PURPOSE: INITIAL RESOLUTION - LIGHTING AND LANDSCAPING
400 BLOCK NORTH MAIN STREET
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED by the Common Council of the City of Oshkosh as
follows:
1. The Common Council of the City of Oshkosh hereby declares its
intention to exercise its power under Section 66.60 of the Wisconsin
Statutes to levy special assessments upon property within the
following described areas for benefits conferred upon such property by
improvement of the following named streets, said public improvement
shall consist of lighting and landscaping:
(a) NORTH MAIN STREET from Washington Ave. to Church Ave.
(b) ALGOMA BOULEVARD, north side from N. Main Street to
107 feet westerly of N. Main Street
(c) WASHINGTON AVENUE, north side, from N. Main Street to
125 feet east of N. Main Street
(d) MERRITT AVENUE, south side, from N. Main Stxeet to
112 feet east of N. Main Street
(e) CHURCH AVENUE, south side, from N. Main Street to
86 feet westerly of N. Main Street.
2. Said improvements shall consist of street improvements
including lighting and landscaping at qrades heretofore established
by special ordinance of the City of Oshkosh.
3. Before such improvements are made, the Board of Public Works
is directed to cause water and sewer service pipes to be so laid in
said streets from the main to the curb line of each lot fronting on
the said streets and to keep an accurate account of the expense
incurred in front of each lot and report the same to the Comptroller
who shall cause the amount charged to each lot to be entered on the
tax roll as a special tax against said road, provided, however, that
the Board of Public Works shall not cause such laterals to be so laid
for any particular lot or parcel where, in the opinion of the Board of
Public Works, it would be impractical to do so.
4. The total amount assessed against such district shall not
exceed the total cost of the improvements and the amount assessed
against any parcel shall not be qreater than the benefits accrued
thereto from said improvements.

5. The assessments against any parcel may be paid according to
the provisions of Section 25-83 thru 25-89 of the Oshkosh Municipal
Code.
6. The Board of Public Works is directed to prepare a report
consisting of:
a. Final plans and specifications for said improvements.
b. An estimate of the entire cost of the improvements and
laterals.
c. An estimate as to each parcel of property within the assess-
ment district of:
(1) The assessment of benefits to be levied for each
improvement.
(2) The damages to be awarded for property taken or damages
by each improvement.
(3) The net amount of damages over benefits or of benefits
over damages for each improvement.
Upon completion of such report, the Board of Public Works is
directed to file a copy thereof in the City Clerk's office for public
inspection.
7. The Wisconsin Public Service Corporation of Oshkosh,
Wisconsin, is hereby required to install gas mains in said streets and
service laterals at such intervals as the Board of Public Works shall
direct; said work to be completed prior to the improvement of said
streets. The City Clerk shall forward a certified copy of this
resolution to said corporation forthwith.
8. The Board of Public Works and the proper City officials shall
do all things necessary so as to complete the installation of storm
sewer in said street prior to the improvements thereof.
9. The installation of said street improvements shall be accom-
plished according to the provisions of Section 25-3 thru 25-11 of the
Oshkosh Municipal Code.
10. Upon receiving the report of the Board of Public Works, the
City Clerk is directed to give notice of a public hearing on such
report as specified in Section 66.60(7) of the Wisconsin Statutes.
The hearing shall be held by the Board of Public Works in the Council
Chambers in the City Hall at a time set by the Clerk in accordance
with Section 66.60(7) of the Wisconsin Statutes.
