NOW, 1F�RGE'ORE, IT ZS tiERFEY AGE2E[�D between.the City of Oshkosh, a mimicipal mryoration located in winnebago County, wisconsin, hereinafter called "City," and the Catholic C�etery Association of Oshlwsh, Oshkosh Wisconsin, hereinafter calle3 "The Catholic Pssociation," as follws: A. The City of Oshkosh agrees to provide the following services on the afora�entioned Calvary ��etery and Riverside Catholic Cemetexy: 1. Turf a�intenance camionly associated with a cesretery includir�q cutting, :.o�7ding, irriyatirn�, weed control, and trimning. 2. Snau raroval on cert�tery roads used for funeral servi�s. 3. Uxating, spotting, ar�d establishing the proper locations for imrediate inte.rnments acd ttieir mrresparling mazkess. 9. IE�+t�or for the repair of irrigation liries and valves. 'lhe cost of needed supplies and materials will be billed at Gity cost to the Catholic Pssociation. 5. D3uiprient and related expenses such as gasoline, oil, and la6or used in noxmal turf maintenance fimctions. 6. M office will be provide3 to the Catholic Canetery Associatim, such to be approximately 9 x 12' and to be located in the M�ilding camnnly referred to as the Ri�rerside Chapel. Such office sha11 be provided with adequate heat, lights, and related utilities. 7. The Catialic Association may re3uest the City of Oshkosh mnduct intexnrtient services at the approved rate sd�edule and that the City inwice tl�e appropriate ra3uesting party, and the City of psh]msh may agree to do same. The Catholic Association will pay to the City of Oshkosh the amount of $23,850.00, such �}nrelits to be made in quarterly install�tents, payable by the 15th of the m�nths de���3 },o � apPropriate by the ��itment of�Finance of the City of c�hkosh, and payrtents to be msde at the Collection ��xt�rent, City Hall, ZLS ii1l1LC11 �VP1]U2� OStI)COSfI� W15CQ151I1. C. The Catholic Associatimi azul the D'uectar of Parks of the City of �lilcosh or his designee will cooperate with each other in the use, operation, security, and hours of operation or similaz �tters with regazd to the cmeteries, in order to protect, rt�intain, and to seeuce the physical cc�c�orwnts loeated within tl�e caretecy and to provide proper service within the cmietezy, Hw.ever, the decision of tne City of Osiixost� wiil be Linal whenever a cmflict arises. 7Yte Catholic Associatim� agrees to provide proper s�ervision of the offices to be rented by it and.to use all reasonable efforts to prevent vandalism or damaye to City property, and the Association agrees to leave any prenuses occ�ied by Uwm at the end of the year in good cmdition at the teTmuiation of the agree- ment." The Catholic Association will be respw�sible for any/and all c�iretery related activities incl�rling but not limited to the selling of lots, publishing and advertising, record keeping, inwicing, collectim of fees, tree care, i.e.; the planting, re�noval, and cii.sposal o: all wocd, li�rbs, and leaves associatzd with the trees.
