BE IT RESOLVED by the Common Council of the City of Oshkosh that the
Preliminary Plat known as Rusch-Gabert Subdivision, described below, is
hereby approved:
A parcel of land being part of Outlot "A", B1ock 3, "01son Acres",
being part of the N?dl/4 ef the �W1/4 of Sectiun 2, T18N, K16E,
City of Oshkosh, Winnebago County, Wisconsin, which is more
fully described as follows: commencing at the N1/4 corner of said
Section-2; thence S OG'-43'-45" E, along the west line of the
NE1/4 of said Section 2, 987.57 feet; thence N 89°-05' E, 11.19
feet �.o the SW corner of Outlot "A", Block 3, Olson Acres; thence
N 89`-05' E, 191.43 feet to the point of beginning, thence N
CO"-50'-45" W, 166.27 feet; thence S£�9'-09'-15" W, 191.43 feet
to a poinC on the W line of sGid GutLat "�1"; thence N 01°-22'-45"
W, along the west line of said Outloc "A", 66.00 feet co the SI2

BE IT FURTHER RESOLVED that approval of the Preliminary Plat known
as Rusch-Gabert Subdivision is contingen[ upon the folLowing:
1. The payment of park fees in lieu of dedication of $100
per lot be paid prior to final plat approval.
2. A covenant requiring $100 per unit in lieu of park
dedication be placed on t}ie final plat.
3. A grading and drainage plan for the total development
be submitted prior to final plat approval of Phase I.
The drainage plan to indicate Phase I drainage into
the Vinland Road ditch, and Phase II utilizing storm
sewer.
4. That the lots on the north section of the development
be�a minimum of 80 feet wide, per developer's proposal.
5. That apprc�:al is based upon the phased development
proposal, wherein a final plat w.ill first be submitted
fo: the westerly 240 feet oi the plat, and later for
the remaining area shown.
6. City of Osh'�:osh Subdivision Ordinance, Section 30-42
relative to required improvemen[s to Subdivisions.
