MOSLING PLAN COMMISSION RECOMMENDATION: Approved 5-1 with conditions WHEREAS, it appears that the public interest requires that the following described street in the City of Oshkosh be vacated and discontinued, NOW, THEREFORE, BE IS RESOLVED by the Common Council of the City of Oshkosh that a hearing on the passage of the following resolution shall be held before the Common Council in the Council Chambers in the City Hall, City of Oshkosh, Winnebago County, Wisconsin, on the 15th day of May, 1986, at 7:00 P-M. of said day and the proper City officials are hereby authorized and directed to give notice of said hearing by personal service and publi- cation of said hearing as provided by law: BE IT FURTHER RESOLVED by the Common Council of the City of Oshkosh parsuant to Section 66.296(2) of the Wisconsin Statutes, that it is hereby declared that since the public interest requires it, the following described street in the City of Oshkosh, Winnebago County, Wisconsin, be vacated and discontinued: The 60' right-of-way of Lake Street extending south from the intersection of Lake Street and Bay Shore Drive to Lake Winnebago, 8th Ward, City of Oshkosh, Winnebago County, Wisconsin. February 12, DEPARTMENT OF COMMUNITY DEVELOPMENT Ne are �riting as the tar.pay�rs !�ho own the property on either side of Lake Street where it meets the Fox River, south of Bay Shore Drive. We have a fair and positive proposal. Years ago, when Oshkosh was a much different place, some city street crew took it upon themselves to lay a little asphalt on the end of Lake Street in order to create a makeshift boat ramp. There were very few, or perhaps no other public places at the time to launch boats. For that matter, there were few boats and most of them were small. Now, however, we have fine municipal boat launching sites at Menominee, Steiger, Rainbow Parks and the 24th Street facility. These have toilet and waste disposal facilities. They have ample parking for the cars and the large trailers which are needed for the boats which people now prefer. They have adequate security and safety lighting, and they have docks that pecple can use to safely get into and out of their boats. The Lake Street alley between our houses surely must be a nuisance now. City crews must spend time and money on mainienance and litter pick up. It is a popular hangout for vandals. As something of an attractive nuisance, it probably represents a disproportionate liability risk. There does not appear to be any other street or alley in the City which is kept in this way. 3vat traiiers anu ca�s often blotk cff Qay Shore and Lake Street as they jockey around getting positioned in the alley. The streets are inadequate for this now. In addition both streets often become, in effect, one-lane roadways as cars and trailers park on both sides of the streets after launchings. As the boats have become bigger, and their number have increased, the actual boating season has grown longer. We now have launchinqs occurring from 4:30 in the morning around the clock until midnight virtually from ice- out to freeze-up. — 23a — RESOLUTION # 17 Mr. Willia, Frueh City Manager Page -2- Oshkosh, WI February 12, 1986 We have imposed on us constant problems of litter and security. Our yards are used for toilet facilities. titter is a continual problem. The ]ighthouse is a histor?c 13�dmark ih3t h85 been one of the City's visual symbols since 1909. It is privately maintained and is taxed to us by the City. It has been a source of pride, but now is almost a nuisance to us. Stone-throwing and vandalism have made us reluctant to light it for fear of what additional problems it will attract. As a result, we no longer provide its navigational aid to boaters on the lake at night. We ask that Lake Street be affirmatively abandoned as a launch site. Remove the asphait. Plant it with grass, or make it more like the other street endings on Bay Shore. In fact, consider abandoning it. We pay over $9,000 per year in property taxes, but we would be pieased to pay.the taxes on this strip if it were returned to private ownership. � . � � i. D.
