HomeMy WebLinkAbout33966 / 86-131June 5, 1986 # 131 RESOLUTION (CARRIED PURPOSE: INITIATED BY: LOST__ LATD OVER_____WITHDRAWN ___) SET WAGE RATE SCALE FOR PUBLIC WORKS PROJECTS FROM JULY 1, 1986 TO JUNE 30, 1987 DEPARTMENT OF PUBLIC WORKS WHEREAS, Section 66.293 of the Wisconsin Statutes provides that it shall be the duty of every city which proposes the making of a contract for any project of public works to determine the rate of wage scale which shall be paid by the contxactor to the employees upon such ptoject, and reference to such scale having to be published in the notices issued for the purposes of securing bids for any projects; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached schedule marked "Exhibit A" and made a part hereof as though fully set out at length herein is hereby determined to be the rate of wage scale for such public works; and the City Clerk is directed to file same and to use same in connection with and as directed by said statutes, same being the rate of wage scale published by the Builder and Construction Trades Council of Oshkosh and vicinity, and same shall remain in full force and effect; and in the event that the present contracts now under negotiations are adopted resulting in an increase in the rate of wage scale over and above these established in the schedule marked "Exhibit A", the same wage scale adopted as the result of said negotiations shall automatically become the rate of wage scale for the City of Oshkosh as required by Section 66.293. K Five Paid Holidays. �� The "prevailing hours of labor" for all classes of taborers and mechanics are eight hour per day and forty hours per calendar reek. All work perfortred in excess of these prevailing hours must be paid at a rate of at least 1-1/2 times the hourly basic rate of pay (plus fringe benefits if applicable). ?� A rate for learner, helper, pre-apprentice or trainee far this trade or xcupation is available upon request. If use of such rate is conteiplated, request such rate rp ior to starting wrk on the projxt. ss. 66.293(3)(a)(e), Wis. Stats. My contractor, subcontractor or agent thereof, wtw fails to pay the prevailing rate of wages determined by the department under this subsxtion or pays less than 1-1/2 times the hourly basic rate of pay for hours worked on the projxt in excess of the prevailing hours determined under this subsection, shall be liable to the aryloyes affected in the arount of their unpaid minimim wages or their unpaid overtime caryensation and an additional anpunt as liquidated damages. Action to recover the liability may be maintained in any court of cmpetent jurisdiction by any one or more arpioyes for and in behalf of himself and other enptoyes similarly situated. No eryloye shall be a party plaintiff to any such action unless he gives his consent in writing to becare such a party and.the consent is filed in the court in which the action is brought. The court shall, in addition to any judgnent awarded to the plaintiff, allaw a reasonaGle attorney's fee and costs to be paid by the defendant. Each contractor, subcontractor or agent thereaf participating in a project wvered by this subsection shall keep full and accurate records clearly indiwting the name and trade or occupation of every laborer, workman or mechanic eryloyed by him in con�rection rith the project and an accurate record of the nuiber of hours worked by each mploye and actual rages paid therefor.
