HomeMy WebLinkAbout33976 / 86-141June 5, 1986 (CARRIED _ FIRST READING LOST # 115 LAID OVER PURPOSE: AMEND MINIMUM HOUSING CODE INITIATED BY: CODE ENFORCEMENT DIVISION ORDINANCE WITHDRAWN ) A GENERAL ORDINANCE OF THE CITY OF OSHROSH AMENDING SECTIONS 16-23, 16-24, 16-31, 16-33, 16-34, 16-35 AND 16-45 OF THE OSHROSH MUNICIPAL CODE PERTAINING TO MINIMUM HOUSING CODE AND ROOMING HOUSE REQUIREMENTS. The Common Council of the City of Oshkosh do ordain as follows: Section 1. That Section 16-23 of the Oshkosh Municipal Code pertaining to inspections is amended to delete paragraph (C) and to reletter paragraph (D) to (C). Section 2. That Section 16-24 of the Oshkosh Municipal Code pertaining to notices is amended by repealing and recreating paragraphs (A) and (5) as follows: (A) Whenever the Housing Inspector determines that there has been a violation or that there are reasonable grounds to believe that there has been a violation of any provision of this Article, he shall give written notice of such violation or alleged violation to the party responsible for maintaininq the premises in compliance with this Article or agent as designated in writing. (5) Be served upon the responsible party or agent as designated in writing, provided, however, that such notice shall be deemed to be properly served upon such party, if a copy thereof is delivered to him personally or if not found, by leaving a copy thereof at his usual place of abode, in the presence of someone of the family of suitable age and discretion who shall be informed of the contents thereof, or by sending a copy thereof by registered mail, with return receipt required, to his last known address, or if the registered letter with the copy is returned with a receipt showing it has not been delivered, to him, by posting a copy thereof in a conspicuo�s place in or about the dwelling affected by the notice. - 13 - June 5, 1986 #115 Cont'd. Section 3. That Section 16-31 of the Oshkosh Municipal Code pertaining to emergency orders is repealed and recreated as follows: SECTION 16-31 EMERGENCY ORDERS - HOUSING INSPECTOR - NOTICE If the Housing Inspector shall determine that a building is in such condition that it constitutes a public nuisance and that there is great and immediate danger to the public health, safety, and welfare and if the owner, or occupant if appropriate, refuses to comply with orders within the time prescribed, the Housing Inspector, or other designated officer, shall cause such building or part thereof to be closed if unfit for human habitation, occupancy, or use. The Inspector shall post a placard on the premises containing the following words: THIS BUILDING CANNOT BE USED FOR HU�AN HABITATION, OCCUPANCY OR USE. It is the duty of the Housing Inspector, or other designated officer, to prohibit the use of the building or part thereof for human habitation, occupancy or use until the necessary repairs have been made. The procedure followed shall be pursuant to Section 16-24. Section 4. That Section 16-33 of the Oshkosh Municipal Code pertaining to minimum standards for equipment and facilities is amended by repealing and recreating paragraphs (A) and (6) as follows: (A) All habitable buildings subject to the provisions of this Article shall comply with the following requirements for basic equipment and facilities. (6) Stairways in single and two family dwellings shall be of safe and sound construction, equipped with proper handrails mounted not less than two feet six inches (2' 6") above the nose of the treads and equipped with treads and risers reasonably uniform. Stairways in other multiple family dwellings shall comply with the appropriate provisions of the state uniform building code contained in the Wisconsin Administrative Code. Section 5. That Section 16-34 of the Oshkosh Municipal Code pertaining to minimum standards for heating, ventilation, electrical service and lighting is amended by repealing and recreating paragraphs (A)(1), (A)(2)(b) and (A)(3)(a) as follows: (1) Heating Every dwelling shall have heating facilities which are capable of safely and adequately heating all habitable rooms and bathrooms to a temperature of at least sixty- seven degrees (67°) Fahrenheit with an outside temperature of minus fifteen degrees (-15°) Fahrenheit without forcing the heating facilities beyond safe capacity. All - 14 - June 5, 1986 # 115 Cont'd. facilities shall be operated to maintain at least this minimum temperature during all occupied periods. (2) Ventilation (b) Every bathroom have at least or be equipped system to the (3) Electrical service and every toilet compartment shall one (1) window openable to the outside, with a mechanical exhaust ventilation outside or an appoved ductless device. (a) Every habitable room shall contain at least two (2) separate wall-type electric convenience outlets or one (1) such convenience outlet and one (1) ceiling- type or wall-type electric fixture; and every water closet compartment, laundry room, furnace room and public hall shall contain at least one (1) ceiling or wall-type electric fixture. Every bathroom shall contain one wall convenience outlet and one wall or ceiling light fixture. Every such outlet and fixture shall be properly installed and shall be maintained in a good and safe working condition and shall be connected to the source of the electric power in a safe manner. Section 6. That Section 16-35 of the Oshkosh Municipal Code pertaining to requirements for maintenance is amended by repealing and recreating paragraphs (A)(1)(a), (A)(1)(d) and (A)(2) and by creating paragraph (A)(1)(e) as follows: (1) Floors, walls, etc. (a) Every floor, wall, and roof shall be privacy, and kept condition. ceiling, exterior door, foundation weathertight, capable of affording in good repair and in a clean (d) All windows shall be maintained in good repair and in a weathertight condition. (e) All interior doors shall be maintained in good repair. (2) Stairs and porches Every inside and outside stair, every porch, every guardrail and every appurtenance thereto shall be so constructed as to be safe to use and capable of supporting the load that normal use would cause to be placed thereon, and shall be kept in sound condition and good repair and in clean condition. Such stairs and porches shall be kept free of refuse or stored material. - 15 - June 5, 1986 #115 Cont'd. Section 7. That Section 16-45 of the Oshkosh Municipal Code pertaining to minimum requirements is amended by repealing and recreating paragraph (B)(2) as follows: (2) communal cooking and dining facilities in a rooming house shall be kept by the owner, operator or agent designated in writing, in a safe, sanitary and orderly condition. Section 8.
