PURPOSE: APPROVE AGREEMENT WITH WISCONSIN PUBLIC SERVICE
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED by the Common Council of the City of Oshkosh
that the proper City officials are hereby directed and authorized
to enter into the attached agreement with Wisconsin Public Service
regarding the 900 Block of Oregon Street project, removing the
overhead system and services and installation of new underground
system in the amount of $8,598.00.
BE IT FURTHER RESOLVED that money for this purpose is hereby
appropriated from:
Account No. 339-989 -- Special Assessments-Others

Dear Jerry:
Total cost for the removal of the overhead system and services
and the installation of the new underground system amounts to $8,598.
Two copies of our standard underground contract are enclosed for
your signature. We need both copies returned along with a purchase
order covering the total amount of construction cost.
Along with this infornation I've also provided a sketch of the
proposed construction and a detailed drawing of the transforrner
pad that's required.

1. This contcact is null and void if conditions foc installacion aie not met by the applicant within 60
days of [he signing of this contract.
2. The applicant agrees that sezvice will beqin at said location qoalifying foc exiension allovance vi[hin
[vo months aftec the canpany canpletes the installation of the equipnent necessacy to [endec secvice and
tha[ payments will begin, in accocdance with the applicable cate schedule, wi[hin �hree months aftec the
afocesaid canpletion of the installation.
3. The company shall de[ezmine the most pzacticable location for the line extension, and shall pcepace and
furnish the necessacy papecs for secucing cight-of-way. The applicant agrees to secuce the necessacy
easements without cost to the company. .
4. The applicant agcees to provide free of chacge, pcoper and sufficient space, cleared of all obstacles,
on the prernises foc the construction, opeiation, and main[enance of the company's lines; and fucthec
agrees pecmanently [o pecmi[ the company to cut, tcim, oc perfocm othei wock [o contiol tzees on the
cight-of-way, to set anchocs whece necessacy, and do other things essential to the efficient and safe
opecation of said lines and equipmen[. No buildings oc [iees shall be placed on said rights-of-way, but
they may be used for gacdens, shzubs, landscaping and othec purpos=c thaG will not interfere vith
maintenance of electc u facilities.

recording the necessary grant of ziqht-of-way ovec the applicant's propecty along a route Yo be mu[ually
agreed upon between the applicant and the company.
7. If sezvice to the applicant is pact of a pcojec[ to secve several appl?cants fcom one extension it is
undecstood that this agteaneo[ shall be binding on the pacties hece[o, only when and if [he canpany
secuces sufficient agceements to wazcant the undectaking of the projece.
8. It is fucthec agzeed that i£ the applicant leases, sells, oc otherwise disposes of the propecty hecein
described, he sha11 tm plete the payments according [o this contxact unless he shall have secured an
assumption of his cemaining obligations on the contract, satisfac[oiy to and appcoved by the company.
9. All Ehe tecros and conditions of this agceement shall extend to and be binding upon the heizs, executors,
-ad.ainistraio[s, successors�and assigns of the pacties hereto.
10. The paymen[ calculation of this contzact is subject to change when customec causes constcuction delay or
change in scope, oc wnen actions by govecnmental authocities eause a calculation change. M y change
shall be zeviewed vi[h Che applicant.
11. The company vill use ieasonable caie to provide an unintecrupted and a regolac supply of service, but
shall not be liable for any loss, injucy or damage cesultir.g from intecruptions, deficiencies oc
irperfections of service no[ due to villful default oc negligence on its pazt.
Without limiting [he generality of [he focegoing, the compsny shall have the cight to cause seevice to
any customec to be intercup[ed oc limited at any time wi[hout Liability by automatic devices oc
o[hecvise when, in the jud9ment of the canpany, such inteicuotions or limitation aie necessacy oc
desicable due to arecgency conditions.
12. The applican[ and the company hezeby agree to abide by and be subjec[ to the rules, teguLations, and
schedules of the comoany as filcv3 with and aporoved hy the Public Service Com�nission of Wisconsin fcom
time to time, as well as the cules and regulations of the h'isconsin Pdministrative Code.

TO ALL INSTALLATIONS INVOLV[NG ONDERGROUND FACSLITIES
1. Where undecground sys[em is cequested, the applicant shall specifically define the azea to be served by
undergcound facili[ies and shall insert a clause in all deeds and/oc abs[cacts cequiiing undecground
elecccic facilities within this defined acea,

conpany, canpacted soil gcading within siz inches oE finished grode of the area covered by the cights-
of-woy so thac the undergcound facilities can Se propecly installed in celation to t�e finished gcade.

to inscallation of tacili[ies. The company shall be notified in advance oE any change in grade levels.
Any and all coscs incucced as a cesul[ of such change shall he ac the expense of the pcopecty ownec.
