PURPOSE: AMEND WEAPONS PROHIBITIONS
INITIATED BY: POLICE DEPARTMENT
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTIONS 18-23
AND 18-24 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO PROHIBITING
CERTAIN WEAPONS
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Sections 18-23 and 18-24 of the Oshkosh
Municipal Code pertaining to Concealed Weapons Prohibited and Sale
of Dangerous Weapons to Minors Prohibited are repealed.
SECTION 2. That Section 18-23 of the Oshkosh Municipal Code is
created to read as follows:
SECTION 18-23 DANGEROUS WEAPONS PROHIBITED
(A) As used in this chapter, "dangerous weapon" shall mean and
include, but is not limited to because of enumeration: any
, firearm, whether loaded or unloaded; any device designed as a
weapon and capable of producing death or great bodily haxm; any
electric weapon as defined in Sec. 941.295(4), Wis. Stats.; any
instrument which expels a missile or other object by the
expansion of compressed air or other gas, by spring or any
other means; crossknuckles, blackjack, billy; any knife which
has a blade three inches or longer, or a blade which may be
drawn without the necessity of contact with the blade itself;
martial arts type weapons such as, without limitation because
of enumeration, Shruiken (death stat), Tonfa, Nunchaku (or mini
chuck), Manrikigusari (fighting chain); or any othex device or
instrumentality which, in the manner it isused or intended to
be used, is calculated or likely to produce death or great
bodily harm.
(B) No person other than a peace officer shall, within the
limits of the City, carry or wear under the clothes or shall
conceal about the person any dangerous weapon.
(C) No person other than a peace officer shall enter any
building owned or leased by the State of Wisconsin or any
political subdivision, the United States of America, or any
other governmental entity while armed with a dangerous weapon.

(D) No person shall buy for, sell, or give away to any minor,
any dangerous weapon except household purpose knives or knives
having blades less than three inches long without first having
obtained the written consent of the pazent or guardian of such
minor.
(E) No minor may possess any dangerous weapon without the
express consent of the minor's parent or guardian. Any such
weapon may be confiscated by a peace officer and held for a
ieasonable period of time until the issue of consent can be
established; if proper consent has been determined, the
confiscated weapon shall be returned to the parent or guardian
of the minor unless the possession of same is prohibited by
other provisions of this Chapter or any other statute or law.
SECTION 3. That this ordinance shall be in full force and
effect from and after its passage and publication.
