HomeMy WebLinkAbout33157 / 85-02Januar¢ 3, 1984 # 2 ORDINANCE (CARRIED PURPOSE: INITIATED BY: LOST LAID OVER AMEND PARKING VIOLATION FINES CITY ADMINISTRATION WITHDRAWN ) A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDZNG SECTIONS 27-38.4 (2), 27-40 AND 27-48 OF THE OSHKOSH MUNICIPAL CODE PERTAINIIQG TO PARKING VIOLATION FINES. The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 27-48 is repealed and recreated to read as follows: Each owner or operator shall, within 120 hours after 6:00 p.m. of the day of the violation�pay to the city as a penalty £or and in full satis£action of such vio- lation, the sum of Two ($2.00) Dollars. Each such owner or operator shall, after said 120 hour period�pay a penalty of Five ($5.00) Dollars. However, if the penalty is not paid within fifteen (15) days after 6:00 p.m. of the day of the violation, each such owner or operator shall then pay a penalty of Fifteen ($15.00) Dollars; except that if the penalty is not paid within forty-five i45) days after .6:00 p.m. of the day of the violation, each such owner or operator shall pay a penalty of Twenty-five ($25.00) Dollars. The failure of such owner or operator to make such payment shall render such owner or operator subject to the penalties herein- after provided for violation of the provisions of this section. Each time a designated parking period limit is exceeded even though such violationsshall be consecutive, shall constitute a separate violation. SECTION 2, That Section 27-40 of the Oshkosh Municipal Code is amended by adding the following: (E) Alternate Procedure. In lieu of the foregoing, where violations of this Article are noted by issuance of a parking ticket, each such owner or operator shall, within 120 hours after 6:00 p.m. of the day of the violatiory pay to the City as a penalty for and in full satisfaction of such violation, the sum of Five Dollars ($5.00). Each such owner or operator shall, after said 120 hour period, pay a penalty of Eight Dollars ($8.00). However, if the penalty is not paid within fifteen (15) days after 6:00 p.m. of the day of the violation, each such owner shall then pay a penalty of Eighteen Dollars ($18.00); except that if the penalty is not paid within forty-£ive (45) days after 6:00 p.m. of the day of the violation, each such owner or operator shall pay a penalty of Twenty-eight Dollars ($28.00). The failure of such owner or operator to make such payment shall render such owner or operator subject to the penalties provided in Section 27-48.1. Each time a designated violation is noted by issuance of a parking ticket, even though such violations shall be consecutive, shall constitute a separate violation. - 3 - January 3, �9a5 # 2 OItDINANCE SECTION 3. That Section 2%-38.4 (2) of the Oshko�h Municipal Code i� repealed and recreated to read as follows: (2) Any person violating the provisions of this Section may be required to forfeit not 1es� than $30.00 nor more than $300.00� excep� that where violstions of this section are noted by the issuance of a parking ticket� each owner or operator of such veh�cle shall� within 120 hours after 6:00 p.m. of the day of the violation� pay to the city as a penalty for and in full satisfaction of such violation� the sum of Twenty ($20.00). Each such owner or operator shall� after said 120 hour period� pa� a penalty of Twenty-three Dollars. However� if the penalty is not paid within fifteen days after 6:00 p.m., of the day of the viol,ation each such owner shall then pa� a penalty of Thirty-three (�33.00) Dollars� except that if the penalty is not paid within forty-f'ive (45) days after 6:00 p.m, of the day of the violation� each such owner or operator shall pay a penalty of Forty-three (�43.00) Dollar�. The failure of such owner or operator to mak� such pa;�ment shall render sucn owner or operator subject to the penaltie� provided in Section 2�-�8.1, E�ch time a designated violation is noted by i�Guance of a parking ticket, even though �uch violations Ghall be consecutive� shall con�titute a �eparate violation. SECTION �. Thi� ordinance �ha11 be in full force and effect from and after March 1, �985� upon its passage and publication.
