HomeMy WebLinkAbout33250 / 85-07March 21, 1985 (CARRIED PURPOSE: #7 LOST LAID OVER RESOLUTION WITHDRAWN ) GRANT EASEMENT TO WISCONSIN PUBLIC SERVICE INITIATED BY: CITY ADMINISTRATION PLAN COMMISSION RECOMMENDATION: APPROVED 8-0 BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to grant a permanent easement to Wisconsin Public Service Corporation to provide for the installation of an underground electric distribu- tion system lying in the following described real estate: Part of Lot 24, Block 20 of L. M. Miller'S lst Addition, City of Oshkosh, County of Winnebago, State of Wisconsin. The area of above parcel being more specifically described as: The East 10 feet of the West 26 feet of the South 21 feet of said Lot 24, Block 20. Box 1130 Oshkosh, WI 54902 Dear Mr. Konrad: Attached is an original and three copies of an easement which Ron Buttke has prepared. This is to accortunodate the installation of a PME-9 padrnounted switchgear at the corner of State Stre�t and Caape Avenue. I have attached a sketch to indicate our proposed installation. The=e is an existing manhole at the corner of Ceape Avenue and State Street. Duct will be extended out of this manhole to the site of the nearest island in the parking lot. This will be a 12 bank concrete encased duct. In this island, the duct will feed into a pit, upon which will sit the PMB-9 switch. Z have attached a sketch which indicates the size of this pit which will sit in the parking lot island. This switchgear is being installed at this time to improve reliability to the new city convention center and provide for a feed to the proposed transportation center. I have received preliminary aporoval from cur Budget Department to install this switchgear at this time. As long as there is no request for relocating existing overhead lines on Ceape Avenue underground, Wisconsin Public Service Corpuration caill pay all the costs of this installation. This cost is estimated at approximately $15,000. Our Budget Departments considers this work an improvement to the electric distribution system in general; thus, there is no charge to any customers. I would appreciate it if you could have this easement reviewed and presented to the proper city officials for approval and siynature. Resolution # 7 UNDERGROUND ELECTRIC OJSTRIBUTION SYSTEM EASEMENT THIS INDENTURE made this day of Fe6ruary, 1985, between City of Oshkosh, of Winnebago County, grantor, in consideration of One and 00/100 Dollars ($I.00) to it paid by WISCONSIN PUBLIC SERVICE CORPORATION, grantee, receipt whereof is hereby acknowledyed, does hereby grant unto said WISCONSIN PUBLIC SERVICE CORPORNTION, its successors and assigns, the perpetual right, permission, authority and priviliege to construct, install, operate, maintain and replace necessary and usual appurtenant equipment, all for the purpose of electrical energy for light, heat and power, or for such other purpose as elzctric currert is now or may herearter be used over, across, within and beneath certain easement areas as shown below, on land owned by said grantor in the City�of Oshkosh, County of Winnebago, State of Wisconsin, described as follows. to-wit: Part of Lot 24, Block 20 of L. M. Miller's lst Addition, City of Oshkosh, County of Winnebago, State of Wisconsin. The grantor shall give reasonable notice to the WISCONSIN PU6LIC SERVICc CORPORATION, grantee, in writing, of any trees, buildings, or other objects 6eing placed within the bounds of the easement which would interfere with the operation or maintenance of the aforeinentioned electric facilities and of any change in grade of land cover of four (4) inches or more within th 6ounds of the easement. The covenants herein contained shall bind the parties hereto and their respective heirs, executors, administrators, successors and assigns.
