PURPOSE: AMEND WASTEWATER SYSTEMS ORDINANCE
INITIATED BY: CITY ADMINISTRATION
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTIONS 24-6�
24-6.1(C), 24-6.3(A), 24-6.3(F), 24-6.3(H), 24-6.301, 24-6.7(F)
AND 24-6.7(G) OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO WASTEWATER
SYSTEMS.
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Section 24-6 of the Oshkosh Municipal Code is
amended by relettering paragraphs (JJ) thxough (YY) to (KK) through
(ZZ) respectively, and by creating new paxagraph (JJ) to read as
follows:
(JJ) SIGNIFICANT INDUSTRIAL USER OR SIGNIFICANT USER -- Any
Industrial User of the City's wastewater disposal system
who:
1. has a flow greater than 5 percent of the flow in the
City's wastewater treatment system, or
2. is subject to national categorical pretreatment stan-
dards and/or discharges toxic pollutants in amounts
potentially or actually exceeding limits set forth in
this Chapter, or
3. has a significant impact, either singly or in
combination with other contributing industries, on
the wastewater treatment system, the quality of
sludge, the system's effluent quality, or air
emissions generated by the system, or
4. has an organic concentration of biochemical oxygen
demand (BOD), suspended solids or phosphorus greater
than 210, 340 and 12 milligrams per liter (mg/1),
respectively.
SECTION 2. That Section 24-6.1(C) of the Oshkosh Municipal
Code is amended by renumbering paragraphs (5) and (6) to paragraphs
(6) and (7) respectively, by repealing and recreating paragraph (4)
to read as follows:
(4) Solid or viscous substances which will or may cause
obstruction to the flow in sewers, or other interference
with the proper operation of the wastewater system such
as, but not limited to, ashes, cinders, sand, mud, straw,
shavings, metal, glass, rags, feathers, wax, grease, tar,
plastics, wood, unground garbage, whole blood, paunch
manure, hair and fleshings, entrails, and
cups, miJk containers, etc., either whole
garbage grinders.

by creating new paragraph (5) to read as follows:
(5) Specific Pollutant Limitations
No person shall discharge wastewater at any outfall
entering the City sewer system containing the following
pollutants in excess of the following maximum 24-hour
average concentrations or the maximum average concentra-
tion during the period of discharge if less than 24 hours.

of petroleum oil, non-biodegradable cutting oils, grease or
other products of mineral oil origin.

SECTION 3. That Section 24-6.3(A) of the Oshkosh Municipal
Code is repealed and recreated to read as follows:
(A) Submission of General Dischaxge Data
Within 90 days after passage of this ordinance, each user
discharging industrial process wastewater to the
wastewater system, if notified by the Approving Authority,
shall be required to obtain a discharge permit and file
with the Authority an Industrial wastewater Discharge
Application, to be furnished by the authority, which shall
supply pertinent data, including estimated quantity of
wastewater flow, wastewater characterists and consti-
tuents, plant operational characteristcs and other perti-
nent information requested with respect to the industrial
production process and wastes. The questionnaire must be
signed by an authorized representative of the industrial
user.

Similarly, each industrial discharger desiring to make a
new connection to the system, or modifying an existing
process or connection to the system, shall be required to
file with the authority a revised Industrial Wastewater
Discharge Application, ���1� s�8�. and obtain a
new wastewater discharge permit, j,_f �policabl�, before
connecting to the wastewater system, or modifying its
process or connection.
SECTION 4. That Section 24-6.3(F)(3) of the Oshkosh Municipal
Code is repealed and recreated to read as follows:
(3) Periodic Monitoring Reports
Any industry subject to a pretreatment standard or other
requirement set forth in this ordinance, after the
compliance date of such standard or requirement, or, in
the case of a new industry, after commencement of the
discharge to the wastewater system, shall allow the
Appxoving Authocity semiannually, unless required more
frequently by the authority, to monitoi the nature and
concentration of prohibited or regulated substances in the
industxial effluent which are limited by the Pretreatment
Standards and/or other requirements hereof. The cost of
any or such monitoring performed at the industry as
directed by the Approving Authority shall be billed to the
industry in accordance with this Ordinance. The Approving
Authority may choose to have the city perform such
monitoring or contract services of an engineering firm,
decided through a bidding process, to conduct the
monitoxing. Personnel from a contracted engineering firm
shall be deemed duly authorized representatives of the
city and shall have the right of entry to inspect, observe,
and sample as provided for in Section 24-6.6(A) of the
Sewer Use Ordinance.
In addition, if required by the authority, the industry
shall submit a repoxt to the authority by June 31st and
December 31st of each year, or other dates as established,
that should contain but is not limited to the following
items:
(1) A record of all measured or estimated average and
maximum daily flows from designated points that
occurred duting the reporting period. Flows shall be
reported on the basis of actual measurement,
provided, however, where cost or feasibility
considerations justify, the Approving Authority may
accept reports of average and maximum flows estimated
by verifiable techniques.
(2) Volumes and dates of discharge of all batch tank
contents discharged to the sanitary sewer during the
reporting period and scheduled discharges during the
next reporting period.

wastewater and provided to the industry.
(5) The report shall be signed by an authorized
representative of the industrial usec.
SECTION 5. That Section 24-6.3(H) of the Oshkosh Muinicipal
Code, the introductory three unnumbered paragraphs only, is repealed
and recreated to read as follows:
(H) Wastewater Discharge Permit
No significant industrial user discharging industrial
wastewaters into the City's wastewater system shall
discharge or cause to be discharged into the wastewater
system any wastewater except upon application to the
Approving Authority and upon receipt of a wastewater
permit. Application for a wastewater discharge permit
shall be on a form furnished by the Authority. A waste-
water permit shall be in addition to any other permit
required for connection to the public sanitary sewer
system. The fee required for a wastewater discharge
permit shall be $20.00.
All existing significant industrial wastewater discharges
shall apply for a wastewater discharge permit within 30
days after the effective date of this ordinance, and shall
obtain a wastewater permit within 90 days after the
effective date of this Ordinance.
Similarly, each significant industrial wastewater
discharger desiring to make a new connection, or to modify
an existing process or connection to the wastewater system
shall apply for a new wastewater discharge permit, at
least 90 days before desiring such modification or
connection and shall receive a permit before the process
modification or connection is made to the wastewater
system. ,
(EXPLANATORY NOTE: Paragraphs (1), (2) and (3) of Section 24-
6.3(H) as now amended remain unchanged.)
SECTION 6. That Section 24-6.301 of the Oshkosh Municipal Code
is created to read as follows:
SECTION 24-6.301 SEPTAGE DISPOSAL
(A) Prohibition

cause the introduction of, septage into the City's waste-
water system except upon application to the Approving

Authority and upon receipt of a septage disposal permit.
All disposals shall comply with the provisions of this
Section.
(B) Definitions
For purposes of this Section:
(1) "Sanitary waste hauler" shall mean a person whether
representing himself or another individual, a
company, business or corporation engaged in the
transportation of septage from a point of original to
a point of disposal.
(2) "Septage" shall mean scum, liquid, sludge or other
waste from a septic tank, said absorption field
holding tank, vault toilet, or privy. It does not
include the waste from a grease trap unless mixed
with other septage.
(C) Permit and Fees

(D) Procedures
1. All regulations in Chapter 24, City of Oshkosh
Municipal Code, Wastewater Systems, shall be
observed.
2. Sanitary waste haulers, holding an active permit from
the City of Oshkosh Wastewater Treatment Plant may
discharge septage at the Oshkosh Wastewater Treatment
Plant, 233 Campbell Road, from 7:00 A.M. to 8:00
P.M., Monday through Saturday, excepting holidays.
3. Discharge to the wastewater system shall be at a
location designated by the Wastewater Division.
Discharge at any other location without prior written
approval from the Approving Authority shall be deemed
a violation of this Section.

4. Septage discharges shall be subject to periodic
inspection and testing, and a determination of
character and concentration of said wastes. The
determinations shall be made by the waste genecator
or the permitted discharger as often as may be deemed
necessary by the City of Oshkosh.
5. Upon request of oshkosh Wastewater Treatment Plant
personnel, the discharger shall provide a
representative sample of the septage to be
discharged.
6. Oshkosh Wastewater Treatment plant employees shall
direct the discharger to cease the discharge of any
waste determined to be incompatible with the
wastewater system.
7. Prior approval shall be required for the discharge of
septage at time periods or locations other than those
specifically designated.
8. A manifest form, supplied by the City of Oshkosh,
shall be completed and filed with the Wastewater
Treatment Plant at the time of each discharge.
9. The discharger shall clean up all spills or other
deposits resulting from his activity at any point in
the City of Oshkosh.
(E) Service Charaes
All septage discharged into the wastewater system shall be
billed in accordance with this Chapter and shall be
charged the fees specified in Section 24-6.5(E)(4).
Additional charges may be levied for wastewater discharge
of unusual strenqth, damage to the wastewater system, its
structures or apparatus, or restoration of the discharge
area required as a result of spills or other hauler
activities.
(F) Non-compliance and Penalties
(1) Failure to comply with the provisions of this Section
shall subject the violator to suspension of the
permit for 30 days for the first violation and for 90
days foc the second violation, and to revocation of
the permit for the third violation, all within two
year permit time. Appeal may be had to the Approving
Authority.
(2) In addition to the foregoing, any person who violates
any provision of this Section, upon conviction
thereof, shall forfeit not less than Fifty Dollars
($50.00) for the first offense, not less than One
Hundred and Fifty Dollars ($150.00) for the second
offense and not less than Three Hundred Dollars
($300.00) for any subsequent offense, each forfeiture

not to exceed Five Hundred Dollars ($500.00),
together with the costs of prosecution, or in default
of payment thereof be imprisoned in the Winnebago
County jail for a period not to exceed thirty (30)
days. Each violation even though such violations
shall be consecutive, shall constitute a separate
offense.
SECTION 7. That Sections 24-6.7(F) and (G) of the Oshkosh
Municipal Code are repealed and recreated to read as follows:
(F) Annual Publication of Violators
A list of all industrial users which, during the past 12
months, were significantly in non-compliance with the
Industrial Wastewater Discharge Program requirements of
this Ordinance shall be published at least annually, by
the Approving Authority, in the official publication at
least annually, by the Approving Authority, in the
official publication daily newspaper. "Significantly in

(G) Riaht of Appeal
Any industery or other discharger or any interested party
shall have the right to request, in writing, within �Q
davs of receiving a wastewater permit or enforcement
action, an interpretation or ruling from the Approving
Authority on any matter covezed by this Ordinance and
shall be entitled to a prompt written reply. if the user
does not file an appeal with the Approving Authority
within said time, the wastewater permit or enforcement
action is final. In the event that such inquiry is by an
Industry and deals with matters of performance or
compliance with this ordinance, or deals with a Wastewater
Dischaxge Permit issued pursuant hereto for which
enforcement activity relating to an alleged violation is
the subject, receipt of an Industry's request shall stay
all enforcement proceedings, pending receipt of aforesaid
written reply.
SECTION 8. This ordinance shall be in full force and effect
from and after its passage and publication.
