HomeMy WebLinkAbout33431 / 85-08June 20, 1985 (CARRIED � LOST LAID OVER CITY COUNCIL OF THE CITY OE OSHKOSH, WISCONSIN Resolution No. 8 RESOLUTION WITHDRAWN ) A RESOLUTION CREATING THE ELDERLY HOUSING AUTHORITY OF THE CITY OF OSHKOSH WHEREAS, the City o£ Oshkosh, Wisconsin (the "City") is a municipal corporation organized and existing under and pursuant to the laws of the State of Wisconsin and is authorized by Section 66.395, Wisconsin Statutes, as amended (hereinafter sometimes re£erred to as the "Elderly Housing Authority Law") by proper resolution of this City Council to declare that there is a need for an elderly housing authority ("Authority") in the City which shall be a public body corporate and politic authorized to transact business and exercise any and all powers granted to it in the Elderly Housing Authority Law, upon the making of certain findings by this City Council; and WHEREAS, it is the £inding and determination o£ this City Council that there is a shortage of dwelling accommodations in the City available to persons who are 62 years of age or older and families, the head of which, or his or her spouse, is 62 years or older ("Elderly Persons"); and WHEREAS, an Authority established by the City may exercise its powers to alleviate such shortage of accommodations £or Elderly Persons in part through cooperation between the Authority and private developers with respect to housing projects selected and approved by the Authority; and WHEREAS, it is the finding and determination of this City Council that the City would derive public bene£its from the creation of an Authority and the exercise by the Authority of its powers under the Elderly Housing Authority Law, including its power to issue revenue bonds to provide financing £or housing projects for Elderly Persons to be constructed by private developers, including by way o£ illustration but not limitation, the £ollowing: the provision of accommodations to Elderly Persons in the City; the provision and retention of gain£ul employment opportunities £or the citizens of the City; and the stimulation of the flow of investment capital into the City with resultant beneficial e££ects upon the economy in the City; and WHEREAS, it is the £inding and determination of this City Council that the public interest will be served i£ the City were to create an Authority in the City; - 11 - ..r . .... NOW, THEREFORE, BE TT RESOLVED: RESOLTUION # 8 1. This Common Council hereby finds that there is a shortage of dwelling accommodations in the City available to Elderly Persons and declares that there is a need for an Elderly Housing Authority in the City authorized to transact business and exercise any and all powers granted to such an Authority under the Elderly Housing Authority Law. 2. That this Common Council hereby creates the Oshkosh Housing Authority for Elderly persons, which shall consist of five (5) persons, and further authorizes said authority to transact business and exer- cise any and all powers granted to such an authority under Section 66.39s, wis. Stats. 3. This Resolution shall be effective immediately upon its passage and approval. Upon such approval, the Mayor or the City shall, with the confirmation of this City Council, appoint five (5) persons to serve as commissioners of the Authority. 5UBMITTED BY APPROVED - 12 - RESOLUTION # 8 CERTIFICATIONS BY CLERK I, DONNA C. Said resolution was considered £or adoption by the City Council at a meeting held in the City Hall at 7: 00 P.M. on June zp. 1985. Said meeting was a regular meeting o£ the City Council and was held in open session in compliance with Subchapter IV of Chapter 19 of the Wisconsin Statutes. 2. Said resolution was on the agenda £or said meeting and public notice thereof was given not less than 24 hours prior to the commencement o£ said meeting in compliance with Section 19.84 of the Wisconsin Statutes, including, without limitation, by posting on the bulletin board in the City Hall, by notice to those news media who have £iled a written request £or notice of meetings and by notice to the official newspaper of the City. 3. Said meeting was called to order by Mayor Propp who chaired the meeting. Upon roll I noted and recorded that the following � were present: Council Members .Tamrc Ma+har Bernice Teichmiller Floyd Chapin Don Kutchera 'I omas inn Kathleen Propp and that the following �,i}��p were absent: Council Members Robert Punct I noted and recorded that a quorum was present. Various matters and business were taken up during the course of the meeting without intervention o£ any closed session. One of the matters taken up was said resolution which was introduced and its adoption was moved by ����xi Kutchera , and seconded by �2�Rm Binner Following discussion and after all aldermen who desired to do so had expressed their views for or -3- - 13 - � RESOLUTION # 8 against said resolution, the question was called and upon roll being called and the continued presence of a quorum being noted, the recorded vote was as £ollows: Aye: Mather, Teichmiller Chapin, Kutchera _B�nner. Propp Nay: Abstain: Npne Whereupon the Mayor declared said resolution adopted, and I so recorded it. 4. Said resolution was approved by the Mayor on June 20, 1985, and I have so recorded. Clerk November 7, 1985 RESOLUTION APPROVING RENTAL HOUSING PROJECT OF THE ELDERLY HOUSING AUTHORITY OF THE CITY OF OSHKOSH, WISCONSIN (WHISPERING PINES PROJECT) WHEREAS, on October 30, 1985, a public hearing was held before the Elderly Housing Authority o£ the City of Oshkosh, Wisconsin, (the "Authority") with respect to a rental housing project for elderly persons (the "Project") to be located at 1255 West 18th Avenue, in the City of Oshkosh; and 'r7HEREAS, notice o£ such public hearing, in the form attached as Exhibit A hereto and incorporated herein (the "Notice"), was published by one insertion in the Oshkosh Northwestern, the of£icial newspaper of the City £or the publication o£ notices pursuant to Chapter 985 0£ the Wisconsin Statutes and a newspaper o£ general circulation in the locality of the Project, no less than fourteen .(14) days prior to the date of such public hearing; and WHEREAS, such public hearing was conducted in a manner that provided a reasonable opportunity to be heard for persons with differing views on both issuance of the bonds re£erred to in the Notice (the "Bonds") and the location and the nature of the Project, which is to be financed by the Bonds; and WFiEREAS, the Authority has made a report of such public hearing to this body, which report this body has considered; and WHEREAS, this body is an elected leqislative body of the City; NOW, THEREFORE, on behal£ of the Authority, for the purposes of Section 103(k) o£ the Internal Revenue Code of 1954, as amended, this body hereby approves issuance of the Bonds for the Project. * * ,r * The foregoing resolution of the City Council of the City of Oshkosh was adopted and recorded on November 7, 1985. —����Fi�u ��!_�����._�_ Mayor � . �� � /I, 9 , �!��l �V / ��. L-.i Clerk MJM2IA:B Exhibit A NOTICE OF PUBLIC HEARING TO RESIDENTS OF THE CITY OF OSHKOSH, WISCONSIN NOTICE is hereby given that the Elderly Housing Authority of the City of Oshkosh, Wisconsin (the "Authority") will hold a public hearing at 8:30 a.m. on October 30, 1985 at Marian Manor, 600 Merritt Avenue, Oshkosh, Wisconsin, regarding the proposed issuance by the Authority of revenue bonds pursuant to Section 66.395 and Sections 66.40 to 66.404 of the Wisconsin Statutes, as amended, in a maximum aggregate face amount of $2,750,000 (the "Bonds"), on behalf of whispering Pines Associates, a Limited Partnership, a Wisconsin limited partner- ship to be organized in which Gordon Decker and Alarlene Decker will be general partners. The bonds would finance the con- struction of a multifamily residential rental facility for elderly persons containing approxi�ately 66 apartments and related equipment and facilities. The orospective location of the facility to be financed is 1255 West 18th Avenue, Oshkosh, Wisconsin. The initial owner of the facility will be Flhispering Pines Associates, a Limited Partnership. THE BONDS WILL NOT CONSTITUTE AN INDEBTEDNESS OF THE CITY OR THE AUTHORITY F]ITHIN THE MEANING OF ANY F?ISCONSIPI CONSTITUTIONAL PROVISION OR STATUTORY LZMITATION AND WILL NOT CONSTITUTE OR GIVE RISE TO A PECIINIARY LIABILITY OF THE CITY OR THE AUTHORITY OR A CHARGE AGAINST THE GENERAL CREDIT OR TAXING POWERS OF THE CITY OR THE AUTHORITY. The public hearing will be conducted in a manner that provides a reasonable opportunity to be heard for persons with differing views on both issuance of the bonds and the location and nature of the proposed facility. Any person desiring to be heard on this matter is requested to attend the public hearing or send a representative. Written comments (not exceeding 250 words) to be considered at the hearing may be submitted to the Authority.
