PURPOSE: INITIAL RESOLUTION FOR STORM SEWER
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED by the Common Council of the City of Oshkosh
as follows:
1. The Common Council hereby declares its intention to exercise
its power under Section 66.60 of the Wisconsin Statutes to levy
special assessments upon property within the following described area
for benefits conferred upon such property by improvement of the
following named streets, said public improvement shall consist of the
installation of sanitary sewer and water main as hereinafter listed:
STORM �EWER
A parcel of land in Lots 1 and 2 of Leach's Map, Block 103,
in the 15th Ward, City of Oshkosh, Winnebago County,
Wisconsin, described as follows:
Commencing at the NW corner of Lot 2 of said Block 103 and
also being the intersection of the easterly right-of-way of
the Soo Line Railroad and the south line of East Murdock
Avenue, thence southwesterly along the easterly right-of-way
of the Soo Line Railroad 340', thence southeasterly at right
angles to the Soo Line Railroad right-of-way 10', thence
northeasterly parallel to the Soo Line Railroad right-of-way
to the south line of East Murdock Avenue, thence W along the
south line of East Murdock Avenue to the point of beqinning.
Generally located east of Harrison Street and the Soo Line
Railroad tracks, extending south from East Murdock Avenue
approximately 340'. Commonly known as 411 East Murdock
Avenue.
2. The total amount assessed against such district shall not
exceed the total cost of the improvement and the amount assessed
against any parcel shall not be greater than the benefit accruing
thereto from said improvements.
3. The assessments against any parcel may be paid according to
the provisions of Section 25-83 thru 25-89 of the Oshkosh Municipal
Code.
4. The Board of Public Works is directed to prepare a report
consisting of:
(a) Final plans and specifications for said improvements.
(b) An estimate of the entire cost of the improvements
and laterals.

(c) An estimate as to each parcel of property within the
assessment district of:
(1)

The assessment of benefits to be levied for
each improvement.
The damages to be awarded for property taken
or damages by each improvement.
(3) The net amount of benefits over damages or of
damages over benefits for each improvement.
Upon completion of such ieport, the Board of Public Works is
directed to file a copy thereof in the City Clerk's office for public
inspection.
5. Upon receiving the report of the Board of Public Works, the
City Clerk is directed to give notice of a public hearing on such
reports as specified in Section 66.60(7) of the Wisconsin Statutes.
The hearing shall be held by the Board of Public Woxks at the Council
Chambers in the City Hall at a time set by the Clerk in accordance
with Section 66.60(7) of the Wisconsin Statutes.
6. The Wisconsin Public Service Corporation of Oshkosh,
Wisconsin, is hereby required to install gas mains in said stxeets and
service laterals at such intervals as the Board of Public Works shall
direct, said work to be completed priox to the improvement of said
street, the City Clerk shall forward a certified copy of this
resolution to said corporation forthwith.
7. The Board of Public Works and the proper City officials shall
do all things necessary so as to complete the installation of storm
sewers in said streets prior to the improvements thereof, if
necessary.
8. The installation of said street improvements shall be
accomplished according to the pcovisions of Section 25-3 thru 25-11 of
the Oshkosh Municipal Code.
