ANTI-DISCRIMINATION REQUIREMENTS
FOR
Lakeside Flastics, Inc.
INDUSTRIAL DEVELOPMENT REVENUE
BOND PROJECT
RESOLUTION NUMBER 12
WHEREAS, the City of Oshkosh, hereinafter called the
"Municipality", has by resolution of its Commo❑ Council
expressed its intent to issue its industrial revenue bonds
pursuant to Sec[ion 66.521 of the Wisconsin Sta[utes in an amount
not to exceed $400,000.00, for the purpose oE financing on behalf
of Lakeside Plastics, Inc., hereinafter called the "Company"
costs rela[ed to the purchase and installation of equipment for
the facility presen[ly operated by the Company in Che City in
connection with its business, which construc[ion, equipping and
related improvements are herein called the "Project", and
WHEREAS, Section 66.521 (11) (b) l. (i) of the Wisconsin
Statutes provides that construction work which is let by contract
and which has an estima[ed cost exceeding $5,000 may be financed
with indus[rial revenue bonds only if the contract is let to the
lowest responsible bidder and proposals for [he contracC are
advertised by publishing a Class II notice undec Ch. 985 and (ii)
prohibits discrimination in access or employment based on race,
creed, sex, handicap, ethnic origin, age or marital status with
regard to construction and operation of projec[s fina�ced under
the Act, and
WHEREAS, the Company has made representa[ions to the
City that compliance with the notice and public bidding
requirement in the firs[ sentence of said Section 66.521 (11 (b)
l. could render the Company unable Co employ the services of
companies the Company believes to be best suited to perfocm
construction work on the Project and tha[ while the Company
supports anti-discrimination policies of the type enunciated by
the statu[e, it would prefer in the light of negotia[ions with
prospec[ive purchasers and the need for certainty in the context
of the bond financing to have them effectuated by a contractual
provision with a cleacly specified remedy, and
WNEREAS, Section 66.521 (11) (b) 2. of the Wisconsin Statutes
provides the City with au[hocity to waive Che public bidding and
anti-discrimination requirements.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the
City of Oshkosh [hat this Common Council hereby finds (i) that
the imposition of the public no[ice and biddi�g requirements of
Wis. Sta[s. Sec. 66.521 (11) (b) 1, could render [he Company

unable to employ the services of companies Che Company believes
to be bes[ suited Co perform construction work on the Project as
well as hinder Che expeditious development of the Projecc and
(ii) tha[ Che an[i-discrimina[ion requiremen[s are more
appropriately handled in the light of the needs of this bond
financing by contract with [he Company; and, therefore, this
Common Council pursuant Co the authori[y granted to i[ by Section
66.521 (11) (b) 2. of [he Wisconsin Statu[es hereby waives the
requirements of Sec.521 (11) (b) 1. of the Wisconsin Statutes
wiCh cegard to the ProjecC, provided that the revenue producing
agreemen[ or agreemen[s for the financing shall contain an
anti-discrimination provision satisfactocy to the Ci[y of
Oshkosh.
FUR'CHER RESOLVED, That the City Clerk is hereby directed to
publish [his Resolu[ion as a Class 1❑otice under Ch. 985, Wis.
Stats., in the Oshkosh Northwestern, [he official newspaper of
the City.
