HomeMy WebLinkAbout34157 / 86-359NOVEMBER 6 1986 (CARRIED LOST PURPOSE: INITIATED BY: LAID OVER # 359 RESOLUTION WITHDRAWN ) APPROVE CONTRACT BETWEEN THE UNIVERSITY OF WISCONSIN- OSHKOSH AND THE CITY OF OSHKOSH FOR RELOCATION ASSISTANCE SERVICES UNIVERSITY OF WISCONSIN-OSHKOSH, BOARD OF REGENTS WHEREAS, the University of Wisconsin-Oshkosh, Board of Regents, under the provision of Chapter 32 of the State Statutes is a Condemnor, possessing the power of emin�nt domain; and WHEREAS, the Board of Regents is required to provide relocation assistance to persons, families, businesses, farms and others displaced by reason of public acquisition activities under Chapter 32 of the State Statutes and may contract with an experienced agency to provide reloca- tion assistance; and WHEREAS, the City of Oshkosh is an experienced relocation agency familiar with State and Federal relocation regulations; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached Contract for Relocation Assistance Services to the University of Wisconsin-Oshkosh, Board of Regents, is hereby approved. BE IT FURTHER RESOLVED that the proper City officials and appropriate staff inembers be hereby authorized and directed to execute the attached contract to provide relocation assistance services. SUBMITTED SY + e / :. n — 12 — J RESOLUTION # 359 CONTRACT fOR RELOCATION ASSISTANCE SERVICES THIS AGREEMENT, entered into this day of , 198 , by and between the City of Oshkosh, State of Wisconsin, hereinafter referred to as the "City", and the Board of Regents of the University of Wisconsin System, Chapter 36, central administrative office located at 1930 Monroe Street, Madison, Wisconsin, hereinafter referred to as the "Board", WITNESSETH: WHEREAS, the laws of Wisconsin domain, and, Board under the provisions of Chapter 32 of the is a Condemnor, possessing the power of eminent ,�u�REAS the Bcar,d 's ��G�ir�d ro Prov;de relocation ���� , assistance to persons, families, businesses, farms and others dispiaced by reason of public acquisition activities under Wisconsin Statutes, Chapter 32, and, WHEREAS, the Board proposes to provide public improvements and will displace persons, families, businesses, farms and/or others in the course of their activities, and, WHEREAS, Chapter 32 of the Wisconsin Statutes provides that a Condemnor may contract with an experienced relocation agency to provide relocation assistance under this Chapter for those displaced by the action of the Board, and, WHEREAS, the City is experienced in residential and business relocation activities, and is prepared to provide such service under the provisions of Wisconsin Statutes, Chapter 32, NOW, THEREFORE, BE IT RESOLVED that the parties do hereby mutually agree as follows: Scope of Services. The City shall perform all of the necessary relocation services in connection witn and respecting the responsibilities of the Board as a Condemnor provided for in the Wisconsin Statutes, Chapter 32. The jurisdiction for administration of Chapter 32 shall be the corporate limits of the City of Oshkosh. The Board further agrees that all University departments shall provide complete cooperation to the City in the City's administration of the relocation assistance program. The City shall perform the following functions which shall include, but not be limited to, - 12a - � The preparation of to the Department Board office. Inspect and analyze replacement housing facilities as secured by displacee within the defined jurisdiction to insure that they meet D.S.S. standards as provided by law. d. Prepare .the r,ecessary for���s an� reports incidental to the adminstration of the program with all forms and reports to DLAD being submitted through the Board office. Establish a public information services and provide for the distribution of such information to displacees relating to the relocation assistance program. Analyze each relocation question and recommend, in writing, the amount of payments due each displacee as determined by the City and submit such determination to the Board, who will make the appropriate payments to the displacees. Maintain sufficient professional and administrative staff to perform the work herein set forth in accordance with the Wisconsin Statutes, Chapter 32. Prepare all reports relating to appeals of displacees to tne Department of Locai Affairs and/or courts having jurisdiction in the matter of the relocation program. Payment to Displacees. The City shall have no responsibility for any of the payments due to displacees resulting from activities by the 6oard. (Urban renewal activities undertaken under the Wisconsin Statutes 66.431 excepted.) Method of Pavment to the Citv. The City for its time, materials, local for all services rendered at a rate Dollars ($25.00) per hour for each the Scope of Services set forth in City shall bill the 6oard at 30-day - 12b - Board shail pay the travel and overhead of Twenty-five employee working on this Contract. Detailed records of the time spent under the terms of this Contract by employees of the City shall be kept and forwarded to the Board at time of billing. Failure by the Board to pay monthly invoices for a period of 60 days shall be sufficient grounds for the City to terminate this Contract. 4. Other Considerations. The Board shall pay the City for the actual cost of travel, food, lodging, and incidental costs resulting from nonlocal travel necessitated by the administration of this Contract and matters r2lating t��ereto. The Soard must approve all such nonlocal travel in advance. The Board shall pay the City for the actual costs of long distance phone calls occurring as a result of the administration of this contract. All costs of appeals and/or court actions for which the Board is alleged liable resulting from any determination of any governmental agency, commission or court having jurisdiction over appeals relating to relocation costs or costs incidental to relocation shall be paid by the Board. All activities herein provided shall be administered by the City without regard to race, creed, color, sex, or national origin. 5. Term of Contract. The term of this Contract shall be for a period of two (2) years ending December 30, 1988, unless terminated by either party, which termination shall be effected by either party giving ninety (90) Gays' notice of sucr� te�-minatior. 6. Cost Limitation. It is agreed and understood that the fees for services hereunder furnished by the City in accordance with the procedures of paragraph 3 shall not exceed a maximum allowable amount of Ten Thousand Dollars ($10,000.00) for the two-year period.
