HomeMy WebLinkAbout33675 / 85-20Noves�ber 21, 1985 # 20 RESOLUTION (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: INSTIAL RESOLUTION FOR VARIOUS STREET AND UTILITY IMPROVEMENTS INITIATED: DEPART2dENT OF PUBLIC WORKS BE IT RESOLVED by the Common Council of the Cit3 of Oshkosh as follows: 1. The Common Council hereby declares its intention to exercise its power under Section 66.60 of the ti9isconsin Statutes to levy special assessments upon property within the following described areas for benefits conferred upon such property by improving the following named streets, said public improvements to include the following: A. Farmington Avenue, Vinland Street East 441 feet; (a) Sanitary Sewer (c) Laterals (b) Water Main (d) Gradinc & gravelina B. So. Westfi2ld St., and comm. at the N. end of the cul-de-sac approx. 310 feet S. of Witzel Ave., Witzel Ave. South 1150 feet; (a) Sanitary Sewer (d) Storm Sewer (b) Water idain (E) Grading & graveling (c) Laterals 2. Said public improvement shall include the grading of the above named stxeet to the grade hereaf�er established by special ordinance of the City of Oshkosh, and concrete paving as described above and appurtenant work with concrete curb and gutter on both sides of the street at a grade heretofore established by special ordinance of the City of Oshkosh. 3. Before such improvements are made, the Board of Public Works is directed to cause water and sewer service pipes to be laid in said streets fron the mains to the curb line of each lot fronting on the said streets and to keep an accurate account of the expense incurred in front of each lot and report the same to the Comptroller who shall cause the amount charqed to each lot to be entered on the tax roll as a special tax against said road, provided, however, that the Board of Public Works shall not cause such laterals to be so laid for any particular lot, or parcel where, in the opinion of the Board of Public V7orks, it would be impractical to do so. 4. The total amount assessed against such district shall not exceed the total cost of the improvements, and the amount assessed against any parcel shall not be greater than the benefits accrued thereto from said improvements. -23- Nov. 21, 1985 . , 5. The Board of Public Works is directed to prepare a report consisting of: a. Final plans and specifications for said improvements. b. An estimate of the entire cost of the improvements and laterals. c. An estimate as to each parcel of property within the assessment district of: (1) The assessment of benefits to be levied for each improvement. (2) The damages to be awarded for property taken or damages by each improvement. (3) The net amount of benefits over damages or of damages ovEr Uenefits for each improvement. Upon completion of such report, the Board of Public works is directed to file a copy thereof in the City Clerk's office for public inspection. 7. Upon receiving the report oF the Board of Public Works, the City Clerk is directed to give notice of a public hearing on such reports as specified in Section 66.60(7) of the Wisconsin Statutes. The heaririq shall be held by the Board of Public Works at the Council Chambers in the City Hall at a time set by the Clerk in accordance with Section 66.60(7) of the Wisconsin Statutes. 8. The installation of said street improvements shall �e accomplished according to the provisions of Section 25-3 through 25-11 of the Oshkosh Municipal Code.
