PURPOSE: INITIAL RESOLUTION FOR GRADING, GRAVELING AND
CONCRETE PAVING
INITIATED: DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED by the Common Council of the City of Oshkosh as
follows:
l. The Common Council hereby declares its intention to exercise
its power under Section 66.60 of the Wisconsin Statutes to levy
special assessments upon property within the following described areas
for benefits conferred upon such property by improving the following
named streets, said public improvements to include the following:

Extension of Village Lane as described below:
All that part of Outlot 6 of Westhaven and part of the
southwest 1/4 of the northwest 1/4 of Section 28, T18N,
R16E, City of Oshkosh, Winnebago County, Wisconsin, more
fully described as follows:
Commencing at the west 1/4 corner of said Section 28,
T18N, R16E, thence S89°-29'-50" E, along the south line of
the SW 1/4 of the NW 1/4, a distance of 1448.24 feet to
the northwesterly cotner of previously dedicated Village
Lane (formerly Maricopa Drive) and point of beginning;
thence N30°-23'-30" [a, 33.14 feet; thence along the arc of
a curve to the left 71.62 feet, which has a radius of
92.22 feet, a central angle of 44°-30'00" and a long chord
of 69.84 feet which bears N52°-38'-30" W to the point of
tangency; thence N74°-53'-30" E, 70.00 feet; thence N15°-
06'-30" E, 60.00 feet; thence S74°-53'-30" E, 70.00 feet;
thence along the arc of a curve to the right 118.22 feeta
which has a radius of 152.22 feet, a central angle of 44 -
30'-00" and a long chord of 115.27 feet which bears S52°-
38'-30" E to the point of tangency; thence 530�-23'-30" E,
69.00 feet to the northeasterly corner of dedicated
Village Lane, (formerly Maricopa Drive); thence N 89°-31'-
19" W, along the northwesterly line of said dedicated
street, 69.90 feet to the point of beginning.
Generally located noxth of Westhaven Circle, extending
approximately 216+ feet from existing Village Lane.
2. Said public improvement shall include the gxading of the
above named street to the grade hereafter established by special
ordinance of the City of Oshkosh, and concrete paving as described
above and appurtenant work with concrete curb and gutter on both sides

of the street at a grade heretofore established by special ordinance
of the City of Oshkosh.
3. Before such improvements are made, the Board of Public Works
is directed to cause water and sewer service pipes to be laid in said
streets from the mains to the curb line of each lot fronting on the
said streets and to keep an accurate account of the expense incurreu
in front of each lot and report the same to the Comptrolier who shall
cause the amount charged to each lot to be entered on the tax roll as
a special tax against said road, provided, however, that the Board of
Public Works shall not cause such laterals to be so laid for any
particular lot, or parcel where, in the opinion of the Board of Public
Works, it would be impractical to do so.
4. The total amount assessed against such district shall not
exceed the total cost of the improvements, and the amount assessed
against any parcel shall not be greater than the benefits accrued
thereto from said improvements.
5. The assessments against any parcel may be paid according to
the provisions of Section 25-83 through 25-89 of the Oshkosh Municipal
Code.
6. The Board of Public Works is directed to prepare a report
consisting of:
a. Final plans and specifications for said improvements.
b. An estimate of the entire cost of the improvements and
laterals.
c. An estimate as to each parcel of property within the
assessment district of:
(1) The assessment of benefits to be levied for each
improvement.
(2) The damages to be awarded for property taken oc
damages by each improvement.
(3) The net amount of benefits over damages or of
damages over benefits for each improvement.
Upon completion of such report, the Board of Public Works is
dizected to file a copy thereof in the City Clerk's office for public
inspection.
7. Upon receiving the report of the Board of Public Works, the
City Clerk is directed to give notice of a public hearing on such
reports as specified in Section 66.60(7) of the Wisconsin Statutes.
The hearing shall be held by the Board of Public Works at the Council
Chambers in the City Hal l at a time set by the Clerk in accordance
with Section 66.60(7) of the Wisconsin Statutes.
8. The installation of said street improvements shall be
accomplished according to the provisions of Section 25-3 through 25-11
of the Oshkosh Municipal Code.
