HomeMy WebLinkAbout34187 / 86-3920 ,� � � NOVEMBER 20 1986 DECEMBER 4, 1986 ORDINANCE # 373 FIRST READING SECOND READING `� ���" (CARRIED 7AST LAID OVER WITHDRAWN ) PURPOSE: AMENDMENTS TO LAND SUBDIVISION ORDINANCE INITIATED BY: PLANNING AND RESEARCH DIVISION PLAN COMMISSION RECOMMENDATION: Approved 6-0 A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING VARIOUS SECTIONB OF TiiE OSHKOSH LAND SUBDIVISION ORDINANCE. The Common Council of the City of Oshkosh do ordain as follows: SECTION 1: That Section 30-38(B)(1) of the Oshkosh Municipal Code pertaining to the number of Preliminary Plats to be submitted is hereby amended to increase the number of plats to twenty-�on���E4� copies. - Six (26) SECTION 2: That Section 30-38(B)(2) of the Oshkosh Municipal Code pertaining to the number of Final Plats to be submitted is hereby amended to increase the number of plats to twenty-�aur_�34� copies. - six (26) SECTION 3: That Section 30-38(B)(1)(c) of the Oshkosh Municipal Code pertaining to the number of days the Common Council has to act on a plat is hereby amended to ninety (90) days. SECTION 4: That Section 30-38(B)(1)(e) pertaining to Preliminary Plats is hereby created to read as follows: (e) The developer/surveyor shall forward three (3) copies of the Preliminary Plat to both Wisconsin Public Service Corporation and Wisconsin Bell. One (1) copy shall be returned by the utility company to the developer/surveyor, one (1) copy shall be forwarded by the utility company to the City of oshkosh Planning and Research Division, and one (1) copy shall be retained by the utility company. SECTION 5: That Section 30-35(E) of the Oshkosh Municipal Code p2rtaining to Plats Outside the Corporate Limits is hereby amended by adding thereto reference to Sections 30-41, 30-42(B) and (C). SECTION 6: That Section 30-42(C)(6) of the Oshkosh Municipal Code is hereby retitled to "Street Surfacinct Curb and Gutters, and Sidewalks." - 1 - � l NOVEMBER 20 1986 # 373 ORDINANCE (cont'd) Said Subsection (6) is also hereby amended by adding thereto the following sentence to the second paragraph: "The cost of sidewalk installation shall be borne by the subdivider in accordance with Section 30-42(A) and (B)." Said Subsection (6) is also hereby amended by adding thereto the following paragraph between the second and third paraqraphs: All new subdivisions approved for development within the City of Oshkosh shall be required to install standard concrete sidewalks in accordance with the following standards: (a) Sidewalks shall be required on both sides of the street. (b) Sidewalks are not required on cul-de-sacs or dead end streets less than one hundred fifty (150) feet in length unless it is required by the Common Council. (c) Sidewalks shall be a minimum of four (4) feet in width for all residential subdivisions unless the sidewalk is on a designated aollector street, arterial street, or a street adjacent to a school, hospital or other public facility in which case the sidewalk shall be five (5) feet wide. (d) Construct3on of said sidewalks to be in conformance with requirements set forth in Chapter 25 of the City of Oshkosh Municipal Code. Said Subsection (6) is also hereby amended by adding thereto the word "sidewalks" to the last paragraph. SECTICN 7: That Section 3C^42(A);2) of the Oshkosh Municipal Code pertaining to methods of financing improvements to plats within the City limits is hereby amended by adding thereto the following to sentence three "except in the case of sidewalk installation."; and adding thereto the following before the final sentence: "In which case, sidewalks shall be constructed when seventy-five (75) percent of the lots within the subdivision are developed, but in no event before the street is paved or greater than five (5) years after Common Council approval of the final plat." SECTION 8: That Section 30-42(A)(3) Municipal Code pertaining to special assessment installation of improvements is hereby amended the words "sidewalk installation" to the first - z - of the Oshkosh financing for the by adding thereto paragraph. NOVEMBER 20 1986 # 3�3 ORDINANCE (cont'd) SECTION 9: That the first paragraph of Section 30- 42(C)(5) of the Oshkosh Municipal Code pertaining to storm sewers is hereby repealed and recreated to read as follows: (5) Storm Sewers. Storm sewers shall be constructed with the necessary facilities throughout the entire subdivision which shall be separate and independent of the sanitary sewer system, and which shall provide an adequate outlet or connection with the storm sewer system of the City. When storm sewers are not installed, adequate facilities for the removal of surface water shall be provided throughout the entire subdivision. SECTION 10: That Section 30-42(C)(5) of the Oshkosh Municipal Code pertaining to storm sewers is hereby amended by adding thereto the following paragraphs between the second and third paragraphs of subsection (5): All new subdivisions approved for development within the City of Oshkosh shall be required by the Common Council to install storm sewer laterals and extensions from the storm sewer with laterals exending therefrom for each building. Prior to occupancy of any of said buildings, the sump pump system shall be connected to the available storm sewer lateral. Cost for extensions shall be borne by the developer/subdivider and shall be in addition to the Five Dollar ($5.00) fee imposed by this subparagraph (5).
