PURPOSE: APPROVE AGREEMENT WITH HNTB/SUPPLEMENTAL TASK ORDER NO. 3
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED by the Common Council of the City of Oshkosh that
the attached agreement with Howard Needles Tammen & Bergendoff, being
Supplemental Task Order No. 13 to the Agreement dated 6/20/79, is
hereby approved.
BE IT FURTHER RESOLVED that money for this purpose is hereby
appropriated from: Account No. 349-145 -- Sanitary Sewer Construc-
tion in Progress.

13-1.0 Purpose
The purpose of this Supplemental Task Order is to establish scope, schedule
and payment provisions for Step 1, the facilities planning phase of the
program as more specifically described herein.
13-1.1 Consultant shall not con¢nence work on any task defined by this Task
Order agreement until authorized by the City.
13-1.2 Agreement by the City to the provisions of this Task Order does not
obligate the City to the Consultant for funding or authorization of any
portion of this work until such time that the City authorizes the work
defined herein.
13-1.3 The Consultant shall not retain the services of any Subconsultant
for assistance witn che tasks dzscribad :erein w-ithcut authoriza*_ion �v the
City of Oshkosh.
13-2.0 Scope
The scope of the work to be performed under this Supplemental Task Order
shall in accordance with the qeneral provisions described in the Agreement
between the City of Oshkosh and Howacd Needles Tan¢nen & Bergendoff, dated
June 20, 1979, Article 2.1.2 and 2.1.2.1, "Facilities planning phase. Upon
receipt of the City's written authorization to proceed with the facilities
planning phase the Consultant shall: "Prepare a facilities planning study
and report in accordance with the EPA State regulations, and as further
defined in supplemental task orders."
13-2.1 The C�TSULTANT will provide the following engineering services
under this Supplemental Task Ocder for the Phase 2 portion of the program
service area defined as Districts C, D, E and F north of the Fox River, and
Districts AG, AI, AJ and AY south of the Fox River:
13-2.1.1 PROJECf MANAGEMENT - Consultant shall provide overall management
services to assist the City with the administration of Step 1 activities in
this portion of the Phase 2 program area, and overall management of the
below listed tasks.
13-2.1.2 FLGW M�IITORING - Consultant shall monitor wastewater flows in
these areas to provide a flow pattern data base for evaluation of the
quantity and likely swrces of cleatwater infiltration and inflow through a
minimiun of one wet weather event and to assess the degree of relief pro-
vided by completed Phase 1 constniction.
13-2.1.3 CLEF.�ITER ZNVESTIGATION - Consultant shall perform minimal
visual inspections, smoke testing, and dyed water tracing activities in the
Districts listed to document major identifiable sources of clean�ater
infiltration or inflow indicated by flow monitoring records and to verify
major I/i source removals.

13-2.1.4 FACILITIES PLAN At�IDMENP - Consultant shall prepare an amendment
to the project facilities plan, based on results of the above activities,
that should include develoFanent of alternative solutions in accordance with
the established program criteria for elimination of wet weather surcharging
in the Phase 2 areas, application of the original cost-effectiveness
analysis of alternative solutions, and confi�mation or refinement of the
plan selection for implementation steps identified in the original
Facilities Plan.
Consultant shall prepare amendments to the following facility plan sections
to specifically address these distcicts in the Phase 2 area:
Chapter 3- Description of Existing Situation
Description of the Existing Sewerage System
Chapter 5 - Aiternatives
Purpose and Scope
Alternative Analysis
Chapter 6 - Plan Selection
Purpose and Scope
Cost-Effectiveness Analysis Sw�miary

It is understood that the unlisted sections of the facility plan apply as
approved to the limited scope of this continuing Step 1 activity.
13-2.1.5 FACILITY P?AN P.M_FNC*4�:T SUBMI'!'�'�.T� — Coasultar±t shall work with
the City to su�nit the proposed facility plan amendment to regulatory
agency review staff, and to respond to regulatory agency review coam�ents as
necessary to gain agency approval.
13-3.0 Schedule
The work under this Supplemental Task Order shall coaunence upon receipt by
the Consultant of an executed copy of the Supplemental Task Order, and
written authorization to proceed from the City to the Consultant. Proposed
amendments to the facility plan will be submitted to the City for their
review prior to sulxnittal to the regulatory agency. The schedule for
subdnittal of the amendment documentation is subject to the occurrence of a
significant rainfall event, but is expected to follow conclusion of flow
monitocing activities by four or five weeks. The services to be provided
herein will conclude upon the regulatory agency's notice of approval of
su�nitted amendments to the facility plan.

13-4.0 Small or Minority Business Enterprises (AIDE)
Small or minority business enterprise involvement in this limited scope
task order is impractical and not cost-effective. Substantial small and
minority business involve�nt has been maintained throughout the entice
Phase 1 portion of the program, and will be pursued thcoughout subsequent
Step 2 and Step 3 activities.
13-5.0 Payment
13-5.1 Payment for the work defined under this Supplemental Task Order
shall be on the basis of a cost plus fixed fee in accordance with the
general provisions described in Article 5.1.1 of the Consultant Services
Agreement between the City and Consultant dated June 20, 1979. Total
charges for this Supplemental Task Order will not exceed $21,550, unless
othenaise agreed to in writing.
13-5.2 The estimated direct labor costs, indirect costs, other direct
costs, and profit will be itemized in the Supplemental Task Order COST OR

and on the attachments incidental to those fozms.
IN WITNESS WF�REOF, the parties have caused this Supplemental Task Order
No. 13 to be executed the year and the day belaa written by their proper
officers and representatives.
