WAIVING YUBLIC BIDDING AND
ANTI-DISCRIMINATION REQUIREMENTS
FOR
Pacur Inc.

WI:EREAS, the City of Oshkoch, hereinafter called the
"Municipality", has by resolution of i.ts Common Council
expressed its intent to issue ir.s industri.al revenue bonds
pursuant to Section 66.521 of the Wisconsin Statutes in an amount
not to exceed $2,500,000.00, for the purpose of financing on
behalf of Pacur Inc., hereinafter called the "Company", costs
related to the construction of an addition to, and purchase and
installation of equipment for, the facility presently operated by
the Company in the City in connection with its business, which
construction, equipping and related improvements are herein
called the "Project", and
WHEREAS, Section 66.521 (11) (b) 1. (i) of the 4lisconsin
Statutes provides that construction work which is let by contract
and which has an estimated cost exceeding $5,000 may be financed
with industrial revenue bonds only if the contract is let to the
lowest responsible bidder and proposGls for the contract are
advertised by publishing a Class II notice under Ch. 985 and (ii)
prohibits discrimination in access or employment based on race,
creed, sex, handicap, ethnic origin, age or marital status with
regard to construction and operation of projects financed under
the Act, and
WHEREAS, the Company has nade representations to the City
that compliance with the notice and public bidding requirement in
the first sentence of said Section 66.521 (11 (b) 1. could render
the Company unable to employ the services of companies the
Company believes to be best suited to perform construction work
on the Project and that while khe Company supports
anti-discrimination policies of the type enunciated by the
statute, it would prefer in the light of negotiations with
prospective purchasers and the need for certainty in the context
of the bond financing to have [hem effectuated by a contractual
provision with a clearly specified remedy, and
WHEREAS, Section 66.521 (11) (b) 2. of the Wisconsin Statutes
provides the City wiUi authority to waive the publi.c bidding and
anti-discrimination requirements.
NOW, TtIEREFORE, BE IT RESOLVEll by the Common Council of the
City of Oshkosh that this Common Council hereUy finds (i) that
the imposition of the public notice and bidding requirements of
Wis. Stats. Sec. 66.521 (11) (b) l, could render the Company

unable to employ the services of companies the Company believes
to be best suited to perform construction work on the Project as
well as hinder the expeditious development of the Project and
(ii) that the anti-discrimination requirements are more
appropriately handled in the light of the needs of this bond
financing by contract with the Company; and, Cherefore, this
Common Council pursuant to the authority granted to it by Section
66.521 (11) (b) 1, of the Wisconsin Statutes with regard to the
Project, provided that the revenue producing agreement or
agreements for the financing shall contain an anti-discrimination
provision satisfactory to the City of Oshkosh.
PURTfIER RESOLVED, That the City Clerk is hereby directed to
publish this Resolution as a Class 1 notice under Ch. 985, Wis.
Stats., in the Oshkosh Daily Northwestern, the official newspaper
of the City,
