As you know, this partnership is presently developing real estate in the City of Oshkosh having frontage on Witzel Avenue. we understand that the City owns certain property which lies generally South of property being purchased by our clients. Specifically this is property owned by Virginia R. Bleckinger. The pu�pose of this letter is to outline a proposal for acquisition of the lands owned by the City of Oshkosh with terms and conditions to be as follcws: I. SELLER. The Seller would be the City of Oshkosh, a political s�ib-division of the cr?re of w;scons.i.n- II. B[JYE12. The Buyer would be HWP Enterprises, a Wisco.^.sin partnership. III. PROPERTY S�BJECT TO S��I.E. The property subject to sale would be a triangular parcel of prooerty contiguous to the Bleckinger property consisting of appror.imately 4,0�4.35 square feet as shown on Aer.o-Metric Engineering survey dated October 10, 1985, Notebook No. 86. IV. PURCHASE PRICE. The purch�se price would be the sum of 5200.00 to be paid in cash at closinc. - 16a - RFGOLOTION # 14 Mr. Boyd Kremer Page 2 October 29, 1985 V. CONDITION TO CLOSING. The obligation of purchaser to close the transaction would be conditioned on the following: a. C.'. Upon the closing of the Bleckinger parcel and acquisition of Bleckinger land by purchaser. Upon rezcnir.g the subject parcel consistent with zoning of Bleckinger and Schramm property. VI. CLOSING/EVZDENCE OF TITLE. Closing would be subject to the following conditions: a. Expenses prorated in accord with normal real estate transactions involving municipality. b. Conveyance to be supported by appropriate copy of resolution authorizing execution of deed and by certified copy of resolution showing rezoning. c. Evidence of title to be by ti*_le insurance, abstract, or letter report at option of City. d. Closing to be held at or within thirty (30) days of closing on Bl�ckinger parcel or upon completion of conditions for rezoning or City resolution, whichever occurs last. VII. ACCEPTANCE OF OFFER. '1'nis offer of purchase shall remain open for a period of ten (10) days. It may be accepted by providing written notice of acceptance to the undersigned at his business address. At the expiration of ten (10) days this offer shall expire if not accepted and be null and void. SUMMI{RY. This note referred to my earlier letter to you of October 29, 1985 outlining a proposal for purchase of a sma11 parcel of land located in the City of Oshkosh. Please be advised that I have the authority to amend Paragraph seven (7) of the Offer in the following respect: VZI. I�CCEPTANCE OF OFFER. This offer of purchase shall remain open until November 23, 1985. It may be accepted by providing written notice of acceptance to the undersigned at his business address. If no such acceptance has been macie on or beLOre November 2S, 1585 tnis offer shall expire and thereafter be null and void. In all other respects, the offer remains in full force and effect. I trust that the terms outlined herein will be sufficient for your purposes and if you need something further, please advise. As I think you are aware, onr client is willing to purchase the property if that is convenient for the City of Oshkosh but we have no re+l need for the property. Whichever way it works best for the City would be fine with my client. ..
