason of their use in haulinq mate�ials incident to the improvement.

7. The work on projects. insofar as that eligible for State and/or Federal participation is concerned, will be performed under
contracts let and administered by the State and under its supervision. Such contracts may also indude items of work not eligible
for Federal or State participation which are consideretl necezsary to comptete the project.
Work to be performed by the Municipality without Federal aid or State highway fund participation, necessary to insure a com-
plete improvement acceptable to the Fetlera Highway Administration and/or the State, may be done in a manner at the election o`.
the Municipality but must be coortlinated with the work undertaken by the State.
The funds to be provided by the Municipality (except for work performed by the Municipality) will be depositetl with the
State. The authority for the Municipality to provide funds for sudi improvements and to enter into agreements with [he State is er-
tentled by Section 86.25(1), (2�, and (3) of the Statutes.

The 36-foot v:ide curbed street was originally constructed with concrete in 1934• It was
resurfaced in 1956 and again.in 1973• The pavement surface is badly deteriorated, shows
reflective cracking and is in need of repair.
