HomeMy WebLinkAbout33335 / 85-14May 2, 1985 $ 14 RESOLUTION (CARRIED PURPOSE: INITIATED BY: LOST LAID OVER WITHDRAWN FINAL RESOLUTION - GRADING, GRAVELING AND CONCRETE PAVING DEPARTMENT OF PUBLIC WORKS WHEREAS, the owner(s) of the property waived notice of special assessment and hearing pursuant to Wisconsin Statutes, Sec. 66.60 and 66.64, for the purpose of hearing for the purpose of hearing all interested persons concerning the preliminary resolutions and reports of the City Manager (BOard of Public Works) on the proposed improvements consisting of the grading, graveling and concrete paving with concrete curb and gutter and appurtenant work pursuant to initial resolution adopted on May 2, 1985, by the Oshkosh Common Council of the following named streets: :.� � � L� � � �1� K�3�1���?i��i+7�J�Le7 Extension of Villaae Lane as described below: Al l that part of Outlot 6 of Westhaven and part of the southwest 1/4 of the northwest 1/4 of Section 28, T18N, R16E, City of Oshkosh, Winnebago County, Wisconsin, more fully described as follows: Commencing at the west 1/4 corner of said Section 28, T18N, R16E, thence S89°-29'-50" E, along the south line of the SW 1/4 of the NW 1/4, a distance of 1448.24 feet to the northwesterly corner of previously dedicated Village Lane (formerly Maricopa Drive) and point of beginning; thence N30°-23'-30" W, 33.14 feet; thence along the arc of a curve to the left 71.62 feet, which has a radius of 92.22 feet, a central angle of 44°-30'00" and a long chord of 69.84 feet which bears N52°-38'-30" W to the point of tangency; thence N74°-53'-30" E, 70.00 feet; thence N15°- 06'-30" E, 60.00 feet; thence S74°-53'-30" E, 70.00 feet; thence along the arc of a curve to the right 118.22 feet, which has a radius of 152.22 feet, a central anqle of 44°- 30'-00" and a long chord of 115.27 feet which bears S52°- 38'-30" E to the point of tangency; thence 530°-23'-30" E, 69.00 feet to the northeasterly corner of dedicated Village Lane, (formerly Maricopa Drive); thence N 89°-31'- 19" W, along the northwesterly line of said dedicated street, 69.90 feet to the point of beginning. Generally located north of Westhaven Circle, extending approximately 216+ feet from existing Village Lane. -24- � May 2, 1985 #14 Cont'�. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh as follows: 1. That the report of the City Manager, acting as the Board of Public Works, pertaining to the construction of the above-described public improvements, including plans and specifications therefor, is hereby adopted and approved with the following modifications: a. b. c. 2. That the action of the City Manager in advertising for bids and to carry out the work of such improvemencs in accordance with the report of the City Manager and in accordance with the said resolutions heretofore adopted, is hereby approved, ratified and confirmed. 3. That payment for said improvements be made by assessing the cost of the property benefits as indicated in said repoxt, except as modified herein. 4. That the benefits and damages shown on the report as modified are true and correct and are hereby confirmed. 5. That the assessments for all projects included in said report are hereby combined as a single assessment, but any interested property owner shall be entitled to object to each assessment separately or both assessments jointly for any purpose or purposes. 6. That the assessments may be paid in cash, or in installments pursuant to Section 25-83 and 25-89 of the Oshkosh Municipal Code. Said deferred payments to bear interest at the rate of ten percent (10�) per annum on the unpaid balance. The City Clerk shall publish an installment assessment notice in accordance with Section 66.54(7)(e) of the Wisconsin Statutes in the official newspaper of the City. 7. The City Clerk is directed to publish this resolution in the official newspaper of the City, the OSHKOSH DAILY NORTHWESTERN. 8. The City Clerk is further directed to mail a copy of this resolution to every property owner whose name appears on the assessment roll whose post office address is known or can with reasonable diligence be ascertained.
