BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated from Account No. 919-191 - Sewer Utility Construction in Progress. - 13 - SUBEtITTED BY APPROVED Resol. #12 SUPPLEMENTAL TASK ORDER N0. B TO THE AGREEMENT DATED 6/20/79 BETHEEN THE CITY OF OSHKOSH IN THE STATE OF WISCONSIN AND HOWARD NEEDLES TAMMEN & BERGENDOFF FOR CONSULTANT SERVICES IN CONNECTION WITH IMPROVEMENTS TO THE SENERAGE SYSTEM -13a- 8-�.0 Purpose Resol. #12 The purpose of this Supplemental Task Order is to establish scope, schedule and payment provisions for engineering assistance asso- ciated with preparation and submittal of Step 3 Grant Application documents for Wisconsin Fund monies to partially finance construc- tion of the Phase IB portion of the Sewer System Rehabilitation Project as more specifically described herein. 8-1.1 Consultant shall not commence xork on any task defined by this Task Order agreement until authorized by the City. 8-�.2 Agreement by the City to the provisions of this Task Order does not obligate the City to the Consultant for funding or authorization of any portion of this xork until such time that the City authorizes the work defined herein. �-�•3 The Consultant shall not retain the services of sny Subcon- sultant for assistance With the tasks described herein with- out authorization by the City of Oahkosh. 8-2.0 Scope The scope of the work to be performed under the Supplemental Task Order shall be in accordance with the general provisions described in the Agreement between the City of Oshkosh and Hoxard Needles Tammen & Bergendoff, dated June 20, 1979. These services are de- fined in Articles 2.1.4, Construction Phase, and 2.2 Additional Services, of the Agreement, and specifically described as follows. 8-2.1 The CONSULTANT will provide the following engineering ser- vices under this Supplemental Task Order: 8-2.�.1 PREPARE STEP 3 GRANT APPLICATION DOCUMENTS - The Consultant shall assist the City of Oshkosh in preparation of documents comprising a Step 3 Grant Application for Wisconsin Fund Grant monies admin- istered by the State of Wisconsin Department of Natural Resources Bureau of Water Grants. This assistance shall include preparation of application forms on behalf of the City of Oshkosh, and provi- sion of assistance to the City of Oshkosh in devel- oping documents as necessary to meet the normal requirements of the Wisconsin Fund Grant Application process. 8-2.1.2 SUBMITTAL OF STEP 3 GRANT APPLICATION DOCUMENTS - The Consultant shall submit the grant application documents as prepared by the City of Oshkosh with the Consultant's assistance and submit them to the granting-agency for their review. • -1- - 13b - Resol. #12 8-2.�.3 REVIEW ASSISTANCE - The Consultant shall assist the City of Oshkosh through the grant application review and approval process by providing additional project specific information or documentation as required by the Department of Natural Resources Bureau of Water Grants. 8-3.0 Schedule The xork under this Supplemental Task Order shall commence promptly after receipt by the Consultant of an executed copy o£ the Supple- mental Task Order, xhich shall constitut= authorization to proceed from the City to the Consultent. Preparation of the application documents shall be completed expeditiously to meet the granting agency deadlines. Assistance during the agency review and approval process shall terminate upon issuance by the Department of Natural Resources of Wisconsin Fund Step 3 Ready-To-Allocate funds status for Sewer System Rehabilitation Project Phase IB construction. 8-4.0 Minority and Small Business Enterprises (MSBE) Minority or Small Business Enterprises will not be retained by the Consultant to assist in providing the services included in this Supplemental Task Order due to its limited scope of included activi- ties. It is anticipated that Minority and Small Business Enter- prises xill be retained by the Consultant to essist in providing services during additional Step 3 related services, consistent with the City of Oshkosh's Stated guidelines for minority or small busi- ness enterprise participation. B-5.0 Payment 8-5.1 Payment for the work defined under this Supplemental Task Order shall be on the basis of a cost plus fixed fee in accordance with the general provisions described in Article 8.1.1 of the Consultant Services Agreement between the City and Consultant dated June 20, 1979• Total charges for work included in this Supplemental Task Order will not exceed $3,039, unless agreed io in xriting. 8-5.2 The estimated direct labor costs, indirect costs, other direct costs, and profit will be itemized in the Supplemental Task Order COST OR PRICE SUMMARY FORMAT FOR SUBAGREEMENTS UNDER WISCONSIN FUND GRANTS form, and on the attachments incidental to those forms. -2- - 13c - Resol. #12 IN WITNESS WHEREOF, the parties have caused this Supplemental Task Order No. 8 to be executed the year and the day below written by their proper officers and representatives.
